Shaanxi Tourism Regulations (revised on 20 19)

Chapter I General Provisions Article 1 In order to protect the legitimate rights and interests of tourists and tour operators, standardize the order of the tourism market, protect and rationally utilize tourism resources, and promote the sustained and healthy development of tourism, these Regulations are formulated in accordance with the Tourism Law of the People's Republic of China and other laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the tourism activities organized within the administrative area of this province in the form of sightseeing, vacation and leisure, as well as tourism planning, development, construction, operation, service and management. Article 3 To develop tourism, we should highlight the advantages and local characteristics of Shaanxi's historical, cultural, natural and ecological tourism resources, adhere to the principle of integrating social benefits, economic benefits and ecological benefits, and implement unified planning, rational development and coordinated development. Article 4 People's governments at or above the county level shall strengthen the organization and leadership of tourism development within their respective administrative areas, incorporate tourism development into the national economic and social development plan, incorporate tourism development funds into the annual fiscal budget, promote the combination of tourism development with new industrialization, informationization, urbanization and agricultural modernization, optimize the tourism development environment, and improve policies and measures to promote tourism development.

Township (town) people's governments and subdistrict offices shall assist the people's governments at or above the county level and their relevant departments to do a good job in the protection and utilization of tourism resources, tourism development, tourism safety supervision and tourism environmental order maintenance within their respective administrative areas. Article 5 The provincial people's government shall establish and improve the comprehensive coordination mechanism of tourism, coordinate and deploy the key tasks of tourism development in this province, and work that needs comprehensive coordination such as cross-regional and cross-industry tourism planning and construction and comprehensive supervision and law enforcement of tourism market.

The people's governments of cities and counties (cities, districts) with districts shall, according to the actual situation of local tourism work, establish and improve the comprehensive coordination mechanism of tourism, and make overall coordination of tourism development and supervision and management in their respective administrative areas. Article 6 The tourism administrative departments of the people's governments at or above the county level shall be responsible for the guidance, coordination, management, supervision and service of the tourism industry within their respective administrative areas.

Other relevant departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job in the development of tourism. Article 7 People's governments at all levels shall carry out publicity and education on civilized tourism, guide tourists, tour operators, employees and residents of tourist destinations to enhance their awareness of protecting the ecological environment, and advocate and encourage healthy, low-carbon, green and civilized tourism modes.

Tourism operators and their employees should publicize the knowledge of ecological environment protection to tourists in tourism business activities, and guide tourists to travel in a healthy and civilized way. Article 8 A tourism industry organization established according to law shall carry out activities in accordance with laws, regulations and the articles of association of the industry organization, improve the self-discipline management of the industry, strengthen the credit construction of its members, guide their honest services and safeguard their legitimate rights and interests. Chapter II Tourists Article 9 Tourists shall enjoy the following rights:

(a) to enjoy the right to know the contents, standards, prices, precautions and other information of relevant tourism products and services;

(two) have the right to choose tourism products, tourism operators, tourism services and tourism services;

(three) have the right to refuse the compulsory trading behavior of tour operators, and personal freedom is inviolable;

(four) have the right to require tour operators to provide tourism products and services in accordance with the contract, and to obtain relevant contract texts, invoices and other payment vouchers in the process of tourism;

(5) Have the right to request assistance and protection when personal and property are threatened;

(six) personal and property damage, have the right to compensation according to law;

(seven) personal dignity, national customs and religious beliefs should be respected;

(eight) the disabled, the elderly, minors, servicemen and other tourists enjoy convenience and preferential treatment in accordance with laws, regulations and relevant provisions in tourism activities;

(nine) other rights stipulated in the travel contract and laws and regulations. Article 10 Tourists shall perform the following obligations:

(1) Abide by social order and social morality, cherish tourism facilities, protect tourism resources and ecological environment, and conduct civilized tourism;

(two) respect for local customs, cultural traditions and religious beliefs, and abide by the tourism order and safety and health regulations;

(three) truthfully inform the tourism operators of personal health information related to tourism activities;

(four) shall not harm the legitimate rights and interests of local residents, interfere with the tourism activities of others, and harm the legitimate rights and interests of tourism operators and tourism professionals;

(five) to cooperate with the measures taken by the state to temporarily restrict tourism activities in response to major emergencies and the safety precautions and emergency measures taken by relevant departments, institutions or tourism operators;

(six) outbound tourists are not allowed to stay illegally abroad, and tourists who leave the group are not allowed to join or leave the group without authorization;

(seven) inbound tourists are not allowed to stay illegally, and tourists who enter with the group are not allowed to leave the group without authorization;

(eight) to fulfill the obligations stipulated in the tourism contract and other obligations stipulated by laws and regulations. Eleventh tourists and tour operators dispute, tourists can be resolved through the following channels:

(1) Negotiating with tour operators;

(2) Complaining to consumer associations, tourist complaint acceptance agencies or applying for mediation to relevant mediation organizations;

(3) If there is an arbitration clause or a written arbitration agreement in the travel contract, apply for arbitration;

(four) to bring a lawsuit to the people's court;

(five) other ways as prescribed by laws and regulations.
