In order to strengthen the management of setting off fireworks and firecrackers, setting off Kongming lanterns and burning open flames, prevent air pollution and prevent fire and explosion accidents, according to the provisions of the People's Republic of China (PRC) Air Pollution Prevention Law, the People's Republic of China (PRC) Public Security Management Punishment Law, the Fireworks and Firecrackers Safety Management Regulations and other laws and regulations, combined with the actual situation of our city, we make the following decision:

1. Lighting is prohibited within the administrative area of this Municipality.

Two, the following administrative areas prohibit the discharge of fireworks and bonfires.

(1) Xincheng District, Huimin District, Yuquan District, Saihan District, Economic and Technological Development Zone and Helinger New District;

(II) The people's governments of Tumote Zuo Qi, Togtoh County, Horinger County, Qingshuihe County and Wuchuan County demarcate areas where fireworks and firecrackers are prohibited within their respective administrative areas, report them to the Municipal People's government, and announce to the public the areas where fireworks and firecrackers are prohibited.

Where there are other provisions in laws and regulations prohibiting the discharge of fireworks and firecrackers and in prosperous areas, those provisions shall prevail.

Three, during the emergency response to heavy pollution weather, the administrative area of this Municipality is completely prohibited from setting off fireworks and burning fire.

Four, this decision is organized and implemented by the people's governments at all levels.

City and counties in the District People's government, the Economic and Technological Development Zone Management Committee shall strengthen the organization and leadership of the management of the prohibition of fireworks and firecrackers, the discharge of Kongming lanterns and the burning of kindling, and coordinate and solve major problems in the prohibition of fireworks and firecrackers.

The public security organs investigate and deal with illegal fireworks, lanterns and flourishing fires.

Emergency management, market supervision and management departments are responsible for the supervision and management of fireworks sales within their respective responsibilities.

Urban management comprehensive law enforcement, ecological environment, civil affairs and other departments shall, in accordance with their respective responsibilities, do a good job in prohibiting the discharge of fireworks and firecrackers, setting off Kongming lanterns and burning kindling.

The departments of culture, tourism, radio, film and television are responsible for using the news media such as internet, radio, television, newspapers and periodicals to do a good job in the safe discharge of fireworks and firecrackers, and it is forbidden to publicize and educate the safety knowledge such as the discharge of Kongming lanterns and the burning of kindling.

Township People's governments and sub-district offices shall incorporate the prohibition of fireworks, the discharge of Kongming lanterns and the burning of flourishing fires into the work of social governance at the grass-roots level, be responsible for publicizing, guiding and urging units and individuals within their respective jurisdictions to abide by this decision, and cooperate with relevant departments to do a good job in the management of the prohibition of fireworks.

Social organizations, enterprises and institutions, residents' committees, villagers' committees, property service enterprises and other organizations in this Municipality shall cooperate with the management of prohibiting the discharge of fireworks and firecrackers, the discharge of Kongming lanterns and the burning of kindling.

Five, fireworks wholesale enterprises shall not set up fireworks storage warehouses in urban built-up areas, and it is forbidden to store fireworks outside the storage places specified in the fireworks business license.

Six, fireworks business and hold fireworks evening and other large-scale fireworks display activities to implement the licensing system. Without permission, no unit or individual may hold a fireworks party or other large-scale fireworks display activities.

Nine, the public security organ shall strictly examine the qualifications of the business units and operators of fireworks display or other large-scale fireworks display activities, and urge, inspect and guide the organizers to do a good job in security, emergency rescue and vigilance.

Ten, to provide wedding, banquet, funeral services business enterprises or individuals, should fulfill the obligation to inform, in advance to the organizers in writing not to set off fireworks in the area specified in this decision. Business enterprises that provide wedding, banquet and funeral services shall not provide services for those who set off fireworks and firecrackers in violation of regulations, discourage those who set off fireworks and firecrackers in violation of regulations, or report to the public security organs.

Eleven, any unit or individual has the right to report the behavior of setting off and selling fireworks and firecrackers in violation of this decision.

After receiving the report, the public security organ and the department responsible for the supervision and administration of production safety shall promptly investigate and handle it, and inform the informant of the investigation results.

Twelve, in violation of this decision, fireworks are set off in areas where fireworks are prohibited, and fireworks parties or other large-scale fireworks display activities are held without permission, and the public security departments shall be punished according to the relevant provisions of the Regulations on the Safety Management of Fireworks and Firecrackers.

Thirteen, to operate without permission, beyond the scope of operation, the expiration of the license to continue to operate fireworks, the emergency management department shall be punished according to the relevant provisions of the "Regulations" on the safety management of fireworks.

Fourteen, fireworks wholesale enterprises have one of the following acts, shall be punished by the emergency management department according to the relevant provisions of the "Regulations" of fireworks safety management.

(a) the establishment of fireworks storage warehouses in urban built-up areas;

(two) storing fireworks and firecrackers outside the warehouse designated by the fireworks and firecrackers business license.

15. In violation of this decision, enterprises or individuals that provide wedding, banquet and funeral services provide fireworks and firecrackers places and related services to customers in areas, places and times where fireworks and firecrackers are prohibited, and the public security department shall order them to stop the illegal behavior, which constitutes a violation of public security management, and shall be punished in accordance with the relevant provisions of the Law of People's Republic of China (PRC) on Public Security Administration Punishment.

16. Those who set off Kongming lanterns in violation of this decision will be punished according to the relevant provisions of the Fire Protection Law of People's Republic of China (PRC) and the Law of People's Republic of China (PRC) on Public Security Administration Punishment; If a crime is constituted, criminal responsibility shall be investigated according to law.
