Regulations on the Protection of Historical and Cultural Cities in Beijing
The district and county people's governments are responsible for the specific work related to the protection of Beijing's historical and cultural cities within their respective jurisdictions.
The municipal planning administrative department is responsible for the planning and management of Beijing's historical and cultural city protection.
The municipal administrative department of cultural relics shall be responsible for the protection of buildings with protection value in accordance with the duties stipulated in these regulations, and participate in the preparation of protection plans for historical and cultural cities in Beijing, the formulation of protection measures, and the identification of historical and cultural blocks.
The administrative departments of district and county development and reform, finance, construction, land and resources, water affairs, municipal administration, gardens, tourism, religious affairs, cultural relics, etc. shall be responsible for the protection of Beijing's famous historical and cultural city according to their respective duties. Article 5 This Municipality shall coordinate the national economic and social development with the protection of Beijing's famous historical and cultural city, and incorporate the protection of Beijing's famous historical and cultural city into the national economic and social development plan and annual plan. Article 6 The municipal, district and county people's governments shall arrange funds for the protection of Beijing's famous historical and cultural city in the financial budget at the corresponding level and incorporate them into the government investment management procedures. Article 7 This Municipality encourages units and individuals to participate in the protection of Beijing's famous historical and cultural city through donations, subsidies, technical services or suggestions.
This Municipality supports scientific research, technological innovation and professional personnel training related to the protection of Beijing's famous historical and cultural city. Article 8 All units and individuals have the obligation to protect Beijing's famous historical and cultural city, and have the right to make suggestions on the formulation and implementation of the protection plan, and to dissuade, report and accuse acts that destroy Beijing's famous historical and cultural city. Article 9 Units and individuals that have made outstanding contributions to the protection of Beijing's famous historical and cultural city shall be commended and rewarded by the municipal, district and county people's governments or relevant administrative departments. Chapter II Protection Contents Article 10 The protection contents of Beijing's famous historical and cultural city include: the overall protection of the old city, the protection of historical and cultural blocks, the protection of cultural relics protection units and the protection of buildings with protection value. Article 11 The old city refers to the area within the moat of Beijing and its ruins in the Ming and Qing Dynasties.
The protection contents of the old city include: historical rivers and lakes, traditional central axis, imperial city, convex shape of the old city, traditional street pattern, building height, urban landscape line, street view, architectural color, ancient and famous trees and so on.
The protection of the old city should adhere to the principle of overall protection and adopt different protection methods for different regions. Article 12 The protection of the imperial city should completely and truly maintain the historical features, planning layout and architectural style with the Forbidden City as the core, the palace, the yamen, the temple buildings and the imperial home forest as the main body, and the quadrangles as the background. Thirteenth blocks, buildings, villages and towns with traditional features or ethnic local characteristics in a specific historical period should be recognized as historical and cultural blocks.
The scope of historical and cultural blocks should include core protected areas and construction control areas. The delineation of the construction control zone shall conform to the requirements of the style protection and visual landscape of the core protection zone. Fourteenth quadrangles and other buildings that are not classified as immovable cultural relics, reflect certain characteristics of the times, have protective value, and bear true and relatively complete historical information should be recognized as buildings with protective value. The specific identification standards and procedures shall be formulated and promulgated by the Municipal People's government. Article 15 The list of historical and cultural blocks and the scope of their core protection areas and construction control areas shall be proposed by the municipal planning administrative department in conjunction with the municipal cultural relics administrative department and submitted to the Municipal People's Government for approval and promulgation.
The list of buildings, urban landscape lines and landscape buildings with protection value shall be put forward by the municipal cultural relics administrative department in conjunction with the municipal planning administrative department and submitted to the Municipal People's government for approval and promulgation.
The list of historical rivers and lakes shall be put forward by the municipal water administrative department in conjunction with the municipal cultural relics administrative department and submitted to the Municipal People's Government for approval and promulgation. Chapter III Protection Planning Article 16 The Municipal People's Government shall, in accordance with the requirements for the protection of historical and cultural cities in Beijing, organize the preparation of protection plans for historical and cultural cities in Beijing and incorporate them into the overall urban planning of Beijing.
The municipal planning administrative department shall, according to the protection plan of Beijing historical and cultural city and the protection list and scope published by the Municipal People's Government, organize the preparation of special protection plans for urban geographical environment, urban central axis, old city, imperial city, historical and cultural blocks and detailed planning for the construction of old city and historical and cultural blocks, and report them to the Municipal People's Government for approval and promulgation.
The compilation of protection planning, special protection planning and construction detailed planning of Beijing's historical and cultural city (hereinafter referred to as protection planning) shall solicit public opinions and organize experts to demonstrate.
Protection planning shall be compiled in accordance with unified standards and requirements.
The special planning and detailed planning of other cities in this Municipality shall conform to the protection planning.
