First, the registration instructions

1. Visitors should sign up for tour groups in advance, sign a travel contract with the travel agency when signing up, and provide real personal identification information to the travel agency. They must hold their ID card or other valid documents during the trip.

2. An advance payment of not less than 30% of the total tour fee shall be paid at the time of registration, and the balance shall be paid 7 days before departure (excluding the day of departure); Those who fail to pay in full within the time limit will be automatically dismissed.

3. If a tourist requests to change the itinerary or departure date after registration, the travel agency shall charge the extra expenses and business losses arising therefrom. When tourists leave the tour group because the objective conditions are not allowed to change, they shall be handled in accordance with the method of 1 in Article 4 of the Guidelines.

4. Visitors with special medical history must truthfully explain when registering. In view of the health status of tourists or other reasons, travel agencies have the right to accept or not.

5, children's fees, agreed by tourists and travel agencies.

Second, the tour fee includes

1, the inter-city transportation fee, sightseeing fee and one piece of luggage per person listed in the itinerary (the weight and volume are subject to the relevant regulations of the transportation department);

2. Accommodation fees of hotels listed in the itinerary or hotels at the same level;

3. Meals listed in the itinerary (excluding drinks);

4. The first ticket fee for each tour item listed in the itinerary (excluding the "Garden in the Garden" ticket).

Third, the tour fee does not include

1, meals on the train or ship during the journey (unless otherwise agreed);

2. Aviation personal insurance premium;

3. Overweight (piece) luggage;

4. All private expenses such as drinks, laundry and communication in the hotel;

5. All expenses and tips required for activities outside the trip.

Iv. cancellation and cancellation of travel

When the group trip must be cancelled due to other circumstances, the travel agency shall truthfully explain the reasons to the tourists, and arrange another trip through consultation with the tourists as soon as possible, or refund the tour fee paid by the tourists in full, and compensate the tourists for liquidated damages according to the following standards:

Pay 2% of the paid tour fee more than 7 days before departure;

6-4 days before departure, compensate 5% of the paid tour fee;

3- 1 day before departure, compensate15% of the paid tour fare;

On the day of departure, compensate 30% of the paid tour fare.

3. The departure date is less than 7 days before the tourists register. Tourists who request to leave the group after registration shall pay liquidated damages according to the actual losses of the travel agency. The travel agency shall truthfully inform the tourists of the expected actual losses when they register.

If the travel agency fails to leave the tour group on the agreed date due to its own reasons, it shall pay liquidated damages to the tourists according to the standard of 65438+ 0% of the tour fee received.

4. If the tourists do not agree with the compensation standards determined by 1, 2 and 3, they can negotiate with the travel agency at the time of concluding this contract and agree on the liability standards for breach of contract separately.

1. Travel agencies should provide services that meet the needs of ensuring the personal and property safety of tourists, and should explain and warn tourists in advance about projects that may endanger the personal and property safety of tourists.

Tourists should take good care of their personal belongings. If it is damaged or lost without entrusting the travel agency to keep it, the travel agency shall not be liable for compensation.

3. When the number of participants in the tour group is less than 16, the travel agency can join the tour group with other travel agencies on the premise that the promised service content and standards remain unchanged, but with the consent of the tourists and the responsibility of the contracted travel agency.

Teams with more than 16 people (excluding children) will be accompanied by the travel agency responsible for leaving the group, and teams with less than 16 people will not be accompanied (unless otherwise agreed by both parties).

4. The travel agency can handle the change, delay, detention or early termination of the team trip due to force majeure. In case of cost increase or decrease, the tourists will be refunded according to the expenses that have not occurred, and the cost overrun will be handled by the tourists themselves.

5. If you can't travel according to the agreed itinerary for some reason, the travel agency can temporarily make appropriate adjustments to the itinerary after reaching an agreement with the tourists, and the increased expenses will be borne by the travel agency. If the service level is reduced or the activities are reduced due to adjustment, the travel agency shall compensate the tourists for their economic losses in accordance with the Trial Standards for Quality Margin Compensation of Travel Agencies. Tourists should obey the arrangement of the travel agency, otherwise the expanded losses will be borne by tourists. Do not refuse tourists to board the plane (car, boat) or take other measures to force travel agencies to accept their requirements on the grounds of service quality.

6. Visitors who leave the group on their own or do not participate in planned team activities will automatically abstain, and the paid fees will not be refunded. Because of the responsibility of tourists, they can't travel with a group, and the losses caused by them will be borne by them. When adding items (including attractions, shopping, entertainment, etc.). If the itinerary is out of the contract, the written consent of the tourists should be obtained in advance.

7. Tour guides should provide services that meet national and industry standards for tourists, and tourists have the responsibility to cooperate with tour guides and observe team discipline. If tourists deliberately disobey discipline, seriously interfere with the normal operation of the team, and do not listen to advice, the travel agency has the right to cancel their qualification to join the group and deduct the expenses and losses that have occurred.

8. When tourists are unable to continue traveling due to illness during the journey, travel agencies should actively assist in proper arrangements. After deducting the expenses and losses that have occurred, the rest will be refunded. Travel agencies do not bear their medical expenses.

9. If the personal and property rights and interests of tourists are damaged due to reasons not attributable to the travel agency, such as flight delay or cancellation, third-party infringement, etc., the travel agency shall not be liable, but shall actively assist in resolving disputes between tourists and responsible parties.

10. Travel agencies shall take out travel agency liability insurance in accordance with state regulations, and recommend relevant personal insurance for tourists. When tourists have personal or property accidents during their travels, they should be handled or handed over to the public security department for investigation according to the regulations of relevant departments (such as insurance companies, transportation departments or hotels). Travel agencies should try their best to provide necessary help. If it is not the responsibility of the travel agency, the travel agency will not be responsible for the accident.

Article 1 Definitions of Terms in this Contract

1. A package travel agency refers to a travel agency that has obtained the business license of an enterprise as a legal person according to law and obtained the qualification to organize China citizens to travel abroad in the form of a team with the approval of the National Tourism Administration. The list is uniformly published by the National Tourism Administration.

2. Tourists refer to China citizens or groups who sign outbound travel contracts with tour groups and participate in outbound travel activities.

3. Outbound travel service means that travel agencies organize tourists to travel to China people, countries outside China, Hong Kong, Macao and Taiwan and other tourist destinations, and apply for tourist visas/endorsements. Individuals or local travel agencies designated by the governments of overseas tourist destinations book tourist tickets, arrange catering, accommodation and sightseeing services for tourists.

4. Travel expenses refer to the expenses paid by tourists to tour groups for purchasing outbound travel services.

Travel expenses include: necessary visa/endorsement fees (except those handled by tourists themselves); Transportation expenses (including overseas airport tax); Accommodation fee; Meals (excluding drinks); The first admission fee for non-self-funded tourist attractions; Other project expenses arranged in the itinerary; Service fees for tour groups, land agencies and overseas tour guides.

Travel expenses do not include: travel documents and departure expenses; Travel insurance premiums insured by individuals; The self-funded project expenses agreed in the contract; The contract does not stipulate the expenses that the tour group needs to pay (including: expenses for non-contractual activities outside the trip and expenses incurred during free activities, etc.). ); Overseas tips; Personal expenses of tourists during their travel (including: non-free meals on transportation, overweight luggage, laundry, telephone calls, drinks and alcohol during their stay, medical expenses for personal injuries, expenses and rewards for finding personal lost items, compensation expenses caused by personal reasons, etc.). ).

5. Travel agency liability insurance refers to the behavior that the travel agency pays the insurance premium to the insurance company according to the agreement with the insurance contract, and the insurance company assumes the responsibility of the travel agency for the personal and property damage caused by the travel agency in the tourism business activities, and also assumes the liability for compensation for the insurance money.

6. Leaving the group refers to the behavior that tourists fail to complete the itinerary agreed with the group abroad due to objective reasons such as illness and loss of documents after participating in the outbound travel team organized by the group travel agency.

7. Leaving the tour group refers to the behavior that tourists leave the tour group abroad without authorization after participating in the outbound tour group organized by the tour group organization, and do not complete the itinerary agreed with the tour group.

8. Tour transfer refers to the behavior of a package tour agency to hand it over to the outbound tour teams organized by other travel agencies with the written consent of the tourists on the premise of ensuring that the promised service content and standards remain unchanged, because the number of package tours is lower than that of package tours.

9. Force majeure refers to unforeseeable, unavoidable and insurmountable objective circumstances, including those caused by natural and social reasons, such as natural disasters, wars, strikes, major infectious diseases and government actions.

10. An accident refers to an accident caused by accidental factors other than the intention or negligence of the parties. Such as traffic jams caused by major protocol activities, train flight delays, etc.

1 1. Business loss refers to the economic loss caused by tourists leaving the group before departure. Including: the cost of flying (car, boat) and other means of transportation (including reservation fee), tourist visa/endorsement fee, hotel accommodation fee (including reservation fee), per capita car rental in sightseeing bus and other actual expenses.

Second, the signing of the contract

Article 2 Description of travel itinerary plan

The package travel agency shall provide a package description of the travel plan (hereinafter referred to as the "plan"), which shall be regarded as an integral part of this contract after being signed or sealed by both parties. The plan should clearly state the following contents:

(1) tourist destination, route travel time (calculated by natural days, including flight time of planes, cars, ships, etc. , less than 24 hours is counted as one day);

(2) the vehicle and its grade (indicate the departure time of the vehicle and whether it is necessary to transfer);

(3) Accommodation arrangement and hotel name, location and grade (whether there are air conditioning, hot water and other related service facilities);

(4) the contents of tourist routes and sightseeing activities such as scenic spots/attractions (including the minimum stay time of major scenic spots);

(5) Dining frequency and standard (breakfast and dinner);

(six) shopping arrangements (the number of shopping trips arranged by the package tour agency shall not exceed half of the number of days of the trip, and the name of the shopping place, the longest stay time and the main commodities shall be listed);

(7) Entertainment activities (time, place, items) arranged by the itinerary;

(8) Self-funded projects (if there are any arrangements, the travel agency shall provide the tourists with a list of overseas self-funded projects when signing the contract, which will be voluntarily selected by the tourists and signed as an integral part of this contract; Self-funded projects should be based on the principle of not affecting the original planned itinerary, and the fees charged for self-funded projects should not be higher than the local retail price in the same period);

The wording of the plan must be accurate and clear, and there must be no uncertain terms such as "quasi-star", "luxury", "excellent tour guide (leader) service", "for reference only", "for reference" and "at the same level".

Article 3 Signing a contract

Tourists should carefully read the relevant clauses, plans and list of overseas self-funded projects in this contract. When the tourists have made clear the terms of this contract and the contents of relevant annexes, the package travel agency shall sign a written contract with the tourists.

Article 4 Tourism advertisements and promotional products

Tourism advertisements and promotional products of tour groups should follow the principle of good faith. If its contents conform to the provisions of the contract law, it shall be regarded as an integral part of this contract and binding on both tour groups and tourists.

Article 5 the validity of the contract

This contract is made in duplicate, one for each party, with the same legal effect, and shall come into effect as of the date of signature or seal by both parties.

Three. Rights and obligations of both parties to the contract

Article 6. Rights of tour groups

1, according to the tourists' physical health and related conditions, decide whether to accept tourists to sign up for travel.

2. Have the right to verify the relevant information provided by tourists.

According to the contract, the tourists are charged all the travel expenses.

4. In case of emergency, the tourism team can take emergency measures.

5. Have the right to refuse unreasonable demands made by tourists outside the contract.

Article 7 Obligations of tour groups

1, according to the contents and standards agreed in the contract and scheme, to provide tourists with tourism services with consistent quality and price. For items that may endanger the personal and property safety of tourists and problems that should be paid attention to, tourists should be given a true explanation and a clear warning in advance, and measures should be taken to prevent the occurrence of harm.

2. Hold a briefing before leaving the group, send detailed itinerary and itinerary precautions to tourists, and truthfully inform the specific itinerary and various service standards; Important laws and regulations, customs and habits of the country or region you are going to; Security measures; Payment methods and standards of overseas tips, as well as foreign exchange matters; Emergency contact information (including emergency contacts of China's embassies, consulates and tour groups abroad and contact information at home and abroad).

3. Arrange a tour leader who meets the qualification requirements of the Measures for the Administration of Outbound Tour Leaders for the tourism team.

4. Keep the documents submitted by tourists properly.

5. Insure travel agency liability insurance in accordance with the Provisions on Travel Agency Liability Insurance, and recommend personal travel insurance and other insurances to tourists.

6. During the trip, tourists shall not be forced to arrange shopping and participate in self-funded projects in violation of the contract.

When the goods purchased by tourists at planned shopping spots are fake and shoddy goods, the travel agency shall actively assist tourists in making claims. If a tourist cannot get compensation from the shopping point within 90 days from the date of shopping, the travel agency shall pay in advance.

7. Provide tourists with legal travel expense invoices.

8. Keep the personal information of tourists in the outbound travel registration form confidential.

9. Actively coordinate and handle tourists' complaints during the travel itinerary. In the event of a dispute, take appropriate measures to prevent the loss from expanding.

10. If the personal and property rights and interests of tourists are damaged due to third party infringement and other reasons not attributable to the travel agency, the travel agency shall perform the obligation of assistance to avoid the expansion of the personal and property rights and interests of tourists.

Article 8 the rights of tourists

1. Enjoy the rights granted to consumers by the Consumer Protection Law and relevant laws and regulations.

2. Have the right to ask the travel agency to issue an invoice when paying the travel expenses.

3. Have the right to require travel agencies to perform travel itinerary services according to the contents and standards of contracts and plans.

4. Have the right to refuse the package tour agency's tour transfer behavior without prior consultation and the shopping and self-funded project arrangement outside the contract.

Article 9 obligations of tourists

1. Fill in the Entry Application Form for Outbound Tourism and visa/endorsement materials truthfully, and be responsible for the contents filled in.

2. Passports or passes submitted to tour groups should be valid for more than half a year, and visa/endorsement holders should also ensure that visas/endorsements are valid during travel.

3. Pay the travel expenses according to the contract.

4. Abide by the contract and complete the travel itinerary, and cooperate with the unified management of the tour leader.

5. Abide by the laws, regulations and relevant provisions of China and tourist destination countries (regions), do not bring prohibited items into or out of the country, and do not stay abroad for no return.

6. Respect the customs and habits of the destination country (region), behave in a civilized manner, and do not set foot in pornographic places or participate in gambling.

7. Take care of your luggage, especially valuables.

8. Disputes arising during travel should be settled on the principle of equal consultation, and appropriate measures should be taken to prevent losses from expanding. Do not delay the trip or leave the group by refusing to board the plane (car, boat).

Fourth, the change of the contract

Article 10 Changes of Contract Contents

1. The tour contents agreed in this contract can be changed through consultation between the package travel agency and the tourists, but they must be signed by both parties in writing. The increased travel expenses and losses caused to the other party shall be borne by the party proposing the change, and the reduced travel expenses shall be returned to the tourists by the package travel agency.

2. If the contract cannot be performed or continues to be performed due to force majeure or unexpected events, the package tour agency may change the corresponding contents after obtaining the consent of most members of the tour team. When it is impossible to solicit opinions due to an emergency, the package tour agency may decide to change the content, but it shall provide necessary explanations and evidence for the decision made.

3. In case of force majeure or unexpected events before the trip, both parties can cancel or postpone the trip through consultation. If the itinerary is cancelled, the travel expenses will be fully refunded to the tourists by the package travel agency (but the visa/endorsement fees incurred should be deducted). Travel expenses, if any, shall be shared reasonably by both parties through consultation.

4. In case of force majeure during the tour, which makes the contract unable to be performed or continued to be performed, the package tour agency will return the unexposed travel expenses to the tourists after implementing the changes as agreed in the second paragraph of this article, and the increased travel expenses will be reasonably shared by both parties through consultation.

5. If the contract can't be performed or can't continue to be performed due to unexpected events in the itinerary, the package tour agency will return the unexpired travel expenses to the tourists after implementing the changes as agreed in Paragraph 2 of this article, so the increased travel expenses shall be borne by the party who proposes the changes (but the expenses incurred by the beneficiaries due to emergency avoidance shall be borne by the beneficiaries).

Article 11 One tour group will be transferred to another.

When the number of tour groups is less than the number of tour groups, the travel agency may transfer the tourists to the outbound tour groups organized by other tour groups on the premise of ensuring that the promised service content and standards remain unchanged, but the written consent of the tourists must be obtained in advance, and it shall be indicated in the terms of this contract. The transferred travel agency shall be liable for the violation of this contract before making compensation.

The rights and obligations of this contract shall be terminated if the tourists sign a separate contract with the transferred group agency.

Verb (abbreviation of verb) termination of contract

Article 12 Do not agree to transfer or postpone the termination of the contract.

If the number of tour groups is less than the number of tour groups, and the tourists neither agree to transfer the tour group nor postpone the transfer, it shall be deemed that the tour group has terminated the contract and shall be handled according to the relevant provisions in Article 13 and Article 15, Paragraph 1, of this contract.

Article 13 Termination of Contract before Travel

Tourists and tour groups can terminate the contract in writing before departure. If the termination of the contract is proposed more than 30 days before departure (calculated by the difference between the departure date and the natural date of arrival of the notice of termination, the same below), both parties shall not be liable for breach of contract. The package travel agency shall refund all the travel expenses to the tourists within 5 working days from the date of the notice of termination of the contract. The visa/endorsement fee shall not be deducted if the package travel agency proposes to terminate the contract; The visa/endorsement fee shall be deducted if the tourist proposes to terminate the contract and has already applied for the visa/endorsement.

If a tourist or tour group proposes to terminate the contract within 30 days before the departure of the tour (including the 30th day, the same below), the party who proposes to terminate the contract shall bear the liability for breach of contract.

Article 14 Termination of contract during travel

1. If a tourist fails to arrive at the agreed meeting and departure place or leaves midway to join the tour group, it shall be deemed that the tourist voluntarily terminates the contract, and it shall be handled according to the relevant provisions in Clause 1 of Article 16 of this contract.

2. If the tourists leave the group during the trip, the group agency can cancel the contract. Tourists are not allowed to ask the travel agency to refund the travel expenses. If it causes economic losses to the travel agency, it shall bear the corresponding liability for compensation.

Liability for breach of contract of intransitive verbs

Article 15 Liability for breach of contract of an organized travel agency

1. If the package tour agency cancels the package tour within 30 days (including the 30th day) before departure, it shall refund all the travel expenses (visa/endorsement fees shall not be deducted) to the tourists, and pay liquidated damages to the tourists according to the following standards:

30 days before departure to 15 days, pay a penalty of 2% of the total travel expenses;

Pay a penalty of 5% of the total travel expenses from 14 to 7 days before departure;

6-4 days before departure, pay 65438+ 00% of the total travel expenses as penalty;

3 days before departure to 1 day, pay 15% of the total travel expenses as penalty;

On the day of departure, pay a penalty of 20% of the total travel expenses.

If the above liquidated damages are not enough to compensate the actual losses of tourists, the package tour agency shall compensate the tourists according to the actual losses.

The package travel agency shall, within 5 working days from the date of canceling the arrival notice, refund all the travel expenses to the tourists and pay the above liquidated damages.

2. If the package travel agency fails to provide quality and price-guaranteed services as agreed in the contract, or adjusts the travel itinerary without the consent of the tourists (except in the circumstances specified in the second paragraph of Article 10 of this contract), which leads to the reduction of projects, the shortening of travel time or the lowering of standards, it shall take measures to remedy it. Those who fail to take remedial measures shall bear the corresponding liability for compensation.

3. If the tour leader or overseas tour guide arranges tourists to participate in self-funded projects other than those agreed in this contract without the signature of the tourists, he shall bear the expenses of the self-funded projects arranged without authorization; Increase the number of shopping without authorization, and pay the tourists a penalty of 10% of the total travel expenses each time.

If a package travel agency forces or forces tourists to shop in disguise, it shall pay the tourists a penalty of 20% of the total travel expenses.

4. If the package travel agency violates the contract to stop providing overseas accommodation, catering, transportation and other travel services to tourists, it shall bear the necessary expenses of accommodation, catering, transportation and other expenses of the same level set by tourists themselves during the suspension of travel services, and pay the tourists a penalty of 30% of the total travel expenses. If other personal or property damage is caused to tourists, the package tour agency shall also be liable for damages.

5. Packaged travel agencies transfer tourists to other travel agencies without authorization. If the tourist learns before departure, he has the right to terminate the contract and ask the package travel agency to refund the paid travel expenses in full, and pay a penalty of 10% of the total travel expenses; If the tourists only know about it on the day of departure or after departure, the package travel agency shall pay a penalty of 20% of the total travel expenses.

If the above liquidated damages are not enough to compensate the actual losses of tourists, the package tour agency shall compensate the tourists according to the actual losses.

6. When there is a dispute with tourists, travel agencies should actively take measures to prevent the loss from expanding. Otherwise, it should be responsible for the expanded losses.

Sixteenth tourists' liability for breach of contract

1. If a tourist proposes to terminate the contract within 30 days (including the 30th day) before departure, he shall pay the business loss fee to the package travel agency according to the following standards:

30 days before departure to 15 days, 5% of the total travel expenses;

14 to 7 days before departure, according to 15% of the total travel expenses;

Six to four days before departure, 70% of the total travel expenses will be paid;

3 days before departure to 1 day, 85% of the total travel expenses;

On the day of departure, 90% of the total travel expenses;

If the above compensation ratio is not enough to compensate the actual loss of the package travel agency, the tourist shall compensate the package travel agency according to the actual loss, but the maximum amount shall not exceed the total travel expenses.

After deducting the above-mentioned business losses, the package travel agency shall refund the remaining travel expenses to the tourists within 5 working days from the date of the arrival of the tourists' withdrawal notice.

2. Those who do not listen to the advice of the package tour agency and its team leader and affect the team tour, thus causing losses to the package tour agency, shall bear corresponding compensation liabilities.

3. The losses caused by tourists' personal activities beyond the content agreed in this contract shall be borne by them.

4. If the travel agency suffers damage due to the intention or negligence of the tourist, the tourist shall compensate for the loss.

When there is a dispute with the tour group, tourists should take active measures to prevent the loss from expanding. Otherwise, it should be responsible for the expanded losses.

Article 17 Other responsibilities

1.
