Measures of Henan Province on Implementing the Law of People's Republic of China (PRC) on the Protection of Cultural Relics (revised on 20 16)
(1) Sites of ancient culture, ancient tombs, ancient buildings, cave temples, stone carvings and murals of historical, artistic and scientific value;
(2) Important historical sites, objects and representative buildings related to major historical events, revolutionary movements or famous figures in modern times, which have important commemorative significance, educational significance or historical value;
(3) Precious artworks and arts and crafts in different periods in history;
(four) important documents in different historical periods, manuscripts and books with historical, artistic and scientific value. ;
(five) representative objects reflecting the social systems, social production and social life of various times and ethnic groups in history.
Vertebrate paleontology and ancient human fossils with scientific value are protected by the state as well as cultural relics. Article 3 These Measures shall apply to the protection, utilization, management and related activities of cultural relics within the administrative area of this province. Article 4 The policy of giving priority to protection, giving priority to rescue, making rational use and strengthening management shall be followed in the work of cultural relics.
Activities such as capital construction, tourism development and utilization of cultural relics shall abide by the policy of cultural relics protection and shall not cause damage to cultural relics. Fifth people's governments at all levels are responsible for the protection of cultural relics within their respective administrative areas. The Cultural Relics Protection Management Committee of the people's governments at or above the county level shall be responsible for coordinating and solving major issues of cultural relics protection within their respective administrative areas.
The administrative departments for cultural relics at or above the county level shall supervise and manage the protection of cultural relics within their respective administrative areas.
Development and reform, urban and rural construction planning, public security, industry and commerce, customs, land and resources, culture, civil affairs, tourism, religion, environmental protection, forestry and other relevant administrative departments are responsible for the protection of cultural relics within their respective functions and duties. Article 6 The people's governments at or above the county level shall incorporate the protection of cultural relics into the national economic and social development plan, include the required funds in the fiscal budget, and arrange special funds according to the special needs of the rescue, repair, collection, purchase, exhibition and safety facilities construction of cultural relics. Seventh newspapers, radio, television, Internet and other news media should strengthen the publicity of cultural relics protection laws and regulations and excellent historical and cultural heritage, timely release public service advertisements for cultural relics protection, and enhance the awareness of cultural relics protection in the whole society.
All kinds of schools should take various forms to educate students on the protection of cultural relics. Article 8 Citizens, legal persons and other organizations have the obligation to protect cultural relics according to law, and have the right to report, accuse and stop illegal activities such as digging, stealing, smuggling, reselling and destroying cultural relics. Article 9 Citizens, legal persons and other organizations are encouraged to support the cause of cultural relics protection through donations.
Donated funds and materials shall be used exclusively for the protection of cultural relics, and no unit or individual may occupy or misappropriate them.
Encourage volunteers to participate in the protection of cultural relics. Tenth units and individuals that have made outstanding contributions to the protection of cultural relics shall be commended or rewarded by the people's governments at or above the county level or the administrative departments of cultural relics. Chapter II Immovable Cultural Relics Article 11 The provincial cultural relics administrative department shall, according to the historical, artistic and scientific value of immovable cultural relics, select and determine provincial cultural relics protection units, report them to the provincial people's government for approval and promulgation, and report them to the State Council for the record.
City and county-level cultural relics protection units shall be determined by the municipal and county-level cultural relics administrative departments under the provincial jurisdiction, reported to the people's government at the same level for approval and promulgation, and reported to the provincial people's government for the record.
For immovable cultural relics that have not been approved and announced as cultural relics protection units, the local cultural relics administrative department at the county level shall register and announce their names, categories, years, locations, scope and other matters, formulate protection measures, set up protection signs, and issue protection notices to all people or users to clarify their rights and obligations. Twelfth people's governments at or above the county level shall be responsible for organizing the preparation of protection plans for cultural relics protection units within their respective administrative areas. The protection plan of national key cultural relics protection units shall be approved and promulgated by the provincial people's government after being approved by the cultural relics administrative department of the State Council; The protection plan of provincial cultural relics protection units shall be approved by the provincial cultural relics administrative department and promulgated by the local provincial municipal people's government; The protection planning of cultural relics protection units at the city and county levels shall be approved and promulgated by the local people's governments at the provincial and county levels respectively, and shall be reported to the provincial cultural relics administrative department for the record. Article 13 The protection plans for historical and cultural cities, historical and cultural blocks, towns and villages that have been approved and published according to law shall be compiled by local people's governments at or above the county level and submitted to the provincial people's government for examination and approval.
The engineering construction in historical and cultural cities, historical and cultural blocks and villages and towns shall meet the requirements of protection planning and be in harmony with the historical features and natural environment of historical and cultural cities, historical and cultural blocks and villages and towns. Fourteenth national key cultural relics protection units and provincial cultural relics protection units shall, within one year from the date of approval and publication, be designated by the provincial people's government, make signs, and establish records and files; City and county cultural relics protection units shall, within one year from the date of approval and publication, delimit the necessary scope of protection, make signs and establish records and files.
The construction control zones of national key cultural relics protection units and provincial cultural relics protection units shall be delineated by the provincial cultural relics administrative department in conjunction with the provincial urban and rural construction planning department, and announced after approval by the provincial people's government. The construction control zone of cultural relics protection units at the city and county level shall be delineated by the provincial cultural relics administrative department jointly with the urban and rural construction planning department at the same level, and announced after being approved by the provincial people's government.
