Yunnan Tourism Regulations (revised on 20 14)

Chapter I General Provisions Article 1 In order to regulate the order of the tourism market, safeguard the legitimate rights and interests of tourists, tour operators and employees, protect and rationally develop tourism resources, and promote the development of tourism, these Regulations are formulated in accordance with the Tourism Law of the People's Republic of China and other relevant laws and regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the protection, development and construction, business activities, supervision and management and services of tourism resources within the administrative area of this province. Article 3 The development of tourism should highlight local characteristics, adhere to the principles of government guidance, market operation, social participation and industry self-discipline, and realize the unity of social, economic and ecological benefits. Article 4 The people's governments at or above the county level shall strengthen the organization and leadership of tourism development, incorporate tourism development into the national economic and social development plan, establish and improve the comprehensive coordination mechanism and incentive mechanism for tourism development, and increase investment and support for tourism. Article 5 The tourism administrative departments of the people's governments at or above the county level shall be responsible for the guidance, coordination, management, supervision and service of the tourism industry within their respective administrative areas.

The relevant administrative departments of development and reform, ethnic affairs commission, public security, land and resources, housing and urban construction, environmental protection, transportation, commerce, culture, industry and commerce shall, according to their respective functions and duties, do a good job in the development of tourism. Article 6 Tourism industry organizations shall improve the industry self-discipline system, play the role of service, guidance, coordination and supervision, safeguard the legitimate rights and interests of the industry and the order of fair competition, accept the guidance, supervision and management of the tourism administrative department, and carry out activities according to law. Chapter II Promotion and Development of Tourism Article 7 The people's governments at or above the county level and their relevant departments shall formulate and organize the implementation of industrial policies and measures conducive to the sustained and healthy development of tourism, improve the investment and business environment of tourism, and promote the integrated development of tourism and related industries. Eighth people's governments at or above the county level shall promote the standardization of tourism management. The tourism administrative department shall, jointly with the administrative department of quality and technical supervision, organize the implementation of the national standards, industry standards and local standards of the tourism industry. Local standards shall be formulated by the tourism administrative department of the people's government of the province or state (city) jointly with the administrative department of quality and technical supervision. Article 9 The provincial people's government and its relevant departments shall take measures to eliminate barriers to regional tourism services, promote cross-regional tourism cooperation and management, and prohibit industry monopoly and regional monopoly.

No unit or individual may restrict or hinder the legitimate tourism business activities of travel agencies, tour guides and tourist vehicles outside the administrative area. Tenth people's governments of provinces and border areas, prefectures (cities) and counties (cities, districts) shall, in accordance with the relevant provisions of the state, organize border tourism cooperation and exchanges with neighboring countries, and develop and construct cross-border tourism projects and routes.

The people's governments of states (cities) and counties (cities, districts) in border areas and their relevant departments shall take measures to provide a good environment and services for the development of border tourism.

The provincial people's government shall establish a working mechanism of border tourism with the participation of public security, customs, foreign affairs, inspection and quarantine, tourism and other departments, coordinate and solve relevant problems in the development of border tourism, and promote the development of border tourism. Eleventh people's governments at or above the county level shall set up special funds for tourism development for tourism planning, industrial cultivation, market supervision, commodity development, scientific research, standardization construction, information construction and personnel training. Article 12 The people's governments at or above the county level shall, according to the needs of tourism development, arrange special funds for tourism promotion in the financial budget for shaping and upgrading the overall image of tourism, planning and marketing important tourist routes, scenic spots, large-scale tourism activities and new tourism products.

The tourism administrative departments of the people's governments at or above the county level shall take measures to innovate tourism promotion and marketing methods, encourage diversified tourism marketing, and strengthen the development of domestic and foreign tourism markets.

Encourage the use of relevant special conferences and exhibitions, cultural performances, sports events, scientific and technological exchanges, ethnic festivals, ethnic folk culture and other activities to promote tourism promotion and marketing. Article 13 People's governments at or above the county level shall increase the supply of land for the construction of tourism projects, encourage the use of barren hills and wasteland for comprehensive tourism development and construction, and give priority to ensuring the land for major and key tourism projects in the province. Fourteenth people's governments at or above the county level shall guide financial institutions to innovate and develop credit products and models that meet the characteristics of tourism, and increase credit support for tourism.

Encourage and support tourism enterprises in the province to declare listing in accordance with the relevant provisions of the state, and issue bonds such as corporate bonds, corporate bonds, short-term financing bonds, medium-term bills, and small and medium-sized enterprise collective bills, and directly go to the capital market for financing; Encourage and support the establishment of tourism development investment funds and broaden the channels of tourism investment and financing; Encourage and support insurance institutions to innovate travel insurance products and services. Fifteenth people's governments at or above the county level and their relevant departments shall, in combination with the characteristics of tourism development within their respective administrative areas, adopt various forms to cultivate and introduce tourism professionals, strengthen the training of minority tourism managers, and improve the level of tourism management and service. Article 16 People's governments at or above the county level and their relevant departments shall, according to local conditions, choose ethnic villages, traditional villages and tourist villages with strong ethnic customs, high protection value and good ecological environment, strengthen the construction of tourist villages with ethnic characteristics, and actively promote the development of rural tourism.

County (city, district) people's governments should strengthen overall coordination, integrate resources, guide and absorb social funds to participate in the construction of tourist villages with ethnic characteristics. Provincial and state (city) people's governments shall give policy and financial support to the construction of tourist villages with ethnic characteristics.
