Regulations of Shenzhen Special Economic Zone on Tourism Management
Chapter I General Provisions Article 1 In order to protect the legitimate rights and interests of tourists and tour operators, strengthen the management of tourism and promote the development of tourism, these Regulations are formulated in accordance with the provisions of relevant state laws and regulations and in the light of the reality of Shenzhen Special Economic Zone (hereinafter referred to as the Special Zone). Article 2 The tourism authorities, tour operators and tourists in the Special Zone shall abide by these Regulations. Article 3 "Tourism" as mentioned in these Regulations refers to an industry that uses tourism resources and facilities to attract or receive tourists and provide them with comprehensive services such as transportation, sightseeing, accommodation, catering, shopping and entertainment. Article 4 The tourism administrative department of Shenzhen Municipal People's Government (hereinafter referred to as the municipal government) is the competent tourism department (hereinafter referred to as the municipal tourism administrative department), which shall supervise and manage the tourism industry according to law. The tourism administrative department of the District People's Government (hereinafter referred to as the district tourism administrative department) shall be responsible for the supervision and administration of tourism in this area under the guidance of the municipal tourism administrative department. Article 5 The municipal and district governments shall incorporate tourism into the national economic and social development plan, strengthen the construction of tourism infrastructure, improve the tourism environment, and encourage and support the development of tourism in terms of funds and policies. The municipal government may set up a tourism development fund. The management of the tourism development fund shall be handled in accordance with the relevant provisions of the municipal government. Article 6 The municipal and district governments shall take measures to promote the coordinated development of tourism and related industries. The municipal government shall establish a coordination system for tourism development, and regularly convene relevant government departments to coordinate and deal with major issues in tourism development. The relevant government departments shall perform their respective duties according to law, and support and cooperate with the tourism authorities to do a good job in tourism management. Article 7 The municipal and district governments shall encourage and support the development of tourism education, speed up the training of tourism professionals, and improve the quality and service quality of tourism professionals. Chapter II Development and Management of Tourism Resources Article 8 Governments at all levels shall take effective measures to protect and rationally develop and utilize tourism resources. No unit or individual may destroy tourism resources. The term "tourism resources" as mentioned in these Regulations refers to the natural landscape and human landscape that can be visited. Ninth city and district tourism authorities shall regularly investigate and evaluate the tourism resources within their respective administrative areas, and formulate the overall plan for the protection and utilization of tourism resources. Tenth the development of tourism resources should follow the principle of coordination between development and construction and environmental protection, and ensure the synchronous planning, implementation and development of tourism facilities and environmental construction. The construction of tourist attractions and tourist projects should be evaluated for environmental impact. Eleventh tourism construction projects must conform to the tourism development plan and the overall urban planning, and the architectural style should be coordinated with the surrounding environment. Article 12 Quarrying, mining, dredging, burying graves, hunting, destroying trees, discharging pollutants and dumping wastes without authorization are prohibited in tourist development zones, protected areas and tourist areas. Thirteenth new construction, renovation and expansion of tourism projects, should be approved by the tourism authorities, in accordance with the relevant provisions of the examination and approval. Fourteenth tourist attractions, the construction of scenic spots shall not destroy the natural landscape, cultural landscape and historical and cultural heritage. Chapter III Tourism Management Article 15 Tourism operators must engage in tourism business activities according to law, and their legitimate rights and interests are protected by law, and no unit or individual may infringe upon them. The term "tourism operators" as mentioned in these Regulations refers to legal persons or other economic organizations engaged in tourism business activities according to law. Sixteenth engaged in the following tourism business, should apply to the municipal tourism authorities: (a) travel agencies; (2) hotels (hotels); (3) Hotel (hotel) management company; (four) tourist attractions and leisure and fitness places (including resorts); (5) Tourism consultation; (six) other tourism business as prescribed by laws, regulations and administrative rules. The municipal tourism administrative department shall, within fifteen days from the date of receiving the application, make a written reply on whether to approve or not, and explain the reasons for not approving. Seventeenth approved by the municipal tourism authorities, tourism operators to obtain a business license or approval certificate, can go through the formalities of industrial and commercial registration. Eighteenth tourism operators in other parts of China to set up non-operating offices in the special zone, should be filed with the municipal tourism authorities. Unless otherwise stipulated by the state, such provisions shall prevail. Nineteenth overseas tourism organizations or tour operators to set up branches or offices in the special zone, or tour operators in the special zone to set up branches or offices abroad, must be approved by the municipal tourism authorities. Article 20 Tourism operators shall perform the following obligations: (1) Abide by laws, regulations and administrative rules, and shall not engage in activities inconsistent with their business scope; (two) accept the supervision and inspection of the tourism authorities on their service quality, tourism safety and service charges; (three) open service items, service standards and charging standards, and shall not deceive or mislead tourists by any means; (four) strictly fulfill the service standards agreed in the contract, and shall not change or cancel the service items or lower the service standards without authorization; (five) respect the right of tourists to choose their own goods and services, and shall not force tourists to buy goods or accept services; (6) It is not allowed to transfer business risks to tourists or impose business risks on tourists in the agreed form in the travel contract; (seven) the establishment of enterprise safety management responsibility system, equipped with necessary safety facilities, to ensure the personal and property safety of tourists; Timely inform tourists of possible dangers in the process of traveling; When danger occurs, effective protective measures should be taken; (eight) the establishment of enterprise job training system, strengthen the professional ethics and business skills training for employees; (nine) honest and trustworthy, fair competition, and shall not disturb the order of the tourism market in any form.
