How to judge the infringement of photographic works

Legal analysis: the following two conditions should be met to determine the infringement of photographic works: 1. Photographic works enjoy copyright, which can be original acquisition, such as the author himself or derivative acquisition, such as the author's acquisition of rights through transferee; 2. Without the permission of the copyright owner, the actor copied, distributed and disseminated the photographic works to the public through the information network, or distorted the works, prevented the author from signing, or published the works without permission, which has infringed the personal rights of the copyright owner.

Legal basis: Article 7 of the Interpretation of the Supreme People's Court on Several Issues Concerning the Application of Laws in the Trial of Copyright Civil Disputes can be used as the basis. At the same time, in judicial practice, if the copyright owner can provide the true and effective registration certificate of the work recognized by the copyright bureau, the ownership of the work can be said to be indisputable.
