Regulations of Lanzhou Municipality on the Protection and Management of Yellow River Scenery

Chapter I General Provisions Article 1 In order to protect the natural ecological and human environment of scenic spots along the Yellow River (hereinafter referred to as scenic spots) in this Municipality, standardize the protection and management of scenic spots, and promote the protection of ecological environment in the Yellow River Basin, these Regulations are formulated in accordance with relevant laws and regulations and in combination with the actual situation of scenic spots. Article 2 These Regulations shall apply to the planning, construction, protection, utilization and management of key scenic spots. Article 3 The term "grand scenic spot" as mentioned in these Regulations refers to the area where sightseeing, cultural entertainment, leisure and fitness, scientific and cultural education activities are carried out relying on the natural and cultural landscapes formed on the surface of the Lanzhou section of the Yellow River and on both sides.

The scope of the scenic spot is: from Sangyuan Gorge in Chengguan in the east, to Xiliugou in Xigu in the west, to the red line of Nanbinhe Road in the south and to the red line of Beibinhe Road in the north.

If there is any change in the scope of large-scale scenic spots, it shall be determined by the Municipal People's Government and announced to the public. Article 4 The protection and management of key scenic spots shall adhere to the principles of giving priority to protection, scientific planning, unified management, serving the public and sustainable utilization. Article 5 The Municipal People's Government shall strengthen the organization and leadership over the protection and management of key scenic spots, establish and improve the coordination mechanism for the protection and management of key scenic spots, and timely solve major problems in the planning, construction, protection, utilization and management of key scenic spots. The protection and management of large scenic spots will be included in the national economic and social development plan at the corresponding level, and the funds needed for the protection and management of large scenic spots will be included in the fiscal budget at the corresponding level.

The people's governments where scenic spots are located shall assist in the planning, construction, protection, utilization and management of scenic spots. Article 6. The management organization of large scenic spots established by the Municipal People's Government shall be responsible for the planning, construction, protection, utilization and unified management of large scenic spots, and shall perform the following duties according to law:

(a) the implementation of national and provincial and municipal laws, regulations and policies on scenic spots, landscaping, urban management, land planning, resource development and ecological protection;

(two) in accordance with the requirements of the overall planning of urban land and space, organize the preparation of large-scale scenic spots planning;

(three) to participate in the site selection and construction scheme of business projects in the scenic area;

(four) responsible for the protection and management of parks, landscaping, green space, woodland, wetlands and environmental sanitation in the scenic area;

(five) responsible for the construction, maintenance and management of cultural tourism, services, landscapes and other facilities in the scenic area;

(six) responsible for the overall development and management of natural ecological resources and cultural tourism resources in scenic spots, and supervise and manage the tourism market development, publicity and investment promotion activities in scenic spots;

(seven) to establish a public information service platform for natural resources and human resources in large scenic spots, publicize laws, regulations and specific measures related to the protection and management of large scenic spots, and release information on important activities in large scenic spots;

(eight) to investigate and deal with illegal construction, destruction of facilities, occupation of green space, affecting the city appearance and environmental sanitation and other illegal acts in large-scale scenic spots, accept the public's consulting services, opinions and suggestions on the protection and management of large-scale scenic spots, and report complaints;

(nine) other duties as prescribed by laws and regulations and entrusted by the Municipal People's government. Seventh municipal development and reform, ethnic and religious affairs, public security, finance, natural resources, ecological environment, housing and urban and rural construction, transportation, water affairs, agriculture and rural areas, culture and tourism, forestry, market supervision, urban management and other relevant administrative departments. Should be in accordance with the provisions of relevant laws and regulations, within the scope of their respective duties, responsible for the protection and management of large scenic spots. Article 8 All units and individuals have the obligation to protect the natural resources, ecological environment and public facilities in scenic spots, and have the right to dissuade, stop and report acts of destroying the natural resources, ecological environment and public facilities in scenic spots. Chapter II Planning and Construction Article 9 The planning of key scenic spots is the basis for the construction, protection, utilization and management of key scenic spots.

The planning content of large scenic spots includes the scope, nature, protection objectives, ecological resources protection measures, layout of major construction projects, development and utilization intensity, functional structure, spatial layout and tourist capacity. Tenth key scenic area planning by the key scenic area management agencies in conjunction with the natural resources, housing and urban and rural construction, culture and tourism, water, transportation, forestry and other administrative departments. , in the Yellow River Conservancy Commission and the public opinion and report to the Municipal People's government for approval before implementation.

Scenic area management agencies shall, according to the planning of scenic spots, formulate the implementation plan of tourism development, environmental protection and infrastructure construction in scenic spots. Eleventh major scenic spots planning should follow the following basic requirements:

Comply with the provisions of national and local laws and regulations on natural resources, ecological environment protection and river management;

(two) in line with the city's long-term national economic and social development planning, the overall planning of land and space, the national comprehensive planning of the Yellow River Basin, flood control planning, urban greening planning, environmental protection planning, tourism development planning, etc ... ;

(three) to coordinate the relationship between humanity and nature, protection and construction, history and development, and part and whole, and effectively protect the natural landscape, human landscape, historical features and ecological environment of large scenic spots;

(four) overall consideration of tourism development and the comprehensive needs of citizens' life, culture, entertainment, leisure and fitness, reasonably determine the scale, layout and location of infrastructure, cultural tourism facilities, service facilities and landscape facilities, and clearly define the planning and design conditions.
