One, in violation of the following provisions, the local people's governments at or above the county level and their forest fire prevention headquarters, the competent forestry departments of the people's governments at or above the county level or other relevant departments and their staff members have one of the following acts, and their superior administrative organs or supervisory organs shall order them to make corrections; If the circumstances are serious, the directly responsible person in charge and other directly responsible personnel shall be punished according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(a) failing to prepare the forest fire emergency plan in accordance with the provisions;

(two) found that the forest fire hazards did not promptly issue a notice of rectification of forest fire hazards;

(three) the approval does not meet the requirements of forest fire prevention in the field with fire or live ammunition drills, blasting and other activities;

(four) concealing, lying or deliberately delaying the report of forest fires;

(five) did not take timely measures to put out forest fires;

(six) other acts that do not perform their duties according to law.

Second, in violation of the provisions of this Ordinance, if the business units or individuals of forests, trees and woodlands fail to perform the responsibility of forest fire prevention, the competent forestry authorities of the local people's governments at or above the county level shall order them to make corrections, impose a fine of more than 5,000 yuan on individuals, and impose a fine of more than 60,000 yuan and less than 50,000 yuan on units.

Three, in violation of the provisions of this Ordinance, the relevant units or individuals in the forest fire prevention area refused to accept the forest fire prevention inspection or failed to eliminate the fire hazards after receiving the notice of rectification of forest fire hazards, the competent forestry department of the local people's government at or above the county level shall order it to make corrections, give it a warning, impose a fine of more than 200 yuan but less than 2,000 yuan on individuals, and impose a fine of more than 5,000 yuan but less than 60,000 yuan on units.

Four, in violation of the provisions of this Ordinance, in the forest fire prevention period without authorization in the forest fire prevention area, by the competent forestry department of the local people's government at or above the county level shall be ordered to stop the illegal behavior, given a warning, impose a fine of more than 3000 yuan in 200 yuan for individuals, and impose a fine of more than 654.38+0000 yuan to 50000 yuan for units.

Five, in violation of the provisions of this Ordinance, in the forest fire prevention period, without approval in the forest fire prevention area for live-fire drills, blasting and other activities, by the competent forestry department of the local people's government at or above the county level shall be ordered to stop the illegal behavior, given a warning, and impose a fine of 50000 yuan to 6543800 yuan.

Six, in violation of the provisions of this Ordinance, one of the following acts, the competent forestry department of the local people's government at or above the county level shall order it to make corrections, give a warning, impose a fine of more than two thousand yuan on individuals and a fine of more than two thousand yuan on units:

(a) during the forest fire prevention period, the business units of forests, trees and woodlands have not set up warning signs for forest fire prevention;

(two) during the forest fire prevention period, the motor vehicles entering the forest fire prevention area are not equipped with forest fire prevention devices;

(three) in the period of high forest fire risk, entering the high forest fire risk area without approval.

Seven, in violation of the provisions of this Ordinance, causing forest fires, which constitutes a crime, shall be investigated for criminal responsibility according to law; If it does not constitute a crime, the competent forestry department of the local people's government at or above the county level may order the responsible person to replant trees, in addition to being investigated for legal responsibility in accordance with the provisions of Articles 48, 49, 50, 51 and 52 of this Ordinance.

Eight, special vehicles for forest fire prevention should be sprayed with logo patterns in accordance with the regulations, and alarm and sign lamps should be installed.

9. Forest fires in the border areas of People's Republic of China (PRC) shall be put out in accordance with the relevant agreements signed between the governments of People's Republic of China (PRC) and China and the governments of relevant countries; If there is no agreement, it shall be handled through consultation between People's Republic of China (PRC) and the governments of relevant countries.
