Measures for the Administration of Travel to Taiwan by Mainland Residents (Revised in 2017)

Article 1: In order to regulate the travel of mainland residents to Taiwan, these Measures are formulated in accordance with the "Tourism Law", "Travel Agency Regulations" and "Measures for the Administration of Chinese Citizens' Travel to and from the Taiwan Region". Article 2 Mainland residents traveling to Taiwan (hereinafter referred to as traveling to Taiwan) can take the form of group travel or individual travel.

Group travel for mainland residents to Taiwan should be organized by a travel agency designated to operate travel business for mainland residents to Taiwan (hereinafter referred to as the tour group agency), and the group travel should be carried out as a group. Tour group members should conduct group activities during their stay in Taiwan.

Mainland residents traveling to Taiwan for personal travel can travel to Taiwan on their own and can move around on their own while in Taiwan. Article 3 The tour group agency shall be designated by the National Tourism Administration in conjunction with relevant departments from the travel agencies that have obtained outbound tourism business licenses and submitted applications for operating tourism business to Taiwan, unless otherwise stipulated by the state. The list of tour operators is announced by the Cross-Strait Tourism Exchange Association.

Except for designated tour groups, no unit or individual is allowed to operate tourism business for mainland residents to Taiwan. Article 4 Travel agencies in Taiwan that accept mainland residents traveling to Taiwan (hereinafter referred to as local travel agencies) shall be announced by the Cross-Strait Tourism Exchange Association after being confirmed by the relevant mainland departments in conjunction with the National Tourism Administration. Article 5: Group travel to Taiwan by mainland residents is subject to quota management. The quota will be confirmed by the National Tourism Administration in conjunction with relevant departments and then issued to the organizing agency. Article 6: Before starting the business of organizing mainland residents to travel to Taiwan, a tour group agency shall sign a contract and establish a cooperative relationship with the local travel agency.

Before the travel group of mainland residents to Taiwan departs, the tour group organization shall provide the National Tourism Administration’s travel group management and service information platform with compliant information on the travel group to Taiwan. Tour group information is registered per group. Article 7 The organizing agency shall appoint a team leader for each team, and require the local receiving agency to send a tour guide to accompany the entire trip.

Tour leaders traveling to Taiwan should meet the conditions for leading a group stipulated in laws and regulations, be trained by provincial tourism authorities, and be designated by the National Tourism Administration. Article 8: While traveling to Taiwan, mainland residents are not allowed to engage in or participate in activities involving gambling, pornography, drugs, etc. or activities that are detrimental to cross-strait relations.

The tour group organization shall not organize members of the tour group to participate in the activities of the preceding paragraph, and shall require the local travel agency not to guide or organize members of the tour group to participate in the activities of the preceding paragraph. Article 9 The tour organizing agency shall require the local tour operator to arrange activities strictly in accordance with the team schedule stipulated in the contract; the schedule shall not be changed without the consent of both travel agencies and tour group members. Article 10 Mainland residents traveling to Taiwan must hold a valid Taiwan Travel Permit for Mainland Residents and apply for a group travel endorsement or individual travel endorsement according to the form of travel they adopt. Article 11 Mainland residents traveling to Taiwan should apply to the exit-entry administration department of the public security organ for a "Mainland Residents Travel Permit to and from Taiwan" and corresponding endorsements in accordance with relevant regulations. Article 12 Tour groups to Taiwan shall enter and leave the country as a group through the mainland's open ports based on the "List of Tour Groups for Mainland Residents to Taiwan". Article 13 If a tourist group has decided to enter the mainland in separate groups before leaving the country, the group organizing agency shall register with the relevant entry-exit border inspection station or the provincial public security and border defense department in advance.

If a tour group member is unable to enter the mainland with the group or cannot return to the mainland as scheduled due to emergencies, the tour group organization shall promptly report to the relevant entry-exit border inspection station or the provincial public security and border defense department. Article 14 Mainland residents who travel to Taiwan must return on time and are not allowed to stay illegally. When members of a tour group stay illegally, the organizer shall promptly report to the public security organs and tourism authorities, and assist in the repatriation and review of the stranded persons. Article 15 For those who are illegally staying in Taiwan with serious circumstances, the exit and entry administration department of the public security organ will not allow them to leave the country again within six months to three years from the date of their repatriation to the mainland. Article 16 Anyone who violates the provisions of these Measures and is not designated to operate tourism business for mainland residents to Taiwan, or travel agencies and employees who violate the provisions of these Measures, shall be punished by the tourism authorities in accordance with the "Tourism Law", "Travel Agency Regulations" and other provisions punishment. Relevant units and individuals that violate other laws and regulations will be dealt with by relevant departments in accordance with the law. Article 17: The National Tourism Administration, the Ministry of Public Security, and the Taiwan Affairs Office of the State Council are responsible for the interpretation of these Measures. Article 18 These Measures shall come into effect from the date of promulgation.
