In order to promote the in-depth study and practice of Scientific Outlook on Development activities and strengthen and improve the supervision of the National People's Congress, we conducted a survey based on the study and practice activities of the county party committee.

The arrangement of the overall work plan, together with some members of the Standing Committee of the County People's Congress and responsible comrades of the relevant departments directly under the county, conducted a special investigation on the supervision of the county and township people's congresses for nearly one month from April 9 to May 6, 2009.

The research team investigated the main practices, procedures, system construction and functions of the supervision work of the people's congresses at the county and township levels through self-examination of the supervision work of the standing committees of the people's congresses at the county level, interviews with deputies to the people's congresses, listening to the opinions of cadres and the masses, and observing the construction and work of grassroots people's congresses. In recent years, the central government and the provinces, prefectures and county committees have attached great importance to the work of the National People's Congress, further strengthened their leadership over the people's congresses at all levels and their standing committees, actively supported the people's congresses and their standing committees in exercising their functions and powers according to law, and successively made decisions to further strengthen and improve the work of the National People's Congress. Especially since the promulgation and implementation of the supervision law, higher requirements have been put forward for the supervision work of the NPC. The Standing Committee of the County People's Congress and the Township People's Congress implemented the supervision law and relevant decisions, based on the overall situation of development, earnestly performed the duties entrusted by the Constitution and laws, and gave full play to the supervision function, which promoted the county's economic and social development and achieved initial results. First, the awareness of supervision has been significantly enhanced. Through the implementation of the supervision law and strengthening supervision, the consciousness, initiative and enthusiasm of the members of the Standing Committee of the National People's Congress at all levels and the deputies to the National People's Congress have been gradually improved, and the awareness of centering on the center, serving the overall situation and strengthening supervision has been continuously enhanced. Second, the goal of supervision is more clear. Scientific Outlook on Development has been thoroughly implemented, and promoting development is the same goal of all work, further clarifying the important position and role of NPC supervision in promoting local economic and social development. Third, the content of supervision is more specific. Taking the effectiveness of supervision as the main criterion of inspection work makes the supervision items more prominent, more thematic, phased and timely. Fourth, the quality of supervision has improved. Through continuous exploration and summary in practice, we should highlight the key points of supervision, improve the way of supervision, and pay attention to the actual effect of supervision, so that supervision pays attention to both procedure and substance, both the determination of results and the perfection of process.

Since the transition, under the leadership of the CPC Central Committee, the Standing Committee of the County People's Congress has effectively exercised its supervisory power according to law, which has ensured the implementation of the Constitution and laws in our county and promoted economic and social development.

Focusing on the overall situation of economic and social development, solving the hot and difficult problems strongly reflected by the masses is the fundamental theme of the inspection work.

Third, the regulatory model pursues a "live" word. He is good at unifying the relationship between collective exercise of authority and individual performance of duties. When supervising some major issues, key suggestions and major letters and visits, representatives meet with the staff of state organs to investigate and understand, and matters that need further supervision are supervised and implemented by the meeting of the Standing Committee or the meeting of directors, so that the supervision means are more effective and the problems can be solved more effectively.

2. Improve the supervision mechanism. First, establish and improve the supervision and evaluation mechanism. The fourth is to establish and improve the working mechanism of supervision and disclosure. Formulate rules for the Standing Committee to attend meetings, standardize the invitation of citizens to attend meetings of the Standing Committee of the National People's Congress, further broaden channels for citizens' orderly political participation, and enhance the openness and transparency of NPC supervision. The fifth is to establish and improve the working mechanism of organization and management. The Code for Members of the Standing Committee and the Measures for Members of the Standing Committee to Contact Deputies of the People's Congress at the corresponding level were formulated, which provided institutional guarantee for standardizing the organizational system of the Standing Committee and for members of the Standing Committee to contact representatives.

3. Strengthen quality supervision. The first is to strengthen learning and training. The third is to strengthen team management. Fully understand the importance of doing a good job in organ work, promote the construction of organ performance appraisal mechanism, pay attention to the function of organ work and the role of staff assistant, and actively provide services for the Standing Committee to exercise its supervision power according to law.

Supervision-pay attention to the role of representatives.

Give full play to the role of deputies to the National People's Congress as the key to improve the ability of supervision, and make the supervision process more reflect democracy, public opinion and civil rights.

2. Invite representatives to attend meetings and activities. Inviting delegates to attend meetings of the Standing Committee has become a regular work system. According to the agenda of each meeting, combined with the professional characteristics and personal wishes of the representatives, * * * invited more than 60 representatives from related fields and familiar situations to attend the meeting of the Standing Committee; Carry out law enforcement inspection, special investigation and other activities, invite NPC deputies on the spot, and invite more than 120 people to participate in the activities. During the activity, the delegates put forward many good opinions and suggestions, which played an important role in improving the quality of deliberation and the effectiveness of supervision.

3. Organize representatives to conduct key inspections and investigations. It has organized five provincial, state and county people's congresses of different scales to conduct centralized inspections and investigations, and participated in more than 270 delegates, and went deep into the county 19 townships and some schools, enterprises and communities, focusing on major project construction, new rural construction, agricultural industrial structure adjustment, tourism development, small town construction, poverty alleviation and development, new rural cooperative medical care, forest right system reform and other contents in our county. The opinions put forward by each inspection representative.

On the whole, the supervision of NPC has been further strengthened, and the awareness, means and effectiveness of supervision have been improved to varying degrees. However, in the process of investigation, we also clearly realize that supervision is still a weak link from the essential requirements of the people's congress system, and there is still a gap between the requirements of the development of the situation and the expectations of the people. There are still some difficulties and problems that cannot be ignored, which affect the NPC's supervisory function.

(A) From the perspective of regulatory philosophy, there is confusion in understanding. The understanding of the importance of NPC supervision needs to be further improved, mainly in the following aspects: on the one hand, as the main body of supervision, the consciousness of active supervision is not strong, and there are still "Party committees cannot supervise without nodding; The government is unhappy and inconvenient to supervise; When encountering big problems, I dare not supervise, and I am confused about how much role the NPC supervision can play and how appropriate the power is. I think more about support and cooperation than supervision and restriction; Influenced by traditional thinking and public opinion, there is still a negative mentality of "it is difficult to take a back seat when the boat arrives at the dock and the car arrives at the station". On the other hand, as a supervised person, he still lacks the concept of consciously accepting supervision and has a vague understanding of the legal status and power of NPC supervision. He believes that NPC supervision is routine, critical and negative, and has not attracted fundamental attention. The cognitive deviation of the two aspects has affected the exertion of the supervision function and made the supervision work in a passive situation.

(2) From the perspective of regulatory system, it is necessary to straighten out the relationship. Because China's political system reform lags behind the economic system reform, some operating systems of the party and state organs have not been completely straightened out, which has affected the supervision function of NPC to some extent. First, the relationship between NPC and Party Committee. The supervision object of the Standing Committee of the National People's Congress is the people's government at the corresponding level to look up the dictionary demonstration network (FANWEN.CHAZIDIAN.COM).

People's courts and people's procuratorates, in practice, because the functions of the party and the government are not really separated, a lot of work is decided by the party Committee and handled by the government, or the party Committee and the government make joint decisions. As the Standing Committee of the National People's Congress, which accepts the leadership of the Party Committee and supervises the government's work, it is easy to fall into a "dilemma", which makes it difficult for NPC to carry out its work in depth. Moreover, at present, there are 13 township people's congresses in our county who also serve as party secretary, and the party secretary is in the position of "number one", which is one of the main reasons that affect the supervision of grassroots people's congresses. Second, the relationship between the National People's Congress and "one government, two houses". The government shall accept the leadership of the Party committee and the people's government at a higher level and implement the decisions of the people's government at a higher level. The people's courts and people's procuratorates should also accept the leadership and supervision of the people's courts and people's procuratorates at higher levels, and judicial organs such as public procuratorates and courts should also accept the direct leadership of the Political and Legal Committee of the Party Committee, which involves supervision at many levels and brings certain difficulties to NPC's supervision. It is worth noting that in towns and villages, considering the heavy task of Party committee secretaries, full-time vice-chairmen of township people's congresses are equipped, but the actual situation is that there is a widespread phenomenon of full-time but not specialized. Almost all full-time vice-chairmen of township people's congresses have participated in government work, and put most of their energy into the central work of party committees and governments, with little time and energy to take care of the work of full-time people's congresses, which has also become a difficult problem for grassroots people's congresses to supervise. Third, the relationship between the National People's Congress and the vertical management department of the government. Some government functional departments closely related to people's production and life, such as industry and commerce, land, taxation, quality supervision, food and drug supervision and other functional departments, implement vertical leadership and management, and are basically divorced from local governments in administrative relations. However, the work of these departments is still an important part of government work, and how the NPC supervises government departments also needs institutional rationalization.

(C) From the perspective of supervision effect, the actual effect is not obvious enough. Restricted by many factors such as system and mechanism, low quality and poor supervision are still problems to be solved urgently. First, there is more procedural supervision and less substantive supervision. For example, the supervision of plans, budgets and major project planning mostly follows legal review procedures. Whether the indicators are scientific and reasonable is difficult to review in depth. The deliberation opinions made are relatively principled and general, and the pertinence and operability are not strong, which makes the supervision become a mere formality and lacks authority and seriousness. Second, there is more general supervision and less special supervision. For example, when listening to and deliberating the special work report of "one government, two houses", more attention is paid to the wide scope of supervision, which leads to insufficient supervision focus; When determining the topic for deliberation, more attention is paid to the supervision of the overall work, which makes the main points of the topic not obvious enough and objectively forms a "synthesis", which affects the supervision effect to some extent. Third, there are more flexible supervision and less rigid supervision. Pay more attention to the seriousness of the supervision form and the legitimacy of the procedure, and lack of in-depth understanding and relevant disposal measures for some major issues, sensitive issues and focus issues that have a bearing on the overall situation, so that supervision cannot reflect its due strength and effectiveness. Fourth, there are more suggestive supervision and less mandatory supervision. Appraisal report, law enforcement inspection, debriefing, inspection and investigation are widely used, and the existing and found problems are basically urged to be solved by means of opinions and suggestions, while the compulsory supervision methods such as inquiry, investigation of specific problems, dismissal and recall are rarely used. Only pay attention to help improve the process when the supervision result cannot be decided.

(D) From the perspective of supervision procedures, the system is still deficient. The promulgation and implementation of the supervision law has promoted the legalization and standardization of NPC supervision. However, in the face of the development of the situation and the actual needs of supervision, it needs to be continuously improved and perfected. Some regulations are too principled, the regulatory standards are not uniform, and the mandatory features are insufficient, so it is difficult to implement them. If you listen to and consider the work report of "one government, two houses", how to deal with the unapproved report is not specific enough by law; In addition, there are similar situations in legal supervision means such as inquiry, inquiry and investigation of specific issues. Some forms of supervision of the reform and innovation of the Standing Committee of the County People's Congress are not implemented in a standardized form because of immature conditions, and the relevant systems and procedures are not guaranteed, which also has a certain impact on exploring and establishing an effective supervision mechanism.

(E) From the perspective of supervision ability, the organization lacks guarantee. With the acceleration of the process of governing the country according to law and building a socialist country ruled by law, the task of supervision by the people's congresses is becoming increasingly heavy, and local people's congresses and their standing committees are obviously unable to cope with the huge government and its departments, courts and procuratorates. First, there is a lack of regulatory professionals. The composition of the Standing Committee is unreasonable, the proportion of full-time staff is low, and a considerable number of members are part-time, so it is difficult to concentrate on the work of the National People's Congress, which affects the effective development of supervision work; Second, the establishment of supervision institutions is unreasonable. The internal working body of the Standing Committee is the actual executor and concrete operator of the Standing Committee's supervision function, but there are still problems such as lack of staff and nominal name. At present, the internal working organization is "five committees and one office". In addition to the office, there is only one person (director or deputy director) in each working Committee, which can be said to be both a specific worker and a secretary in charge of the leadership, and sometimes as an office typist; Because the provincial and state people's congresses do not clearly stipulate the name, quantity and number of institutions established by county people's congresses, the names, quantity and number of institutions established by counties according to specific conditions are not uniform. Reflected in the township people's congress, there is no full-time secretary except the full-time vice chairman (1 14). Although the organization department of the county party Committee has determined part-time staff for many times, due to frequent personnel changes, there is no additional staffing. Now most towns and villages are temporary part-time secretaries identified by themselves. Third, the overall quality of the representative is not high. In the general election of the National People's Congress, due to the constraints of the representative class and structural proportion, the ability to participate in the management of state affairs was not fully considered, resulting in the low quality of a large number of deputies. Except for cadres, 5 1.7% of the deputies are grassroots people's congress deputies with farmers as the main body, and their ability to perform their duties is poor.

In view of the existing difficulties and problems, we should strengthen and improve the supervision work closely around the requirements of Scientific Outlook on Development, so that the whole process of supervision work can better reflect the requirements of Scientific Outlook on Development. First, highlight the theme of "development" and persist in serving the overall situation. Consciously support the Party Committee to take the overall situation and coordinate the leading core role of all parties, firmly establish the concept that development is the top priority, make the supervision of the NPC more in line with the requirements of Scientific Outlook on Development, and better serve the local economic and social development; The second is to highlight the core of "people's livelihood" and adhere to the people-oriented principle. Firmly establish the concept of supervision for the people, and through the effective supervision of the National People's Congress, promote the "one government, two houses" to realize, safeguard and develop the most concerned, direct and realistic interests of the people, so that the supervision of the National People's Congress can better reflect the connotation of Scientific Outlook on Development; The third is to highlight the idea of "innovation" and persist in improving the work. Firmly establish innovative ideas, give full play to the advantages of NPC supervision, constantly improve and perfect supervision methods, improve supervision ability and level, and make NPC supervision more in line with Scientific Outlook on Development. Through investigation, we deeply realize that the key to improve the supervision level of NPC is to solve the problem of "what to supervise, how to supervise and how to supervise", and we should pay attention to both the change of results and the improvement of process. We suggest that:

(1) Scientifically determine the regulatory priorities. The first is to strictly control the process of topic selection. Based on the principle of openness and transparency and the way of going from the masses to the masses, it is clear that the topic selection procedure is as follows: facing the society, widely selecting supervision topics from issues that are generally concerned and reflected by representatives, the masses and all walks of life; The directors' meeting initially determined the key points of supervision throughout the year; Relevant working committees put forward specific suggestions; do

The office draws up the annual supervision plan (draft); Solicit opinions from the society on the supervision plan (draft); The meeting of directors discusses and determines the annual supervision plan (draft); Report the annual supervision plan (draft) to the county party committee; The meeting of the Standing Committee of the National People's Congress deliberates and determines the annual supervision plan; Notify all representatives and announce the annual supervision plan to the society; Continue to collect the opinions of representatives and people from all walks of life, listen to reasonable opinions, and adjust and improve the annual supervision plan individually. So that the determination of the topic should not only integrate social conditions and public opinion, but also grasp the regulatory focus of the region. The second is to broaden the scope of topic selection. We should adopt the methods of "please come in" and "go out", take the reception of letters and visits and visiting representatives as the starting point, strengthen the work of NPC letters and visits, comprehensively analyze the trends of letters and visits, and organically unify the problems reflected by the masses with the supervision focus of NPC. Visit and contact NPC deputies regularly, mobilize the enthusiasm of delegates to participate in the management of state affairs, collect more supervision topics, further clarify the supervision objects of NPC Standing Committee, and provide more topic resources for making annual supervision plans.

(2) Innovating and improving supervision methods. The first is to streamline the agenda of the Standing Committee meeting. Starting from the principle of focusing on key points, focusing on special topics and increasing practical results, before each meeting, the working committees of the Standing Committee should conduct in-depth investigation and understanding of certain aspects of work, conduct secondary screening of meeting topics, put forward special deliberation plans, pay attention to selecting key tasks from the overall work, and select difficult tasks from the overall work to improve the pertinence of deliberation at the meeting of the Standing Committee. The second is to improve the inspection and investigation methods, and adopt the combination of clear observation and unannounced visits, planning and random sampling to deeply understand the real situation; Highlight the focus of research, and gradually change from comprehensive research to special research. According to the in-depth study and practice of Scientific Outlook on Development activities and the work points of the Standing Committee in 2009, around the overall strategic development, the special research topic of promoting the construction of new countryside was determined; Around the rural reform and development, the research topics of planting production, agricultural industrial structure adjustment, water conservancy infrastructure construction and animal husbandry development have been determined. Focusing on the development of social undertakings, we will determine the research topics to speed up the implementation of the "two basics" task of education, and recommend the research topics of county leaders such as vigorously promoting the transformation of resource advantages into economic advantages, and paying close attention to investment and development, environmental governance and optimization. The third is to standardize the mechanism for submitting major issues for trial. Every year, the Standing Committee notifies the "one government, two houses" in the form of documents, and the "one government, two houses" report on major issues that need to be submitted to the Standing Committee of the National People's Congress for deliberation in that year, stipulating that all government investment projects with a certain investment scale need to be examined and approved by the Standing Committee of the National People's Congress, so as to standardize the procedures for deliberation on major issues. The fourth is to explore the establishment of an open supervision mechanism, make full use of the Internet, television, newspapers and other media, publicize the supervision process of major issues to the public, solicit opinions and suggestions from all sides, and accept supervision from representatives and the masses. Strengthen the application of administrative supervision results such as auditing and supervision. For key issues related to people's livelihood, we can broaden the channels of supervision and build a more direct and effective supervision platform by holding symposiums and hearings.

(3) Optimize and broaden the channels of supervision. First, strengthen the information communication between the National People's Congress and the "one government, two houses", and establish and improve the work report system, the government information notification system, the normative document filing and review system and the representative proposal undertaking system. Second, the communication channels between NPC and its Standing Committee and the society should be unblocked, and the system of handling deputies' suggestions and letters and visits should be improved, so that the supervision of NPC can be based on a wide range of public opinions. Adhere to the system of citizens attending meetings of the Standing Committee, solicit public opinions and suggestions, and accept social supervision. The third is to make the agenda and results public and accept the supervision of deputies and the masses. Fourth, give full play to the direct supervision role of deputies, further carry out the evaluation of government departments' work and deputies' debriefing, adhere to the system that members of the Standing Committee contact representatives and representatives attend the Standing Committee as nonvoting delegates, and organize representatives to participate in law enforcement inspections, special investigations and special inspections. , so as to give full play to the role of representatives as the main body of supervision.

(4) Improve the supervision mechanism. First, comprehensively clean up and integrate the existing system of the Standing Committee, according to the provisions of the Supervision Law, cut off the provisions that do not meet the needs of supervision, supplement and modify the parts that do not meet the requirements of supervision, and refine and improve the matters that need to be further clarified, so as to make all work systems more standardized and operational. Second, the existing supervision methods have not formed a system. According to the standardization requirements of NPC system and referring to the practical experience of developed regions, the corresponding system should be gradually established and improved to ensure that every supervision procedure of the Standing Committee has rules to follow. The third is to strengthen the supervision and inspection of the implementation of laws and regulations and the provisions of the Standing Committee system by the "one government, two houses" and their working departments, especially the supervision of the implementation of substantive laws, so as to avoid similar incidents of hepatitis C, so that the supervision work always adheres to laws and procedures, and makes specific decisions on cases that do not implement regulations and perform their duties, ensuring the seriousness and authority of supervision work.

(5) Strengthen supervision and review of implementation. The first is to establish a meeting supervision and implementation mechanism. The second is to establish a tracking, coordination and supervision mechanism.
