Contents of the Measures for the Release and Dissemination of Meteorological Disaster Warning Signals

Article 1 In order to standardize the release and dissemination of meteorological disaster warning signals, prevent and mitigate meteorological disasters, and protect the lives and property of the state and people, these Measures are formulated in accordance with the Meteorological Law of People's Republic of China (PRC) and the National Overall Emergency Plan for Public Emergencies.

Article 2 The release and dissemination of meteorological disaster warning signals in People's Republic of China (PRC) and other sea areas under the jurisdiction of People's Republic of China (PRC) must abide by these Measures.

The term "meteorological disaster early warning signal" as mentioned in these Measures refers to the early warning information released to the public by the meteorological offices and stations subordinate to the competent meteorological departments at all levels.

Early warning signals are composed of names, icons, standards and defense guidelines, which are divided into typhoon, rainstorm, blizzard, cold wave, gale, sandstorm, high temperature, drought, lightning, hail, frost, fog, haze, road icing and so on.

Article 3 The levels of early warning signals are generally divided into four levels: IV (general), III (heavier), II (serious) and I (particularly serious) according to the degree of harm, urgency and development trend that meteorological disasters may cause, which are indicated in blue, yellow, orange and red in turn and marked in Chinese and English.

According to the characteristics and early warning ability of different kinds of meteorological disasters, this method determines the early warning signal levels of different kinds of meteorological disasters.

Article 4 The competent meteorological department of the State Council shall be responsible for the administration of the release, cancellation and dissemination of national early warning signals.

The local competent meteorological departments at all levels shall be responsible for the administration of the release, cancellation and dissemination of early warning signals within their respective administrative areas.

Other relevant departments shall, in accordance with their duties, cooperate with the competent meteorological departments in the release and dissemination of early warning signals.

Article 5 Local people's governments at all levels shall strengthen the infrastructure construction of early warning signals, establish smooth and effective channels for the release and dissemination of early warning information, expand the coverage of early warning information, and organize relevant departments to establish emergency mechanisms and systems for meteorological disasters.

Management units of schools, airports, ports, stations, highways, tourist attractions and other crowded public places shall set up or use electronic display devices and other facilities to spread early warning signals.

Article 6 The State protects the special transmission facilities for early warning signals according to law, and no organization or individual may occupy, damage or move them without authorization.

Seventh early warning signals to implement a unified release system.

Meteorological offices and stations subordinate to the competent meteorological departments at all levels shall issue early warning signals in accordance with the release authority and business processes, and indicate the early warning areas of meteorological disasters. Release authority and business process shall be formulated separately by the competent meteorological department of the State Council.

No other organization or individual may issue an early warning signal to the society.

Article 8 Meteorological offices and stations subordinate to competent meteorological departments at all levels shall issue early warning signals in time, update or cancel early warning signals in time according to weather changes, and notify the people's governments at the corresponding levels, relevant departments and disaster prevention and mitigation institutions.

When multiple meteorological disasters occur at the same time or are predicted to occur, multiple early warning signals can be issued at the same time according to corresponding standards.

Article 9 Meteorological offices and stations affiliated to competent meteorological departments at all levels shall make full use of radio, television, fixed network, mobile network, Internet, electronic display equipment and other means to release early warning signals to the society in a timely manner. When issuing early warning signals in ethnic minority areas, in addition to the Chinese language, the local common ethnic minority languages should also be used.

Article 10 Media such as radio and television and communication networks such as fixed network, mobile network and Internet shall cooperate with the competent meteorological department to disseminate early warning signals in a timely manner, use real-time early warning signals directly provided by the meteorological offices and stations affiliated to the competent meteorological department, and indicate the name and release time of the meteorological offices and stations that issued the early warning signals. And shall not change or delete the contents of the warning signal, shall not refuse to spread the warning signal of meteorological disasters, and shall not spread the false and outdated warning signal of meteorological disasters.

Eleventh local people's governments at all levels and their relevant departments shall, after receiving the early warning signals provided by the meteorological offices and stations affiliated to the competent meteorological departments, issue public announcements in a timely manner, widely disseminate them to the society, and take effective measures to prevent meteorological disasters according to their duties, so as to avoid or mitigate meteorological disasters.

Article 12 The competent meteorological department shall organize the education and publicity of early warning signals of meteorological disasters, compile and publish publicity materials of early warning signals, popularize knowledge of meteorological disaster prevention and mitigation, enhance public awareness of disaster prevention and mitigation, and improve public self-help and mutual rescue capabilities.

Thirteenth in violation of the provisions of these measures, occupy, damage or move the special transmission facilities for early warning signals without authorization, the relevant competent meteorological departments shall be investigated for legal responsibility in accordance with the provisions of Article 35 of the Meteorological Law of People's Republic of China (PRC).

Fourteenth in violation of the provisions of these measures, one of the following acts, the relevant competent meteorological departments shall be investigated for legal responsibility in accordance with the provisions of Article 38 of the National Meteorological Law of People's Republic of China (PRC):

(a) illegal release and dissemination of early warning signals to the society;

(two) radio, television and other media and fixed networks, mobile networks, Internet and other communication networks do not use the real-time early warning signals provided by the meteorological offices and stations affiliated to the competent meteorological departments.

Fifteenth meteorological staff dereliction of duty, leading to major mistakes in the release of early warning signals, the directly responsible personnel and the main person in charge shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Sixteenth meteorological stations subordinate to local competent meteorological departments at all levels shall issue early warning signals, and all kinds of early warning signal standards in the Guide to Meteorological Disaster Early Warning Signals and Defense attached to these Measures shall apply.

Provinces, autonomous regions and municipalities directly under the Central Government may, when formulating local regulations, local government rules or normative documents, select or increase the types of early warning signals specified in these Measures according to the characteristics of meteorological disasters within their respective administrative areas, set different signal standards, and be examined and approved by the competent meteorological department of the State Council.

Seventeenth meteorological stations subordinate to the competent meteorological department of the State Council issued early warning signal standards formulated by the competent meteorological department of the State Council.

Article 18 These Measures shall come into force as of the date of promulgation.
