Chapter I General Provisions

Article 1 In order to strengthen the prevention of meteorological disasters, avoid and reduce losses caused by meteorological disasters, and ensure the safety of people's lives and property, these Regulations are formulated in accordance with the Meteorological Law of People's Republic of China (PRC).

Article 2 Those who engage in meteorological disaster prevention activities in People's Republic of China (PRC) and other sea areas under the jurisdiction of People's Republic of China (PRC) shall abide by these Regulations.

Meteorological disasters mentioned in these Regulations refer to disasters caused by typhoon, rainstorm (snow), cold wave, strong wind (sandstorm), low temperature, high temperature, drought, lightning, hail, frost and fog.

The provisions of relevant laws and administrative regulations shall apply to the prevention of derivative and secondary disasters caused by meteorological factors such as floods and droughts, geological disasters, marine disasters and forest and grassland fires.

Article 3 The prevention of meteorological disasters shall follow the principles of people-oriented, scientific defense, departmental linkage and social participation.

Fourth people's governments at or above the county level shall strengthen the organization, leadership and coordination of meteorological disaster prevention work, and incorporate meteorological disaster prevention work into the national economic and social development plan at the corresponding level, and the required funds into the fiscal budget at the corresponding level.

Article 5 The competent meteorological department in the State Council and the relevant departments in the State Council shall, in accordance with the division of responsibilities, do a good job in national meteorological disaster prevention.

Local competent meteorological departments at all levels and relevant departments of local people's governments at or above the county level shall, in accordance with the division of responsibilities, do a good job in the prevention of meteorological disasters within their respective administrative areas.

Article 6 Where meteorological disaster prevention involves more than two administrative regions, the relevant local people's governments and relevant departments shall establish a joint defense system and strengthen information communication, supervision and inspection.

Article 7 Local people's governments at all levels and relevant departments shall publicize and popularize meteorological disaster prevention knowledge to the society in various forms, so as to improve the public's awareness and ability of disaster prevention and reduction.

Schools should incorporate meteorological disaster prevention knowledge into relevant courses and extracurricular education content, and cultivate and improve students' awareness of meteorological disaster prevention and their ability of self-help and mutual assistance. Education, meteorology and other departments shall guide and supervise the meteorological disaster prevention education carried out by schools.

Article 8 The State encourages scientific and technological research on meteorological disaster prevention, supports the popularization and application of advanced technologies for meteorological disaster prevention, strengthens international cooperation and exchanges, and improves the scientific and technological level of meteorological disaster prevention.

Article 9 Citizens, legal persons and other organizations have the obligation to participate in the prevention of meteorological disasters and carry out self-help and mutual rescue after meteorological disasters occur.

Organizations and individuals who have made outstanding contributions to the prevention of meteorological disasters shall be commended and rewarded in accordance with the relevant provisions of the state.

Chapter II Prevention

Article 10 Local people's governments at or above the county level shall organize meteorological departments and other relevant departments to conduct a general survey of meteorological disasters within their respective administrative areas, establish a meteorological disaster database, conduct meteorological disaster risk assessment according to the types of meteorological disasters, and delimit meteorological disaster risk areas according to the distribution of meteorological disasters and the results of meteorological disaster risk assessment.

Eleventh the State Council meteorological authorities shall, in conjunction with the relevant departments of the State Council, formulate a national meteorological disaster prevention plan according to the results of meteorological disaster risk assessment and meteorological disaster risk areas, and organize the implementation after being submitted to the State Council for approval.

The local people's governments at or above the county level shall, according to the meteorological disaster prevention plan of the people's government at the next higher level and in combination with the characteristics of local meteorological disasters, organize relevant departments to formulate meteorological disaster prevention plans in their respective administrative areas.

Twelfth meteorological disaster prevention planning should include the occurrence and development of meteorological disasters and the status quo, defense principles and objectives, prone areas and prone periods, the construction and management of defense facilities and defense measures.

Thirteenth relevant departments of the State Council and local people's governments at or above the county level shall, according to the meteorological disaster prevention plan, strengthen the construction of meteorological disaster prevention facilities and do a good job in meteorological disaster prevention.

Fourteenth relevant departments in the State Council should consider the impact of meteorological disasters when formulating standards for infrastructure construction such as electric power and communication.

Fifteenth the State Council meteorological authorities shall, in conjunction with the relevant departments of the State Council, according to the needs of meteorological disaster prevention, prepare the national meteorological disaster emergency plan and report it to the State Council for approval.

The local people's governments at or above the county level and relevant departments shall, according to the meteorological disaster prevention plan, combine the characteristics of local meteorological disasters and the possible harm, organize the formulation of meteorological disaster emergency plans in their respective administrative areas, and report them to the people's government at the next higher level and relevant departments for the record.

Article 16 The emergency plan for meteorological disasters shall include the start-up standard of emergency plan, emergency organization and command system and responsibilities, prevention and early warning mechanism, emergency measures and safeguard measures.

Seventeenth local people's governments at all levels shall, according to the characteristics of local meteorological disasters, organize meteorological disaster emergency drills to improve emergency rescue capabilities. Residents' committees, villagers' committees, enterprises and institutions shall assist the local people's governments to publicize the knowledge of meteorological disaster prevention and carry out emergency drills for meteorological disasters.

Article 18 Local people's governments at all levels and relevant departments in areas with frequent strong winds (sandstorms) and tornadoes should strengthen the construction of shelter forests and emergency shelters, and regularly organize supervision and inspection of wind and danger avoidance of buildings.

Local people's governments at all levels and relevant departments in typhoon-prone areas should strengthen the construction of seawalls, dikes, safe havens, shelterbelts, sheltered anchorages and emergency shelters, and make good preparations for personnel transfer according to typhoon conditions.

Article 19 Local people's governments at all levels and relevant departments and units shall, according to local rainfall conditions, organize regular inspections of various drainage facilities, promptly dredge river courses and drainage networks, reinforce dangerous reservoirs, and strengthen inspections of important dangerous areas such as geological disaster-prone areas and dikes.

Twentieth local people's governments at all levels, relevant departments and units shall, according to the occurrence of local snowfall and freezing, strengthen the inspection of power and communication lines, and make good preparations for traffic guidance, snow (ice) removal and line maintenance.

The relevant units and individuals shall, according to the local snowfall situation, make preparations for the reinforcement of dangerous houses, grain and grass reserves, and livestock transfer.

Twenty-first local people's governments at all levels, relevant departments and units should make good preparations for power supply, water supply and heatstroke prevention drugs supply before the high temperature comes, and adjust working hours reasonably.

Article 22 The local people's governments at all levels and relevant departments and units in fog and haze-prone areas should strengthen the construction of fog and haze monitoring facilities in airports, ports, highways, waterways, fishing grounds and other important places and traffic arteries, and do a good job in traffic guidance, dispatching and security.

Twenty-third all kinds of buildings (structures), places and facilities to install lightning protection devices shall comply with the provisions of the relevant national lightning protection standards.

Review the design documents of newly built, rebuilt and expanded buildings (structures) and solicit opinions from the competent meteorological departments on the design of lightning protection devices; When the newly built, rebuilt and expanded buildings (structures) are completed and accepted, the lightning protection devices shall be accepted at the same time, and the competent meteorological departments shall participate. Where lightning protection devices need to be installed separately in mining areas, tourist attractions or buildings (structures) and facilities put into use in lightning-prone areas, the local competent meteorological departments at or above the county level shall be responsible for the design review and completion acceptance of lightning protection devices.

Twenty-fourth units specializing in the design, construction and detection of lightning protection devices shall meet the following conditions and obtain the qualification certificates issued by the competent meteorological departments of the State Council or provinces, autonomous regions and municipalities directly under the Central Government:

(1) Having the qualification of a legal person;

(2) Having a fixed office space and necessary equipment and facilities;

(3) Having corresponding professional and technical personnel;

(4) Having a sound technical and quality management system;

(five) other conditions stipulated by the competent meteorological department of the State Council.

Units engaged in the detection of lightning protection devices for electric power and communication shall have their qualification certificates issued by the competent meteorological department of the State Council, the competent electric power department of the State Council or the competent communication department of the State Council. Units that have obtained the qualification for design and construction of construction projects according to law may engage in the design and construction of lightning protection devices for construction projects within the approved qualification scope.

Twenty-fifth local people's governments at all levels and relevant departments shall, according to the occurrence of local meteorological disasters, strengthen the infrastructure construction of rural meteorological disaster prevention, monitoring and information dissemination, and take comprehensive measures to do a good job in rural meteorological disaster prevention.

Twenty-sixth competent meteorological departments at all levels shall, under the leadership and coordination of the people's governments at the corresponding levels, organize and carry out weather modification work according to actual conditions to reduce the impact of meteorological disasters.

Article 27 The relevant departments of the people's governments at or above the county level shall, when compiling major national construction projects, major regional economic development projects, large-scale projects for the development and utilization of climate resources such as solar energy and wind energy, and urban and rural planning, make overall consideration of climate feasibility and meteorological disaster risks to avoid and mitigate the impact of meteorological disasters.

Chapter III Monitoring, Prediction and Early Warning

Twenty-eighth local people's governments at or above the county level shall, according to the needs of meteorological disaster prevention, build emergency mobile meteorological disaster monitoring facilities, improve the emergency monitoring team and improve the meteorological disaster monitoring system.

The people's governments at or above the county level shall integrate and improve the meteorological disaster monitoring information network to realize the sharing of information resources.

Twenty-ninth competent meteorological departments at all levels and their subordinate meteorological stations shall improve the disastrous weather forecasting system and improve the accuracy and timeliness of disastrous weather forecasting and early warning.

Meteorological offices and stations affiliated to competent meteorological departments at all levels, and meteorological offices and stations affiliated to other relevant departments and units related to disastrous weather monitoring and forecasting shall carry out disastrous weather monitoring according to the needs of meteorological disaster prevention and responsibilities, and provide timely monitoring information such as rain, water, soil moisture and drought to competent meteorological departments and relevant disaster prevention and rescue departments.

The competent meteorological departments at all levels shall, according to the needs of meteorological disaster prevention, organize and carry out joint monitoring of meteorological disasters across regions and departments, and take densely populated areas, major agricultural producing areas, geological disaster-prone areas, important river basins, forests, grasslands and fishing grounds as key areas for meteorological disaster monitoring.

Thirtieth meteorological offices and stations subordinate to the competent meteorological departments at all levels shall, in accordance with their duties, uniformly issue disastrous weather warnings and meteorological disaster warning signals to the society, and promptly notify the relevant disaster prevention and relief departments; Other organizations and individuals shall not release disastrous weather warnings and meteorological disaster warning signals to the society.

The types and grades of meteorological disaster warning signals shall be stipulated by the competent meteorological department of the State Council.

Article 31 Radio, television, newspapers, telecommunications and other media shall broadcast or publish the disastrous weather warning and meteorological disaster warning signals provided by the meteorological offices and stations affiliated to the local competent meteorological departments in a timely manner, and broadcast, insert or publish them in a timely manner according to the requirements of the local meteorological offices and stations.

Article 32 The local people's governments at or above the county level shall establish and improve the meteorological disaster early warning information dissemination system, establish facilities for receiving and broadcasting disastrous weather warnings and meteorological disaster early warning signals in densely populated areas such as transportation hubs and public places and areas prone to meteorological disasters according to the needs of meteorological disaster prevention, and ensure the normal operation of the facilities.

Township (town) people's governments and sub-district offices shall determine personnel to assist the competent meteorological departments and civil affairs departments to carry out meteorological disaster prevention knowledge propaganda, emergency contact, information transmission, disaster report and disaster investigation.

Thirty-third competent meteorological departments at all levels should do a good job in monitoring, forecasting and early warning of space weather disasters such as solar storms and earth space storms.

Chapter IV Emergency Disposal

Thirty-fourth meteorological offices and stations affiliated to the competent meteorological departments at all levels shall timely release disastrous weather forecasts, warnings and meteorological disaster warning information to the people's governments at the corresponding levels and relevant departments.

The local people's governments at or above the county level and their relevant departments shall, according to the criteria for starting the emergency plan for severe weather warning, meteorological disaster warning signals and meteorological disasters, make a decision to start the corresponding emergency plan in time, announce it to the public and report it to the people's government at the next higher level; When necessary, they can report to the local garrison and the people's governments in neighboring areas that may be endangered.

When large-scale meteorological disasters occurred across provinces, autonomous regions and municipalities directly under the Central Government and caused great harm, the State Council decided to start the national meteorological disaster emergency plan.

Thirty-fifth local people's governments at or above the county level shall, according to the scope and intensity of disastrous weather, temporarily determine the areas that may cause casualties or heavy property losses as meteorological disaster danger areas, and make a timely announcement.

Thirty-sixth local people's governments at or above the county level and relevant departments shall, according to the occurrence of meteorological disasters, take emergency measures in a timely manner in accordance with the provisions of the People's Republic of China (PRC) Emergency Response Law; In case of emergency, timely mobilize and organize the evacuation of people threatened by disasters, and carry out self-help and mutual rescue.

Any unit or individual shall cooperate with the local people's government and relevant departments to implement emergency measures for meteorological disasters, and shall not interfere with meteorological disaster relief activities.

Article 37 After the meteorological disaster emergency plan is launched, the competent meteorological departments at all levels shall organize their subordinate meteorological stations to strengthen the monitoring and evaluation of meteorological disasters, activate emergency mobile meteorological disaster monitoring facilities, carry out on-site meteorological services, and report the disastrous weather situation, changing trends and evaluation results to the people's government at the corresponding level and relevant departments in a timely manner, so as to provide decision-making basis for the people's government at the corresponding level to organize the prevention of meteorological disasters.

Thirty-eighth relevant departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job in corresponding emergency work.

Civil affairs departments should set up shelters and relief materials supply points to carry out relief work for the affected people, and verify the disaster situation and release disaster information in accordance with the prescribed duties.

The competent department of health shall organize medical treatment, health and epidemic prevention and other health emergency work.

Transportation, railway and other departments should give priority to the delivery of relief materials, equipment, medicines and food, and timely repair damaged road traffic facilities.

Housing and urban construction departments shall ensure the safe operation of municipal public facilities such as water supply, gas supply and heating.

The competent department of electric power and communication shall organize emergency support for electric power and communication.

The departments of land and resources shall organize the monitoring and prevention of geological disasters.

The competent agricultural departments shall organize technical guidance for agricultural disaster relief and agricultural production.

The water conservancy department shall coordinate the water dispatching of important rivers and reservoirs and organize flood control and drought relief work.

The public security department is responsible for maintaining social security and road traffic order in the disaster area and assisting in organizing the people in the disaster area to make emergency transfer.

Thirty-ninth meteorological, water conservancy, land and resources, agriculture, forestry, marine and other departments shall, according to the occurrence of meteorological disasters, strengthen the joint monitoring of derivative and secondary disasters caused by meteorological factors, and do a good job in emergency treatment according to the corresponding emergency plan.

Fortieth radio, television, newspapers, telecommunications and other media should timely and accurately spread the occurrence, development and emergency response of meteorological disasters to the society.

Article 41 The people's governments at or above the county level and their relevant departments shall, according to the occurrence and development trend of disastrous weather and the development of disasters provided by the competent meteorological departments, timely adjust the level of meteorological disasters or decide emergency measures to relieve meteorological disasters in accordance with relevant regulations.

Forty-second after the emergency response to meteorological disasters, local people's governments at all levels shall organize relevant departments to investigate the losses caused by meteorological disasters, formulate recovery and reconstruction plans, and report to the people's government at the next higher level.

Chapter V Legal Liability

Forty-third in violation of the provisions of these regulations, local people's governments at all levels, competent meteorological departments at all levels and other relevant departments and their staff have one of the following acts, and their superior organs or supervisory organs shall order them to make corrections; If the circumstances are serious, the directly responsible person in charge and other directly responsible personnel shall be punished according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(a) failing to prepare a meteorological disaster prevention plan or a meteorological disaster emergency plan in accordance with the provisions;

(two) failing to take preventive measures against meteorological disasters in accordance with the provisions;

(three) to issue qualification certificates for the design, construction and testing of lightning protection devices to unqualified units;

(4) Concealing, falsely reporting or neglecting their duties, failing to report or falsely reporting disastrous weather warning or meteorological disaster warning signals;

(5) Failing to take emergency measures for meteorological disasters in time;

(six) other acts that do not perform their duties according to law.

Forty-fourth in violation of the provisions of this Ordinance, one of the following acts, the local people's governments at or above the county level or the relevant departments shall be ordered to make corrections; If it constitutes a violation of public security administration, it shall be punished by the public security organ according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(a) failing to take preventive measures against meteorological disasters in accordance with the provisions;

(two) do not obey the decisions and orders issued by the local people's government and its relevant departments, or do not cooperate with the implementation of meteorological disaster emergency measures taken according to law.

Forty-fifth in violation of the provisions of this Ordinance, one of the following acts, by the competent meteorological departments at or above the county level or other relevant departments in accordance with the authority shall be ordered to stop the illegal act, fined 50 thousand yuan to 6.5438 million yuan; Illegal income, confiscate the illegal income; If losses are caused to others, they shall be liable for compensation according to law:

(a) engaged in the design, construction and testing of lightning protection devices without qualification or beyond the scope of qualification;

(two) fraud in the design, construction and detection of lightning protection devices.

Forty-sixth in violation of the provisions of this Ordinance, one of the following acts, the competent meteorological departments at or above the county level shall be ordered to make corrections, given a warning, and may be fined up to 50 thousand yuan; Constitute a violation of public security management, shall be punished by the public security organs according to law:

(a) unauthorized release of severe weather warning and meteorological disaster warning signals to the society;

(two) radio, television, newspapers, telecommunications and other media did not broadcast or release the disastrous weather warning and meteorological disaster warning signal as required;

(3) spreading false or illegal disastrous weather information and meteorological disasters.

Chapter VI Supplementary Provisions

Forty-seventh China People's Liberation Army meteorological disaster prevention activities in accordance with the provisions of the Central Military Commission (CMC).

Article 48 These Regulations shall come into force on April 1 day, 2065.
