Provisions of Liaoning Province on the Administration of Water Tourism Traffic

Chapter I General Provisions Article 1 In order to strengthen the management of water tourism transportation and maintain the order of water tourism transportation, these Provisions are formulated in accordance with the Regulations of People's Republic of China (PRC) on the Administration of Waterway Transportation and other relevant provisions, combined with the actual situation of our province. Article 2 The term "water tourism transportation" as mentioned in these Provisions refers to the commercial transportation of carrying tourists and providing tourist services in navigable waters such as coastal areas, rivers, lakes and reservoirs in our province (hereinafter referred to as navigable waters) with boats (excluding rowing boats and yachts in parks not connected with external waters) as carriers. Third all units and individuals engaged in water tourism and transportation business within the administrative area of our province must abide by these provisions. Fourth provinces, cities and counties (including county-level cities, the same below) traffic administrative departments are the competent departments of water tourism traffic within their respective administrative areas.

Other relevant administrative departments of the government shall, in accordance with their respective statutory duties, manage the units and individuals engaged in water tourism and transportation business. Chapter II Administration of Examination and Approval Article 5 Units and individuals applying for water tourism and transportation business must go through the examination and approval procedures in accordance with the following provisions:

(a) before buying or building a tourist boat (boat), it is necessary to apply to the traffic administrative department for preparation, and after examination and approval, it will be issued with a water transport license (preparation);

(2) Units and individuals that have obtained the water transport license (for preparation) shall purchase and build ships (boats) within the permitted scope, and after the preparation is completed, apply to the traffic administrative department for starting business, and issue the water transport license after examination and approval;

(3) Units and individuals that have obtained water transport licenses shall apply to the local administrative department for industry and commerce for registration, and after obtaining a business license, apply to the traffic administrative department for obtaining a ship business transport license.

If the operation of water tourism transportation business involves the examination and approval authority of other relevant departments, it shall also go through the relevant examination and approval procedures with the relevant departments. Article 6 Units and individuals applying for water tourism and transportation business shall submit the following documents:

(1) Application for preparation;

(2) Feasibility study report;

(3) Articles of association;

(four) proof of the source of funds;

(five) the identity certificate or power of attorney of the person in charge of the preparation;

(six) the safety responsibility certificate of the competent unit.

If it is a joint venture, there must be a contract or agreement signed by all parties to the joint venture. Article 7 Units and individuals planning to build water tourism and transportation shall submit the following documents when applying for business opening:

(1) An application for starting business;

(2) Certificate of seaworthiness issued by the statutory inspection department (copy);

(three) the ship (boat) ownership registration certificate and ship nationality certificate (copy);

(four) the capital verification certificate of its own working capital;

(five) the list of the main crew members and the valid certificate of competency (copy);

(six) safety technology management system;

(7) Insurance policies for accidental injuries of ships (ships) and passengers issued by insurance companies;

(eight) the proof that the port (station, point) that stops along the way agrees to stop. Article 8 The examination and approval authority of the traffic administrative department for water tourism and transportation business shall be divided according to the following provisions:

(a) the operation of water tourism and transportation business in this Municipality shall be examined and approved by the municipal traffic administrative department where the water area is located;

(two) the operation of inter-city water tourism and transportation business in the province shall be examined and approved by the provincial administrative department of transportation;

(three) the operation of domestic inter-provincial water tourism and transportation business and the operation of water tourism and transportation business by foreign-invested enterprises shall be audited by the provincial traffic administrative department and reported to the Ministry of Communications for approval. Ninth units and individuals engaged in water tourism and transportation business, need to increase the capacity, must apply to the administrative department of transportation for approval, after examination and approval, can buy or build a boat (boat). After the purchase and construction of a ship (boat) is completed, it shall submit the documents specified in Items (2), (3), (5), (7) and (8) of Article 7 of these Provisions to the original approval authority, and handle the ship business transportation certificate. Tenth units and individuals engaged in water tourism and transportation business, change the name, address, legal representative, shall go through the registration formalities with the administrative department for Industry and commerce, and report in writing to the original examination and approval of the traffic administrative department for the record.

Units and individuals engaged in water tourism and transportation business need to change their business scope and must go through the formalities for change. Eleventh units and individuals engaged in water tourism and transportation business request to suspend business, and must go through the cancellation procedures at the originally approved traffic administrative department and the industrial and commercial administrative department; The transfer must go through the formalities of examination, approval and registration of suspension of business as required. Twelfth approved units and individuals engaged in water tourism and transportation business, must accept the annual inspection in accordance with the provisions. Without the annual review or the annual review is unqualified, it shall not continue to operate the water tourism and transportation business. Chapter III Operation and Management Article 13 Units and individuals engaged in water tourism and transportation business shall keep tourist boats (boats) clean and tidy. Properly arrange tourists to get on and off the ship (boat) and maintain the order of tourist boats (boats). Fourteenth units and individuals engaged in water tourism and transportation business, must sail in the approved navigation area, and stop at the designated port (station, point).
