Article 1: In order to strengthen the management of rental housing in Shenzhen City (hereinafter referred to as the city), ensure the healthy development of the housing rental market, and maintain social security, these regulations are formulated in accordance with relevant laws and regulations. Article 2 The rental houses mentioned in these regulations include residential rental houses, industrial and commercial rental houses and other rental houses. Article 3 The housing leasing management department of the municipal or district people's government is the administrative authority for housing leasing. The municipal government's housing rental management department implements unified management of the housing rental market in accordance with the law.
The municipal and district rental housing comprehensive management agencies are responsible for the comprehensive coordination, guidance, inspection and supervision of rental housing management.
Municipal and district public security organs are responsible for the security management of rental housing, fire management and the household registration management of temporary residents.
The municipal and district taxation, industry and commerce, family planning, culture, health, quality and technical supervision, production safety supervision and management, and urban management departments manage rental housing within the scope of their respective responsibilities. Article 4 People's governments at all levels shall strengthen leadership and coordination over the management of rental housing. Article 5 The district people's government shall, based on actual needs, organize the district housing rental management department and the district public security organ, family planning department, taxation department and other functional departments to implement a joint office system to centrally handle the registration or filing of housing rental contracts and the registration of renter information. , household registration declaration, family planning management, tax collection and management, etc.
The specific measures for joint office work shall be formulated by the district people's government, and the funds for joint office work shall be allocated by the district finance department. Article 6: The management of residential rental houses shall implement the "Responsibility Letter for Comprehensive Management of Rental Houses" and the "Responsibility Letter for Family Planning" systems. Article 7 The parties involved in house leasing shall register or file with the house leasing management department within 10 days after the signing of the house leasing contract; after the house leasing contract is changed or terminated, the relevant parties shall report to the house leasing management department within 10 days from the date of change or cancellation of the contract. Submit relevant certification materials and go through relevant registration or filing procedures.
When registering or filing a lease contract (residential building), you should check the "Family Planning Responsibility Letter" signed by the lessor and the family planning department where the rental house is located. If the lessee is a temporary resident, he must provide a valid identity. Documents and family planning related documents that have been inspected by the family planning department where the rental house is located. Those who have not signed a family planning responsibility letter and do not have family planning-related documents that have passed the inspection should be registered and reported to the local family planning department in a timely manner.
The comprehensive management agency of rental housing should do a good job in collecting information, statistics and feedback on the tenants. Article 8: After reviewing the lease contract in accordance with the law, the housing rental management department shall issue a housing rental registration or filing certificate. The house rental registration or filing voucher is a valid document for relevant departments to handle relevant procedures. Article 9 The municipal housing leasing management department shall publish the guiding rent for housing leasing once a year. According to the actual needs of market changes, it may also publish the guiding rent for housing leasing once every six months. Article 10 The following houses are prohibited from being rented out:
(1) Houses that are determined to be dangerous and unusable by the relevant competent authorities;
(2) House demolition notices have been published;
(3) There is no proof of housing rights;
(4) Leasing is prohibited according to laws and regulations.
For houses rented out in the preceding paragraph, the relevant competent authorities shall clean up and demolish them in a timely manner in accordance with the law. If there are people living there, the relevant departments of the local government shall clean them up according to law; if there is illegal leasing, the municipal or district housing leasing management department shall confiscate the illegal income in accordance with the law and impose a fine of not more than one time of the illegal income. Article 11 The lessor shall perform the following obligations:
(1) Comply with relevant laws, regulations and rules;
(2) Residential rental houses should have basic living and safety conditions ;
(3) The house shall not be rented to persons without valid identity documents or without civil capacity; On the same day, report the basic situation to the comprehensive management agency of the rental house where the rental house is located, and submit the tenant information registration form to the comprehensive management agency of the rental house where the rental house is located within 3 days. When the occupants change, they should report to the rental house in a timely manner. Report to the comprehensive management agency;
(5) Report to the public security organs in a timely manner when discovering security risks in the rental house, and assist the public security organs in investigating and handling;
(6) Discover that the lessee and other residents have violated the law If you are suspected of committing a crime or committing a crime, you should report it to the public security organs or relevant functional departments in a timely manner;
(7) Assist the rental house management activities implemented by the relevant government departments. If the lessor entrusts others to assist, you should report to the house owner Filing with the leasing management department.
Article 12 The lessee shall abide by the following regulations:
(1) When leasing a residential house, the lessee must truthfully state the number of tenants, present valid identity documents of himself and other tenants, and truthfully fill in the number of tenants Information registration form;
(2) If other occupants change, the lessee should go through the registration change procedures for the tenant information on the same day;
(3) It must be within 3 days of check-in Go to the public security bureau where the rental house is located to apply for temporary residence registration, apply for temporary residence certificates in accordance with relevant regulations, and are not allowed to stay overnight with people without valid identity documents;
(4) The lessee shall not change the nature of the rental house without authorization, The use of rental houses to engage in business activities such as hotels, catering, entertainment, and Internet cafes must comply with relevant regulations;
(5) It is prohibited to use rental houses for gambling, drug trafficking, prostitution, pornography, and forgery of documents, Illegal and criminal activities such as printing illegal publications, manufacturing and selling fake and shoddy goods, harboring criminals, harboring and selling stolen goods;
(6) It is prohibited to use rental houses for pyramid schemes or disguised pyramid schemes, operate without a license, or start a business without a license Clinics, illegal medical practices, illegal recycling of renewable resources and other illegal activities;
(7) It is prohibited to use rental houses for unlicensed employment agencies, matchmaking, training, real estate agencies and other fraudulent activities;
(8) It is prohibited to use residential rental houses to produce, store, and operate flammable, explosive, toxic, radioactive and other dangerous goods; Report to the public security organs;
(10) Assist relevant government departments in the management of rental housing.
