How to protect rights when tourism is "slaughtered"?

Since the "Snow Town Tourism Cheating Event" was fermented on the Internet at the beginning of this year,

Many netizens also broke the experience that their travel was "slaughtered":

60 yuan sold a box of instant noodles.

A plate of fried meat is 288 yuan,

27,000 yuan per night for 9 people. ......

Recently, some netizens once again exposed their experience of being "slaughtered" while traveling in Yunnan. As the Dragon Boat Festival approaches, many people will choose to travel to spend it. Then, what responsibility should tourism bear if it is slaughtered, and how to prevent it from being "slaughtered"?

China's Consumer Protection Law and Price Law both have relevant provisions on the "fraudulent compensation" incident.

1. What is the law of the behavior of merchants sitting on the ground to start the price?

What consumers often encounter is: booking a hotel online, and when they arrive at the hotel, the merchants raise the price for various reasons. How is this behavior law stipulated?

Article 53 of China's Consumer Protection Law stipulates that if an operator provides goods or services in advance, it shall provide them in accordance with the agreement. If it is not provided in accordance with the agreement, it shall fulfill the agreement or return the advance payment according to the requirements of consumers; And shall bear the interest of the advance payment and the reasonable expenses that the consumer must pay.

According to the provisions of Article 9 of China's Tourism Law, tourists have the right to choose their own tourism products and services, and have the right to refuse the compulsory trading behavior of tourism operators. Moreover, travel agencies are not allowed to organize tourism activities at unreasonably low prices to trick tourists, and obtain kickbacks and other illegitimate interests by arranging shopping or paying for other tourism projects.

When organizing and receiving tourists, travel agencies shall not designate specific shopping places or arrange other paid tourism projects. However, unless it is agreed by both parties through consultation or requested by tourists and does not affect the itinerary of other tourists. If the travel agency has the above situation, the tourist has the right to request the travel agency to handle the return and advance the return fee within 30 days after the end of the travel itinerary, or refund the paid travel expenses.

Although both the Consumer Protection Law and the Tourism Law stipulate that the original payment can be refunded, consumers have to find a new residence after getting back the prepaid money, which greatly increases the time cost of consumers.

At the same time, China's "Price Law" also stipulates unfair price behavior. Paragraph 6 of Article 14 of the Price Law stipulates that buying and selling goods or providing services by raising the level or lowering the level in disguise is an unfair price behavior.

2. How to defend rights when being "slaughtered"?

In case of being slaughtered, the first thing to do is to keep relevant evidence. You can collect relevant evidence through video recording, audio recording, photographing and other channels, and keep relevant vouchers as proof of rights protection.

Secondly, if it is not convenient to defend rights in the tourist destination, you can complain to the local consumer association after you go back, or you can join forces with multiple consumers to file a lawsuit.

Therefore, if we encounter an incident of "cheating customers" while traveling, don't panic, and we should protect our rights in the right way.
