Deduction standard for withdrawing from the league
The Tourism Law stipulates that tourists have the right to terminate the contract at will.
(1) If the tourist proposes to terminate the contract more than 7 days before the start of the trip, the travel agency shall refund all the travel expenses to the tourist;
(2) If the tourist proposes to terminate the contract within 7 days before the start of the trip, the necessary expenses shall be deducted according to the following standards:
1) 6 to 4 days before the start of the trip, deduct 20% of the total travel expenses;
2) Deduct 40% of the total travel expenses from 3 days before the start of the trip to 1 day;
3) On the day of the trip, 60% of the total travel expenses will be deducted.
Provisions on refund of tour groups:
1. If the number of registered tour groups is insufficient, the travel agency has the right to cancel the tour group and refund the registration fee in full.
2. After the tour group is registered, if the number of applicants exceeds the maximum number stipulated by the travel agency, the travel agency has the right to cancel the tour group and refund the registration fee in full.
3. After the tour group is registered, if the travel agency cancels the tour group for its own reasons, the travel agency shall refund the registration fee in full.
4. After the tour group is registered, if the number of applicants is insufficient, the travel agency has the right to cancel the tour group, but the registration fee should be refunded according to the actual number of applicants.
5. After the tour group is registered, if the number of applicants exceeds the maximum number stipulated by the travel agency, the travel agency has the right to cancel the tour group, but the registration fee shall be refunded according to the actual number of applicants.
6. Article 63 of the Tourism Law of the People's Republic of China
If the travel agency attracts tourists to travel in groups and cannot leave the group because it does not reach the agreed number, the group agency may terminate the contract. However, tourists should be notified at least 7 days in advance for domestic tourism and at least 30 days in advance for outbound tourism.
If you can't leave the group because you don't reach the agreed number, with the written consent of the tourists, the group agency may entrust other travel agencies to perform the contract. The package travel agency is responsible for tourists, and the entrusted travel agency is responsible for the package travel agency. If the tourists don't agree, they can cancel the contract.
If the contract is terminated due to the failure to reach the agreed number of tour groups, the package tour agency shall refund all the fees charged to the tourists.
Article 67
If the travel itinerary is affected by force majeure or events that cannot be avoided after the travel agency or assistant has fulfilled the duty of reasonable care, it shall be handled according to the following circumstances:
(a) the contract can not continue to perform, travel agencies and tourists can terminate the contract. If the contract cannot be fully fulfilled, the travel agency can change the contract within a reasonable range after explaining it to the tourists. If tourists don't agree to the change, they can terminate the contract.
(2) If the contract is terminated, the package travel agency shall, after deducting the non-refundable fees paid to the land agency or the performance assistance personnel, return the balance to the tourists, and the increased fees shall be borne by the tourists, and the reduced fees shall be returned to the tourists.
(3) Where the personal and property safety of tourists is endangered, the travel agency shall take corresponding safety measures, and the expenses thus incurred shall be borne jointly by the travel agency and tourists.
(4) If the tourists stay, the travel agency shall take corresponding resettlement measures. Therefore, the increased room and board expenses are borne by tourists, and the increased round-trip expenses are shared by travel agencies and tourists.
Article 588 of the Civil Code of People's Republic of China (PRC)
If the parties agree on both liquidated damages and deposit, when one party breaches the contract, the other party may choose to apply the liquidated damages or deposit clause. If the deposit is not enough to make up for the losses caused by one party's breach of contract, the other party may demand compensation for the losses exceeding the deposit amount.
