Party members who misappropriate public funds or travel with public funds are in violation of party organization disciplines.

1. Article 94 of the "Regulations on Disciplinary Punishments of the Communist Party of China":

Party and state functionaries or persons entrusted with the management and operation of state-owned property shall use For the convenience of one's position, misappropriating public funds for personal use, conducting illegal activities, or conducting profit-making activities, or failing to repay them for more than three months, if the circumstances are relatively minor, a warning or a serious warning will be given;

If the circumstances are more serious, If the case is serious, he or she will be dismissed from party positions or placed on probation;

If the circumstances are serious, he or she will be expelled from the party.

Whoever misappropriates party dues, social security funds, disaster relief, emergency rescue, flood prevention, special care, poverty alleviation, immigration, relief, and epidemic prevention funds and materials shall be severely or aggravated in accordance with the provisions of the preceding paragraph, up to and including expulsion from the Party.

If the misappropriation of public funds is for personal use for less than three months, but the amount is relatively large, it shall be handled in accordance with the provisions of this article.

2. Article 384 of the "Criminal Law":

State functionaries take advantage of their positions to misappropriate public funds for personal use, carry out illegal activities, or misappropriate public funds Anyone who engages in profit-making activities in a relatively large amount, or who misappropriates public funds in a relatively large amount and fails to repay it for more than three months shall be guilty of misappropriation of public funds and shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention;

Whoever misappropriates a huge amount of public funds and fails to return it shall be sentenced to fixed-term imprisonment of not less than ten years or life imprisonment.

Whoever misappropriates funds and materials used for disaster relief, emergency rescue, flood prevention, special care, poverty alleviation, immigration, and relief for personal use shall be severely punished.

3. The "Interpretation of the Standing Committee of the National People's Congress on Paragraph 1 of Article 384 of the Criminal Law" stipulates that any of the following circumstances shall constitute misappropriation of public funds "for personal use":

1. Use public funds for yourself, relatives, friends or other natural persons.

2. Using public funds in the name of an individual for use by other units.

3. An individual decides to use public funds in the name of the unit for other units to use for personal gain.

IV. "Regulations of the Supreme People's Procuratorate on the Filing Standards for Direct Acceptance of Investigation Cases by the People's Procuratorate (Trial)": Misappropriation of Public Funds Cases (Article 384, Article 185, Paragraph 2, Article 272, Paragraph 2 (Money)... If suspected of one of the following circumstances, a case should be filed:

1. Misappropriation of public funds for personal use, with an amount ranging from 5,000 yuan to 10,000 yuan, to carry out illegal activities.

2. The amount of misappropriated public funds is between 10,000 yuan and 30,000 yuan, and is used for profit-making activities by individuals.

3. Misappropriation of public funds for personal use, the amount is between 10,000 yuan and 30,000 yuan, and the amount has not been repaid for more than 3 months.
