What is the legislative process of China's tourism law?
In China, tourism legislation in the modern sense began in the late 1970s. In order to ensure the healthy development of modern tourism, China attaches great importance to the legal protection of tourism and has promulgated many civil and economic laws and regulations. However, there are some special rights and obligations in the field of tourism activities that are different from general economic or civil relations. It is not enough to adjust these special rights and obligations only through the general principles and provisions of universal laws. In this way, special laws and regulations to adjust tourism social relations have also been introduced. Therefore, at present, there are two kinds of laws and regulations to adjust tourism social relations in China. One is general laws and regulations, such as People's Republic of China (PRC) Contract Law, People's Republic of China (PRC) Environmental Protection Law, People's Republic of China (PRC) Sino-foreign Joint Venture Law, People's Republic of China (PRC) Company Law, People's Republic of China (PRC) Anti-unfair Competition Law and People's Republic of China (PRC) Sino-foreign Joint Venture Law. Although these laws are not specifically formulated for tourism social relations from the legislative intent, in fact, the legal principles and regulations they provide are also applicable to tourism. The other is the laws and regulations that specifically adjust tourism relations. Tourism is a new industrial sector in China, and the special legislation on tourism started late. On May 1985, 1 1, the State Council promulgated the Provisional Regulations on the Administration of Travel Agencies, which is the first regulation on tourism management in China. After the implementation of the Regulations, dozens of special laws and regulations have been promulgated one after another. These laws and regulations are constantly revised and improved in practice. At present, China's tourism laws and regulations mainly include: Regulations on Travel Agency Management, Regulations on Tour Guides Management, Provisional Regulations on Tourist Attractions Management, Interim Provisions on Quality Guarantee of Travel Agency, Measures for Public Security Management of Hotel Industry, Provisions on Star Rating of Foreign-related Hotels in People's Republic of China (PRC), Interim Provisions on Tourism Complaints, Regulations on Entertainment Places Management and Provisional Regulations on Tourism Safety Management. Some of these laws and regulations were approved by the State Council, and some were formulated by the National Tourism Administration alone or jointly with relevant departments. In addition, there are a large number of laws and regulations on local tourism formulated by local governments.
