Regulations of Jiangsu Province on Surveying and Mapping Geographic Information

Surveying and mapping geographic information, as a basic work related to national economy and people's livelihood, was widely used in all walks of life in ancient China.

Regulations of Jiangsu Province on Surveying and Mapping Geographic Information Chapter I General Provisions

Article 1 In order to strengthen the management of surveying and mapping geographic information, promote the development of surveying and mapping geographic information, ensure the service of surveying and mapping geographic information for economic construction, national defense construction, social development and ecological protection, and maintain the security of geographic information, these Regulations are formulated in accordance with the Surveying and Mapping Law of People's Republic of China (PRC) and other laws and administrative regulations, combined with the actual situation of this province.

Article 2 Those who engage in surveying and mapping activities, use surveying and mapping results and provide geographic information services within the administrative area of this province shall abide by these regulations.

Article 3 The local people's governments at or above the county level shall strengthen their leadership in surveying and mapping geographic information, strengthen the construction of surveying and mapping geographic information institutions and teams, strengthen basic surveying and mapping management and map awareness publicity and education, promote geographic information sharing, promote the integration of national defense science and technology with civil science and technology, and safeguard national sovereignty, security and interests.

Article 4 The competent department of surveying and mapping geographic information of the provincial people's government (hereinafter referred to as the competent department of surveying and mapping geographic information of the province) is responsible for the unified supervision and management of surveying and mapping geographic information of the whole province.

The competent department of surveying and mapping geographic information of the people's government of a city or county divided into districts (hereinafter referred to as the competent department of surveying and mapping geographic information of a city or county divided into districts) is responsible for the unified supervision and management of the work of surveying and mapping geographic information in this administrative region.

Other relevant departments of the local people's governments at or above the county level shall be responsible for surveying and mapping geographic information related to their own departments in accordance with the division of responsibilities stipulated by the people's governments at the corresponding levels.

Article 5 The local people's governments at or above the county level and their relevant departments shall encourage the innovation and progress of surveying and mapping geographic information science and technology, adopt advanced technologies and equipment, organize scientific and technological research, strengthen scientific and technological exchanges and cooperation, and build an innovative system of surveying and mapping geographic information.

Units and individuals that have made important contributions to the innovation and progress of surveying and mapping geographic information science and technology and the management of surveying and mapping achievements shall be rewarded in accordance with the relevant provisions of this province.

Chapter II Basic Surveying and Mapping and Other Surveying and Mapping

Article 6 Basic surveying and mapping shall be managed at different levels.

Provincial Surveying and mapping geographic information department is responsible for the management of basic surveying and mapping at the provincial level. Provincial basic surveying and mapping includes:

(a) the construction and maintenance of provincial surveying and mapping benchmark system;

(2) acquiring and processing space remote sensing data resources;

(3) Surveying and updating digital products such as topographic maps, orthophoto maps and digital elevation models with scales of 1:5000 and 1: 10000;

(four) the construction of provincial basic geographic information spatio-temporal database system and its database update and maintenance;

(five) to compile and update the administrative map of the whole province;

(six) underwater topography and coastal beach topography survey in provincial waters;

(7) Normalized geographic national conditions monitoring and database updating and maintenance;

(eight) other basic surveying and mapping determined by the competent department of Surveying and mapping geographic information of the State Council and the provincial people's government.

The competent department of surveying and mapping geographic information of the city and county divided into districts is responsible for the management of basic surveying and mapping at the corresponding level. Basic surveying and mapping in cities and counties includes:

(a) the construction and maintenance of the city and county surveying and mapping benchmark system within their respective administrative areas;

(2) Surveying and updating digital products such as topographic maps, orthophoto maps and digital elevation models with scales of 1:500, 1: 1000 and 1:2000 within their respective administrative areas;

(three) the construction of the basic geographic information spatio-temporal database system and the updating and maintenance of the database within the administrative area;

(four) to compile and update the map of the administrative area at the corresponding level;

(five) the special monitoring of geographical conditions and the updating and maintenance of its database within its administrative area;

(six) other basic surveying and mapping determined by the competent department of surveying and mapping geographic information of the provincial and municipal people's governments with districts.

Article 7 Basic surveying and mapping is a public welfare undertaking. The local people's governments at or above the county level shall incorporate basic surveying and mapping into the national economic and social development plan and annual plan at the corresponding level, and include the funds required for basic surveying and mapping in the government budget at the corresponding level.

Article 8 The competent department of surveying and mapping geographic information shall organize the implementation of basic surveying and mapping projects at the corresponding level according to the basic surveying and mapping planning, annual plan and project technical design.

The technical design of basic surveying and mapping projects shall conform to the specifications, and be demonstrated by experts and submitted to the competent department of surveying and mapping geographic information of the province.

Article 9 The competent department of surveying and mapping geographic information shall, jointly with relevant departments, establish a regular updating mechanism for basic surveying and mapping results. The renewal period of provincial basic surveying and mapping results shall not exceed three years; The renewal period of basic surveying and mapping achievements at city and county level shall not exceed two years, among which the renewal period of basic surveying and mapping achievements in urban built-up areas shall not exceed one year, and the core elements such as administrative divisions and roads shall be updated immediately.

Tenth in the administrative area of this province engaged in surveying and mapping geographic information activities, should use the prescribed surveying and mapping system and surveying and mapping benchmark.

Due to the needs of urban and rural planning, construction and scientific research, if it is really necessary to establish a relatively independent plane coordinate system in small and medium-sized cities and large-scale key construction projects in this province, it shall be submitted to the competent department of surveying and mapping geographic information of the province for approval.

The establishment of a relatively independent plane coordinate system should be related to the coordinate system. Only one relatively independent plane coordinate system can be established in the same city or local area.

Eleventh the establishment of digital regional geospatial information infrastructure, geographic information public service platform and financial investment of geographic information system, should adopt the unified standard of basic geographic information data in the province.

Article 12 Surveying and mapping aerial photography shall be reported to the military surveying and mapping department for approval in accordance with relevant regulations.

If it is necessary to use unmanned aerial vehicles for photography due to surveying and mapping, the relevant provisions of air flight control shall be observed.

Satellite remote sensing surveying and mapping data and basic aerial photography purchased with financial funds shall be uniformly organized and implemented by the competent department of surveying and mapping geographic information and provide results.

Article 13 The competent department of surveying and mapping geographic information shall, according to the needs of emergency response, formulate an emergency surveying and mapping support plan, establish an emergency surveying and mapping support mechanism, and organize remote sensing monitoring, navigation and positioning, geographic information data application, retrieval and transmission and other related work.

Article 14 The competent department of surveying and mapping geographic information may requisition surveying and mapping equipment and surveying and mapping results from surveying and mapping geographic information units in response to emergencies. After the emergency response is completed, it shall be returned in time. Surveying and mapping equipment is damaged or lost, it shall be compensated according to law.

Fifteenth competent departments of Surveying and mapping geographic information shall organize the monitoring of geographical conditions according to law, and publish the monitoring information of geographical conditions after soliciting the opinions of relevant departments and reporting to the people's government at the same level for approval.

Units engaged in monitoring geographical conditions shall regularly monitor, count and analyze geographical conditions in accordance with unified norms and standards, and be responsible for the quality of monitoring results of geographical conditions.

Article 16 If the attached drawings of the real estate ownership certificate issued by the real estate registration agency involve surveying and mapping, they shall be surveyed and mapped by units with corresponding surveying and mapping qualifications.

Real estate surveying and mapping shall implement relevant measurement specifications and technical standards, and abide by relevant regulations. Real estate surveying and mapping results shall be audited and signed by professional and technical personnel with surveying and mapping qualifications.

If there is any objection to the results of real estate surveying and mapping, the quality supervision and inspection institution of surveying and mapping results may be entrusted for identification.

Seventeenth engineering survey activities in the fields of water conservancy, energy, transportation, communication, municipal administration, resource development, etc., should be carried out in accordance with the relevant technical specifications of engineering survey, and accept the supervision and management of the competent department of surveying and mapping geographic information.

Chapter III Surveying and Mapping Achievements

Eighteenth surveying and mapping results in accordance with the law to implement the exchange system. Surveying and mapping geographic information units shall ensure the quality of surveying and mapping results.

The use of surveying and mapping results, the implementation of unified standards, * * * construction * * * to enjoy, to ensure the safety of the principle.

Twenty-first surveying and mapping results completed with financial funds shall be provided free of charge if they are used for government decision-making, national defense construction and public services. Units that use surveying and mapping results for free shall not use surveying and mapping results for profit-making activities, and shall provide information that can be used to update basic surveying and mapping to the competent department of surveying and mapping geographic information for free.

Except in the circumstances specified in the preceding paragraph, surveying and mapping results shall be paid for use according to law, and a list of paid use prices shall be announced to the public.

Article 22 The confidentiality of surveying and mapping results shall be governed by the provisions of confidentiality laws and administrative regulations. If it is really necessary for the relevant departments and units of this province to provide classified surveying and mapping results and materials to foreign organizations or individuals and foreign-invested enterprises, they shall conduct confidential technical treatment and submit them for approval in accordance with relevant regulations.

Twenty-third basic surveying and mapping results should be backed up in different places.

The storage facilities and conditions of surveying and mapping data files shall conform to the provisions and requirements of confidentiality, network information security, fire protection and file management, and ensure the integrity and safety of surveying and mapping results.

Twenty-fourth important geographic information data of this province shall be audited by the competent department of Surveying and mapping geographic information of the province. After consultation with the relevant departments of the provincial people's government and the military surveying and mapping department, it was approved by the provincial people's government and announced to the public.

The important geographic information data of this province mainly refers to the important data such as the location, elevation, depth, area and length of natural and human geographic entities within the administrative area of this province, as well as the related attribute data such as rivers, lakes, rivers, mountains, caves and islands; Geographic information data such as Jiangsu with the word Jiangsu shall be audited by the competent department of surveying and mapping geographic information according to law.

If the contents specified in the preceding paragraph belong to important geographic information data, they shall be reviewed and published in accordance with relevant regulations.

Twenty-fifth surveying and mapping geographic information units shall establish and improve the quality assurance system, and be responsible for the quality of their completed surveying and mapping results. The competent department of Surveying and mapping geographic information is responsible for the quality supervision and management of surveying and mapping results within their respective administrative areas.

The results of basic surveying and mapping and other surveying and mapping geographic information projects using financial funds, which meet the prescribed standards, shall be inspected by the quality supervision and inspection institutions of surveying and mapping results, and can only be provided for use after the quality is qualified. The specific standards of financial funds are determined by the competent department of Surveying and mapping geographic information of the province.

Units that organize the implementation of surveying and mapping geographic information projects shall cooperate with the quality supervision and inspection of surveying and mapping results organized by the competent department of surveying and mapping geographic information according to law.

Twenty-sixth surveying and mapping geographic information projects using financial funds and other surveying and mapping geographic information projects involving the use of financial funds shall make full use of existing suitable surveying and mapping achievements and shall not repeat surveying and mapping.

For the projects listed in the preceding paragraph, the relevant departments that have approved the establishment of the project shall solicit the opinions of the competent department of surveying and mapping geographic information at the same level in writing within five working days after accepting the application. The competent department of Surveying and mapping geographic information shall put forward written opinions within five working days.

Chapter IV Map Management

Twenty-seventh local people's governments at all levels and the relevant departments and units of surveying and mapping geographic information, press and publication, radio and television, civil affairs, education, network information, etc. should strengthen the publicity and education of territorial awareness and enhance citizens' territorial awareness.

The news media should publicize the territorial consciousness to the public through various forms.

Primary and secondary schools should strengthen territorial awareness education in combination with relevant courses and organize students to participate in territorial awareness publicity and education activities.

Twenty-eighth the compilation and publication of maps and the provision of Internet map services shall comply with the relevant provisions of the province on map management.

The relevant departments and units shall, in accordance with the relevant provisions of the province, provide the surveying and mapping units with the current data and information required for the compilation of maps.

Twenty-ninth competent departments of Surveying and mapping geographic information shall publish the standard samples of their administrative areas to the public, and update them regularly to provide free use.

The compilation of administrative maps does not pay for geographical elements.

When compiling electronic navigation maps, public transport maps, tourist maps and other maps, important public geographic information such as organs, medical institutions, universities, libraries, etc. shall be marked, and no labeling fee shall be charged.

Thirtieth provincial surveying and mapping geographic information department is responsible for the province's map and the main performance including two or more municipal administrative regions of the map audit.

The teaching map of local primary and secondary schools in this province is examined and approved by the Provincial Department of Education in conjunction with the Provincial Surveying and Mapping Geographic Information Department.

The production and production of audio-visual products, signs, advertisements, toys, souvenirs and handicrafts with schematic map graphics of national boundaries or provincial administrative boundaries shall use the standard descriptive graphics approved and published by the State Council; Products made by production and production units with maps and graphics shall be submitted to the competent department of surveying and mapping geographic information of the province or the competent department of surveying and mapping geographic information of the city divided into districts for review.

Thirty-first atlases (volumes), government service maps and Internet public service maps, the competent department of Surveying and mapping geographic information may entrust a map content review agency to review. Commissioned by the map content review agencies for professional review, it shall inform the submitting unit, the time of map content review is not included in the time limit for map review.

The map content examination institution shall complete the examination within fifteen working days. The competent department of surveying and mapping geographic information responsible for map audit shall make an audit decision within five working days after receiving the review opinions of map content.

Thirty-second Internet map service units shall, in accordance with the provisions, conduct security inspections on Internet map service websites, and map security auditors shall be responsible for reviewing, uploading and publishing geographic information and abide by the confidentiality provisions.

Chapter V Geographic Information Services

Article 33 The competent department of surveying and mapping geographic information shall, jointly with relevant departments, formulate policies for the development of geographic information industry, guide and support surveying and mapping geographic information units to provide socialized geographic information services through cooperative development, resource replacement, agency sales and technical services, and promote the socialized application of geographic information.

Article 34 The local people's governments at or above the county level shall organize the departments of surveying and mapping geographic information, planning, construction, transportation, water conservancy, agriculture, environmental protection, civil affairs and civil defense to establish and improve the geographic information sharing mechanism, so as to realize the sharing of geographic information resources among government departments.

Article 35 The competent department of surveying and mapping geographic information shall organize the confidential technical treatment of the basic surveying and mapping results, release the formed non-confidential basic geographic information catalogue to the society in time, increase the supply of basic geographic information, and realize the opening and sharing of basic geographic information.

Thirty-sixth provinces, districts and cities in charge of Surveying and mapping geographic information should organize the construction of geographic information public service platform to provide online services such as browsing, inquiry and interface for the public and social organizations.

Thirty-seventh to carry out the audit of natural resources of leading cadres, we should use the special monitoring information of geographical conditions provided by the competent department of surveying and mapping geographic information.

The competent department of surveying and mapping geographic information shall, jointly with relevant departments, regularly organize and carry out special monitoring of ecological protection geographic conditions such as wading, atmosphere, vegetation, soil, minerals and land subsidence, and provide them in time as required.

Article 38 No unit or individual may transmit classified geographic information on the Internet or public information network without security measures.

The use of geographic information shall not endanger security and public interests. Providing satellite navigation and positioning technical services shall not disclose personal location information.

Chapter VI Infrastructure

Thirty-ninth surveying and mapping geographic information infrastructure includes the following signs, sites and platforms for surveying and mapping geographic information activities:

(1) Permanent surveying markers;

(2) Satellite navigation and positioning reference stations;

(three) special surveying and mapping instruments measurement and verification field;

(4) Basic framework of geospatial information;

(5) Geographic information public service platform;

(six) other surveying and mapping geographic information infrastructure as prescribed by laws and regulations.

Article 40 The competent department of surveying and mapping geographic information of the province shall prepare the development plan of surveying and mapping geographic information infrastructure of the whole province, which shall be audited by the competent department of development and reform of the province and implemented after being approved by the provincial people's government.

Forty-third local people's governments at or above the county level shall include the funds for the construction, maintenance and storage of surveying and mapping geographic information infrastructure in the fiscal budget at the corresponding level. The permanent surveying markers shall be kept under the allowance system.

The competent department of surveying and mapping geographic information shall establish and improve permanent surveying markers, satellite navigation and positioning reference stations, and archives of surveying and mapping special instruments metrological verification field, regularly check and maintain them, and be responsible for assigning units or special personnel to keep them; Township people's governments and sub-district offices shall do a good job in the protection of permanent surveying markers, satellite navigation and positioning reference stations and special surveying and mapping instruments.

Forty-fourth permanent surveying markers, satellite navigation and positioning reference stations, surveying and mapping special instruments measurement and verification field should be scientifically arranged and reasonably set up.

Need to set up permanent surveying markers, satellite navigation and positioning reference stations and special surveying and mapping instruments measurement and verification field, the setting unit shall go through the formalities for land use according to law; Occupation of buildings, the setting unit shall give appropriate compensation.

Forty-fifth departments in charge of surveying and mapping geographic information shall provide the relevant departments with the distribution information of permanent surveying markers, satellite navigation and positioning reference stations and surveying and mapping special instruments measurement and verification fields.

The relevant departments shall solicit the opinions of the competent department of surveying and mapping geographic information at the same level before examining and approving projects that may affect the use efficiency of land use and permanent surveying markers, satellite navigation and positioning reference stations and special surveying and mapping instruments.

The construction of electric power, radio and television, communication facilities and other electromagnetic wave emitting devices should avoid the built permanent surveying markers, satellite navigation and positioning reference stations and special surveying and mapping instruments measurement and verification fields, and avoid the electromagnetic wave emission interference at a safe control distance of not less than 200 meters.

Forty-sixth within the administrative region of this province, the permanent surveying markers and A, B and C-level satellite navigation and positioning points set by the first and second class basic surveying and mapping at the provincial level shall be organized and maintained by the competent department of surveying and mapping geographic information of the province; Third-class, fourth-class and permanent surveying markers set by basic surveying and mapping at the city and county levels, as well as D-class and E-class satellite navigation and positioning points, shall be organized and maintained by the competent department of surveying and mapping geographic information at the city and county level with districts.

Chapter VII Qualification and Market

Forty-seventh units engaged in surveying and mapping activities shall obtain surveying and mapping qualifications according to law. Surveying and mapping qualification examination, surveying and mapping qualification certificate issued by the conditions and procedures in accordance with the relevant provisions of the province.

Forty-eighth professional and technical personnel who have not obtained the qualification of surveying and mapping shall not engage in activities related to the qualification of surveying and mapping.

Surveying and mapping personnel shall hold a surveying and mapping operation certificate when conducting field surveying and mapping activities.

The competent department of surveying and mapping geographic information of the province and the competent department of surveying and mapping geographic information of the city divided into districts shall be responsible for the issuance and registration of surveying and mapping operation certificates in accordance with the division of responsibilities.

Forty-ninth bidding and government procurement of surveying and mapping geographic information projects shall be implemented in accordance with the provisions of relevant laws and regulations. Surveying and mapping geographic information projects involving security, confidentiality, etc. Where it is not suitable for public bidding, public bidding shall not be allowed.

Surveying and mapping geographic information units shall not subcontract the contracted surveying and mapping geographic information projects; If it is planned to subcontract part of the non-main and non-critical work of surveying and mapping geographic information projects, it shall be specified in the tender documents, and the contract shall be performed by subcontracting according to law with the consent of the contractor. Subcontractors shall have corresponding surveying and mapping qualifications, and shall not subcontract surveying and mapping geographic information projects again.

The bidding and government procurement of surveying and mapping geographic information projects should implement supervision system.

Fiftieth bidding and government procurement of surveying and mapping geographic information project contractor shall, within fifteen working days from the date of signing the contract, submit a copy of the contract text to the competent department of surveying and mapping geographic information where the surveying and mapping geographic information project is located for the record; If the surveying and mapping geographic information project is subcontracted, a copy of the subcontracted text shall be attached.

Chapter VIII Supervision and Administration

The competent department of surveying and mapping geographic information shall supervise and inspect the surveying and mapping qualification and market credit, surveying and mapping bid evaluation expert qualification, bid evaluation method and bid-winning price of the tendering units.

Fifty-third competent departments of Surveying and mapping geographic information shall organize the quality supervision and inspection of surveying and mapping results, conduct spot checks on the quality of surveying and mapping geographic information projects in proportion every year, and announce the results of supervision and inspection to the public.

Surveying and mapping geographic information projects that are not contracted by bidding at a lower cost shall be supervised and inspected by the competent department of Surveying and mapping geographic information.

Article 54 The competent department of surveying and mapping geographic information shall strengthen the credit management of surveying and mapping geographic information market, establish a market credit reward and punishment mechanism, release credit information to the society and provide inquiry services.

Fifty-fifth competent departments of Surveying and mapping geographic information shall strengthen the supervision and management of overseas organizations or individuals engaged in surveying and mapping geographic information activities within the administrative region of this province.

Providing surveying and mapping geographic information services to overseas organizations or individuals and foreign-invested enterprises shall abide by the provisions of relevant laws and regulations and shall not involve secrets or endanger safety.

Article 56 The competent department of surveying and mapping geographic information and the departments and units of security, confidentiality, industry and commerce, press and publication, radio and television, internet information and customs shall establish a joint law enforcement mechanism, regularly supervise and inspect the surveying and mapping geographic information market and confidentiality every year, and investigate and deal with illegal acts according to law.

Chapter IX Legal Liability

Article 57 Any staff member of the competent department of surveying and mapping geographic information who neglects his duty, abuses his power or engages in malpractices for selfish ends in the management of surveying and mapping geographic information shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Fifty-eighth in violation of the provisions of the first paragraph of Article 10 of these regulations, those who engage in surveying and mapping geographic information activities without using the prescribed surveying and mapping systems and surveying and mapping benchmarks shall be ordered by the competent department of surveying and mapping geographic information to make corrections; Refuses to correct, at more than ten thousand yuan to one hundred thousand yuan fine.

Article 59 In violation of the provisions of the first paragraph of Article 21 of these regulations, if a unit that uses surveying and mapping results without compensation uses the surveying and mapping results for profit-making activities, the competent department of surveying and mapping geographic information shall order it to make corrections, confiscate its illegal income, and may impose a fine of not less than 10,000 yuan but not more than 100,000 yuan.

Article 61 If a contractor illegally subcontracts a surveying and mapping geographic information project in violation of the provisions of the second paragraph of Article 49 of these regulations, the competent department of surveying and mapping geographic information shall order it to make corrections, confiscate its illegal income, and may concurrently impose a fine of not less than five thousandths but not more than ten thousandths of the amount of the subcontracted project; The relevant departments may suspend the allocation of financial funds for surveying and mapping geographic information projects that use financial funds.

Sixty-second in violation of the provisions of article fiftieth of this Ordinance, the unit that contracted the surveying and mapping geographic information project failed to file in accordance with the provisions, and the competent department of surveying and mapping geographic information shall order it to make corrections.

Sixty-third acts in violation of the provisions of this Ordinance, laws and administrative regulations have been punished, in accordance with its provisions.

Chapter X Supplementary Provisions

Article 64 These Regulations shall come into force on May 0, 2065438. The Regulations on Surveying and Mapping in Jiangsu Province adopted at the 17th meeting of the Standing Committee of the Tenth People's Congress of Jiangsu Province on July 29th, 2005 shall be abolished at the same time.
