Measures for the administration of meteorological forecast release and dissemination

Article 1 These Measures are formulated in accordance with the Meteorological Law of People's Republic of China (PRC) and the Regulations on the Prevention of Meteorological Disasters in order to standardize the release of meteorological forecasts, promote the dissemination of meteorological forecasts and better serve economic and social development and people's lives. Article 2 Whoever engages in the release and dissemination of meteorological forecasts in People's Republic of China (PRC) and other sea areas under the jurisdiction of People's Republic of China (PRC) shall abide by these Measures. Article 3 The meteorological forecast mentioned in these Measures includes public meteorological forecast, severe weather warning and meteorological disaster warning signals.

The term "public meteorological forecast" as mentioned in these Measures refers to the forecast of weather phenomena, clouds, wind direction, wind speed, temperature, humidity, air pressure, precipitation, visibility and other meteorological elements released by the public, as well as the forecast of space weather elements such as solar-terrestrial space weather phenomena, solar activity level, geomagnetic activity level, ionospheric activity level, space particle radiation environment, and middle and upper atmospheric state parameters.

The term "disastrous weather warning and meteorological disaster warning signals" as mentioned in these Measures refers to meteorological disaster warning information such as typhoon, rainstorm, blizzard, cold wave, gale, sandstorm, low temperature, high temperature, drought, lightning, hail, frost, fog, haze, road icing, and space weather disaster warning information such as solar flare, solar proton event, coronal mass ejection, magnetic storm and ionospheric storm.

The release of meteorological forecast as mentioned in these Measures refers to the process of providing meteorological forecast to the public free of charge.

The term "meteorological forecast dissemination" as mentioned in these Measures refers to the process of broadcasting and reprinting the published meteorological forecast. Article 4 The competent meteorological department in the State Council and the relevant departments in the State Council shall, in accordance with the division of responsibilities, jointly do a good job in the release and dissemination of national meteorological forecasts, and strengthen supervision and management.

Local competent meteorological departments at all levels and relevant departments of local people's governments at or above the county level shall, in accordance with the division of responsibilities, do a good job in the release and dissemination of meteorological forecasts within their respective administrative areas, and strengthen supervision and management. Article 5 Local people's governments at or above the county level shall organize relevant departments and units such as press and publication, radio and television, telecommunications, transportation, meteorology, Internet, etc., and establish and improve channels for the release and dissemination of meteorological forecasts.

The media and units that disseminate meteorological forecasts shall establish and obtain the latest meteorological forecast mechanism with the meteorological offices and stations affiliated to the local competent meteorological departments to ensure the timely and accurate dissemination of meteorological forecasts. Article 6 Meteorological forecasts shall be issued in a unified manner. Meteorological offices and stations subordinate to the competent meteorological departments at all levels shall, in accordance with their duties, issue meteorological forecasts to the public through the channels for issuing meteorological forecasts, and update and issue meteorological forecasts in a timely manner according to weather changes.

No other organization or individual may release weather forecast to the society in any form. Article 7 The media and units designated by the people's governments at all levels shall arrange fixed time and frequency, channels, layout and layout, and timely disseminate the latest weather forecast provided by the meteorological offices and stations subordinate to the competent meteorological departments. If a radio station or television station (station) changes the broadcast time of a weather forecast program, it shall obtain the consent of the meteorological station affiliated to the local competent meteorological department in advance. Eighth people's governments at all levels shall organize meteorological departments and other relevant departments to establish a mechanism for rapid release and dissemination of meteorological disaster early warning information. When severe weather is possible or has occurred, the media and units shall, in accordance with the requirements of the meteorological offices and stations affiliated to the competent meteorological departments, broadcast and insert important severe weather warnings and meteorological disaster warning signals in time.

After the disaster weather warning and meteorological disaster warning signals are released, the media and units shall update them in time, and shall not spread outdated disaster weather warning and meteorological disaster warning signals. Ninth to encourage the media and units to spread the weather forecast. When disseminating weather forecasts, media and units shall use the latest weather forecasts provided by the meteorological offices and stations affiliated to the local competent meteorological departments, and indicate the names and release times of the meteorological offices and stations that issued the weather forecasts, and shall not change the contents and conclusions of the weather forecasts themselves. Tenth meteorological forecast opinions and conclusions formed by scientific research and teaching units, academic groups and individuals can be provided to the meteorological stations affiliated to the competent meteorological departments for reference when making meteorological forecasts, but they shall not be made public in any form. Eleventh other relevant departments of the State Council and other relevant departments of the people's governments of provinces, autonomous regions and municipalities directly under the central government can publish special meteorological forecasts using this system, but they shall not be released to the public in any form. Twelfth in violation of the provisions of these measures, one of the following acts, by the relevant competent meteorological departments in accordance with the authority shall be ordered to make corrections, given a warning, and may impose a fine of 50 thousand yuan:

(a) the illegal release of weather forecasts;

(2) Disseminating weather forecasts to the society without using the latest weather forecasts provided by meteorological stations affiliated to local competent meteorological departments. Article 13 If the staff of meteorological offices and stations affiliated to competent meteorological departments at all levels neglect their duties and fail to publish meteorological forecasts according to the regulations, causing serious consequences, they shall be given administrative sanctions according to law; If it causes great losses to national interests and people's lives and property and constitutes a crime, criminal responsibility shall be investigated according to law. Fourteenth in violation of the provisions of these measures, one of the following acts, by the relevant competent meteorological departments in accordance with the authority shall be ordered to make corrections, given a warning, and may impose a fine of 30 thousand yuan; Causing casualties or heavy property losses, which constitutes a crime, shall be investigated for criminal responsibility according to law.

(1) Spreading false weather forecasts;

(2) Failing to broadcast or insert important severe weather warnings, meteorological disaster warning signals and timely update the meteorological forecast in accordance with regulations;

(three) the dissemination of meteorological forecast to the society does not indicate the name of the publishing unit and the release time;

(4) changing the contents and conclusions of the weather forecast without authorization, resulting in adverse social reactions or certain impacts.
