2. Article 35 of the Tourism Law stipulates that travel agencies shall not organize tourism activities at unreasonably low prices to trick tourists, and obtain illegitimate interests such as kickbacks by arranging shopping or paying for other tourism projects. When organizing and receiving tourists, travel agencies shall not designate specific shopping places or arrange other paid tourism projects. However, unless it is agreed by both parties through consultation or requested by tourists and does not affect the itinerary of other tourists. In violation of the provisions of the preceding two paragraphs, tourists have the right to request the travel agency to handle the return and advance the return fee within 30 days after the end of the travel itinerary, or refund the paid travel expenses.
Article 9 of the Tourism Law stipulates that tourists have the right to choose the tourism products and services they want, excluding the compulsory trading behavior of tour operators. At the same time, tour operators have the right to know when purchasing goods and services, and have the right to know the real situation of goods and services.
Article 35 of the Tourism Law stipulates that tour operators and travel agencies shall not engage in such acts as "cheating", "forcing consumption" and "arranging shopping", otherwise tourists have the right to request the travel agency to handle the return of goods for them within 30 days after the end of the tour, and pay the return fee in advance, or refund the fees paid for the tour items.
The contents of these two provisions of the Tourism Law are mainly to restrict compulsory transactions and deception. Among them, Article 9 mainly stipulates compulsory trading and providing agreed products and services, while Article 35 mainly stipulates cheating, which is a restriction on tour guides and tour operators.
However, there was a turning point after Article 35, that is, "except with the consent of both parties or at the request of tourists, and without affecting the itinerary of other tourists." That is to say, acts such as "forced trading", "cheating" and "designated place" in the above provisions become "free acts of tourists" and "voluntary acts of tourists" as long as they are agreed with tour guides or tour operators, and there is no violation of the relevant provisions of the above provisions.
(4) Risk prevention
Since Article 35 stipulates that under voluntary circumstances, tour guides can still take consumers to spend money, and may even take kickbacks, then tourists should take corresponding preventive measures.
As mentioned in the last article, these travel agencies can circumvent the above-mentioned legal provisions through some clauses in the travel contract, so tourists, as consumers, must pay attention to the relevant contract clauses when signing the relevant travel contract, and cannot sign it with the verbal promise of the other party unless you have a recording.
So what should we pay attention to in the travel contract?
The first is to see if there is an agreement in the contract that "based on the principle of equality and voluntariness, the tour guide can recommend tourists to shop in a certain range of places during the tour, and tourists have the right to choose independently". If yes, it is proof that you are spending voluntarily, and the travel agency and tour guide have not forced or deceived you. If you want to sign for it, it is not illegal after all, but you should be careful in the shopping process.
Secondly, in the shopping process, if there is relevant product information in the travel contract, but there is no quality and functional standard, remember to ask, record or buy relevant products carefully. Don't believe the goods that the tour guide says are inexpensive or have excellent functions. After all, the sale of goods is relative. You must ask the seller directly, and the seller's answer is the key. Don't be fooled by the tour guide. In one case, the tour guide said that this Chinese medicine cost 80 yuan a catty, but it was broken by the seller and ground into powder. In the seller's mouth is a gram of 80 yuan, saying that local Chinese medicines are sold by the gram. .........
Finally, as a tourist, it is really difficult to prove the rebate, so don't spend too much energy on it, protect yourself!
