Regulations of Yunnan Province on Tourism Management

Chapter I General Provisions Article 1 In order to protect and rationally develop and utilize tourism resources, safeguard the legitimate rights and interests of tourists and tour operators, strengthen tourism management and promote the healthy development of tourism, these Regulations are formulated in accordance with relevant laws and regulations and in light of the actual situation in Yunnan. Article 2 "Tourism" as mentioned in these Regulations refers to an industry that engages in tourism business and mainly provides services such as transportation, sightseeing, catering, accommodation, shopping and entertainment for tourists. Third organizations and individuals who participate in tourism activities and engage in tourism management within the administrative area of this province shall abide by these regulations. Article 4 People's governments at all levels should strengthen their leadership over tourism, incorporate tourism into the national economic and social development plan, adjust measures to local conditions, increase investment in tourism, strengthen the construction of tourism infrastructure, improve the tourism environment, and be responsible for organizing the implementation.

Encourage and support domestic and foreign organizations and individuals to invest and develop tourism resources and operate tourism in this province.

Encourage and support the development of tourism education, train tourism professionals, and improve the quality of tourism professionals and the quality of tourism services.

Support the development of tourism in ethnic minority areas, develop ethnic tourism projects and train ethnic minority tourism talents. The tourism administrative department of the fifth provincial people's government is responsible for the management of the province's tourism. The tourism administrative departments of prefectures, cities and counties shall be responsible for the tourism management within their respective administrative areas.

Tourism administrative departments at or above the county level shall exercise corresponding administrative law enforcement power in accordance with the relevant provisions of these regulations.

The relevant administrative departments shall, in accordance with their respective responsibilities, cooperate with the tourism administrative departments to manage the tourism industry. Sixth units and individuals that have made outstanding contributions to the development of tourism shall be commended and rewarded by the people's governments at or above the county level or the tourism administrative departments. Chapter II Protection of Tourism Resources and Construction of Tourism Facilities Article 7 The development and utilization of tourism resources must adhere to the principles of strict protection, unified planning, rational development and scientific management.

The development of tourism resources and the construction of tourism facilities must be coordinated with the ecological environment, and strict protection measures must be taken in accordance with the provisions of laws and regulations on environmental and resource protection. The topography of important tourist attractions (spots) shall not be changed without authorization, and the environment shall not be polluted and the ecological balance shall not be destroyed. Eighth development and utilization of tourism resources and construction of tourism facilities projects must implement the provisions of the environmental impact assessment system and environmental protection of construction projects. Ninth tourism administrative departments at or above the county level shall be responsible for organizing the investigation and evaluation of tourism resources within their respective jurisdictions, formulating plans for the development and utilization of tourism resources, and submitting them for approval according to relevant regulations.

The investigation and evaluation of scenic resources and the planning, construction and management of scenic spots shall be carried out in accordance with the Regulations on the Administration of Scenic Spots. Tenth the construction of star-rated tourist hotels (hotels), important tourist attractions (spots), tourist entertainment places, large cruise ships, tourist ropeways and other tourism projects shall be reported to the tourism administrative department for approval according to the tourism development plan. Article 11 An application for establishing a provincial or national tourist resort shall be submitted to the provincial people's government for examination and approval, or it shall be forwarded to the national tourism administration department for examination and approval after being examined and approved by the provincial tourism administration department. Chapter III Tourism Operators Article 12 To apply for engaging in tourism business activities, they shall obtain relevant licenses in accordance with regulations and meet the following conditions:

(1) Having its own name and organization;

(2) Having a clear scope of tourism business;

(3) Having a place, facilities and funds for tourism business;

(four) there are managers or technicians who have passed the examination by the tourism administration department;

(5) Other conditions stipulated by laws and regulations. Thirteenth tour operators must abide by the principles of honesty and credit, fair competition, business according to law and standardized services. Fourteenth tour operators should improve the internal management system and maintain the normal business order. Tourism operators shall not transfer or transfer in disguised form the qualification certificate of designated tourism operation or the business license of travel agency, and shall not operate without a license or beyond the scope. Article 15 When selling tourist commodities and providing services, tour operators shall truly indicate the quality and price of the commodities and the public service items, so that the quality and price are consistent, and shall not induce, pester or coerce tourists to buy tourist commodities or receive services.

Tourism operators are not allowed to set up stalls in tourist attractions and their entrances without authorization, which will hinder traffic and interfere with tourism order. Article 16 Tourism operators shall be equipped with tourism safety facilities and equipment, establish a responsibility system for safety management, strengthen safety precautions for tourists, and take timely protective measures to ensure the personal and property safety of tourists when danger is discovered or tourists' personal and property are damaged. Seventeenth tour operators shall, in accordance with the provisions of relevant laws and regulations, protect the environment and resources, maintain ecological balance and strictly prevent pollution. Eighteenth tour operators' operational autonomy is protected by law, and no unit or individual may infringe upon it.

Tourism operators have the right to refuse the relevant departments to forcibly promote their designated commodities or forcibly resettle personnel; Have the right to refuse to charge and apportion in violation of the relevant provisions of the state and the province. Nineteenth travel agencies and tourists should sign a written contract according to law, and strictly perform the contract.

Travel agencies should handle personal insurance for inbound and outbound tourists and personal and property accident insurance for domestic tourists who voluntarily take out insurance.
