According to the trial and evidence of the case, the judge in charge thinks that Xiao Zhao was at fault and failed to fulfill his duty of reasonable care. As a person with full capacity for civil conduct, Xiao Zhao should foresee that Xiao Li's physical and mental state will be different between drunkenness and normality, and he has just been lovelorn and his mental state is extremely unstable. And on the way back, I told Zhou Xiao on the phone that "I am a ghost and I won't let you go", so I should have foreseen the danger of Xiao Li swimming in Xiangjiang River at 2 am, which is unfamiliar with the situation. Although Xiao Zhao has taken corresponding measures to stop and search and rescue, it is still a fault and should bear corresponding responsibility for Xiao Li's drowning. However, Xiao Li himself fell into the river, which was the direct cause of his drowning, and had no direct causal relationship with the fault of the defendant Xiao Zhao.

Finally, the court ruled that Xiao Zhao should compensate the plaintiff 70,000 yuan at his discretion. The other two defendants had neither subjective intention nor negligence in Xiao Li's drowning incident and should not be liable for compensation. After the verdict was pronounced, neither party appealed, and the case has now taken legal effect.
