Regulations of Tonghua Municipality on Safety Management of Fireworks and Firecrackers

Article 1 In order to strengthen the safety management of fireworks and firecrackers, safeguard public safety and personal and property safety, and protect the environment, these Regulations are formulated in accordance with the State Council's "Regulations on the Safety Management of Fireworks and Firecrackers" and other laws and regulations, combined with the actual situation of this Municipality. Article 2 Fireworks and firecrackers as mentioned in these Regulations refer to fireworks and firecrackers products and civil black powder, pyrotechnics, fuses and other articles used for the production of fireworks and firecrackers. Article 3 These Regulations shall apply to the discharge of fireworks and firecrackers and related safety management activities in the urban areas of this Municipality. Article 4 These Regulations shall be organized and implemented by the Municipal People's Government. The public security organ is responsible for the safety management of fireworks and firecrackers.

Safety production supervision and management department is responsible for the safety management of fireworks production, operation and storage.

Environmental protection, quality and technical supervision, urban and rural construction, planning, meteorology and other departments shall perform corresponding functions according to law. Article 5 Dongchang District People's Government, Erdaojiang District People's Government, Medicine High-tech Zone Administrative Committee, township (town) people's government and sub-district offices shall do a good job in the safety management of fireworks and firecrackers.

Community residents' committees, villagers' committees, owners' committees and property service enterprises shall assist in the safety management of fireworks and firecrackers. Article 6 State organs, social organizations, enterprises and institutions, schools and other organizations shall carry out publicity and education on laws and regulations related to the safety management of fireworks and firecrackers.

Radio, television, newspapers and other news media shall publicize the laws and regulations related to the safety management of fireworks and firecrackers. Article 7 The discharge, production, operation, storage and transportation of fireworks and firecrackers are prohibited in the main urban areas of this Municipality.

The boundary of the main urban area shall be reasonably demarcated by the Municipal People's Government according to law and announced to the public; The scope of the main city should be reasonably adjusted according to the actual development of the city. Eighth major public activities determined by the Municipal People's government really need to hold fireworks activities in the main city, the organizer shall submit materials that meet the requirements of the State Council's "Regulations on the Safety Management of Fireworks and Firecrackers" and apply to the municipal public security organ for permission. The municipal public security organ shall, within 20 days from the date of acceptance, review the relevant materials submitted, and issue a discharge license if it meets the conditions; Do not meet the requirements, it shall explain the reasons.

The Municipal People's Government will announce the time and place of permitted discharge to the public. Ninth places outside the main city, it is forbidden to set off fireworks:

Office of state organs;

(two) the scope of protection of cultural relics protection units, cultural relics protection points and historical buildings;

(3) Units that produce, manage, store and transport inflammable and explosive articles;

(4) the location of military facilities; (five) forests, wetlands, water sources, natural ecological protection areas and key fire prevention areas;

(6) Medical institutions, kindergartens, schools, institutions for the aged and places for religious activities;

(seven) power transmission and transformation facilities safety protection zone;

(eight) transportation hubs such as stations, docks and airports, and safety protection zones for rail transit and railway lines;

(nine) shopping malls, markets, hotels, cinemas, squares and tourist attractions and other crowded places;

(ten) residential quarters, high-rise buildings, underground buildings, construction sites, public parking lots and public parking garages. Tenth in the urban areas of this Municipality, in case of the warning signal of gale above level 6 and haze above moderate level issued by the meteorological department, it is forbidden to set off fireworks and firecrackers. Eleventh fireworks should be set off in accordance with the discharge instructions, and fireworks should not be set off in a way that endangers public safety and personal and property safety. Twelfth it is forbidden to carry fireworks and firecrackers on public transport.

It is forbidden to mail fireworks and firecrackers, and it is forbidden to carry fireworks and firecrackers in checked luggage, parcels and mails.

It is forbidden to bring fireworks into areas and places where fireworks and firecrackers are prohibited by these regulations. Thirteenth in violation of the provisions of the first paragraph of article seventh, article ninth, article tenth and article eleventh of this Ordinance, the public security organ shall order it to stop the illegal act and impose a fine of not less than one hundred yuan but not more than five hundred yuan; Fireworks and firecrackers that have not been set off at the scene shall be handled in accordance with the provisions of Article 16 of these regulations. Fourteenth in violation of the provisions of the first paragraph of article eighth of this Ordinance, the public security organ shall order it to stop the illegal act and impose a fine of fifty thousand yuan. Article 15 Whoever, in violation of the first paragraph of Article 7 of these regulations, produces and operates fireworks and firecrackers shall be ordered by the safety production supervision and management department to stop the illegal production and operation activities, and be fined more than 20,000 yuan/kloc-0,000 yuan, and the articles produced and operated illegally and the illegal income shall be confiscated.

In violation of the provisions of the first paragraph of Article 7 of these regulations, fireworks and firecrackers are transported by road, and the public security organ shall order them to stop illegal transportation activities, impose a fine of not less than 10,000 yuan but not more than 50,000 yuan, and confiscate the illegally transported articles and illegal income.

In violation of the provisions of the seventh paragraph of this Ordinance, illegal storage of fireworks and firecrackers shall be punished by the safety production supervision and management departments and public security organs according to law. Sixteenth in violation of the provisions of the provisions of article twelfth, the public security organs confiscated illegal fireworks; In violation of the provisions of the first and second paragraphs, a fine of one thousand yuan shall be imposed. Seventeenth public security organs shall organize the destruction and disposal of confiscated illegal fireworks and firecrackers and abandoned fireworks and firecrackers by production and operation enterprises. Eighteenth in violation of the provisions of this Ordinance, which constitutes an illegal act of public security management, shall be punished in accordance with the relevant provisions of the "People's Republic of China (PRC) Public Security Management Punishment Law"; Whoever causes property damage or personal injury to the state, collective or individual shall bear civil liability according to law.
