The urban green space mentioned in these Regulations includes: parks, botanical gardens, zoos, cemeteries, street squares and other public green spaces; Green space in residential area; Green space attached to each unit; Production green space such as flower beds and nurseries; Protective green space for urban sanitation, safety isolation and other purposes; Attractions. Article 4 It is everyone's responsibility to green the city. People's governments at all levels should actively organize and carry out national voluntary tree planting activities. Where conditions permit, citizens who have reached the age of eleven, except the old, the weak, the sick and the disabled, should voluntarily plant three to five trees per person per year according to local conditions, or complete seedling raising, management and other greening tasks with corresponding labor.
All units in the city should be responsible for the environmental greening of their own units and complete the greening tasks assigned by the local government.
City residents should be responsible for the environmental greening of their homes. Article 5 The landscaping administrative department of the Municipal People's Government shall uniformly manage the city's urban landscaping work, be responsible for the organization and implementation of urban greening planning and the research work of landscaping science and technology, be responsible for guiding, coordinating and inspecting the greening work in various urban areas, and be directly responsible for the greening management of West Lake scenic spot and urban street trees.
The district landscaping administrative departments shall be responsible for the greening management within their respective jurisdictions, and shall be responsible for supervising, inspecting and guiding the greening work of the organs, troops, enterprises, institutions and people's organizations within their respective jurisdictions.
Sub-district offices shall assist the greening management department to supervise and inspect the greening protection and management of units, residential quarters and residential houses within their jurisdiction. Chapter II Planning and Management Article 6 Urban greening construction shall be carefully organized and implemented in accordance with the requirements of the overall urban planning.
By the year 2000, the overall goal of urban greening planning is: the area of public green space will reach seven to eleven square meters per capita, among which the area of public green space outside the West Lake scenic spot will reach four to six square meters per capita; The green coverage rate reached 50%, of which the green coverage rate outside the West Lake Scenic Area reached 30%.
The green area of new residential areas should not be less than 35% of the total land area; The green area of the old city reconstruction should not be less than twenty-five percent of the total land area; The green area of industrial and mining areas and large-scale construction projects (including public buildings, municipal facilities and public facilities) shall not be less than 30% of the total land area (large-scale construction projects along the street in the old city shall be determined separately). Seventh city planning departments in the examination and approval of the red line, to strictly protect the trees. New buildings and structures should keep a reasonable distance from trees to ensure that the growth of trees is not affected. If it is really necessary to cut down or transfer trees (except ancient and famous trees), it should be approved by the municipal landscaping management department in advance, and then the building red line should be delineated. Article 8 Newly-built residential areas, industrial and mining areas, large-scale construction projects (including public buildings, municipal facilities and public facilities) and residential areas in the old city reconstruction must ensure green land in accordance with the green space indicators specified in Article 6, and the planning and design must be countersigned by the municipal landscaping management department, and the greening project design will be implemented after being approved by the municipal landscaping management department. The greening project should be planned synchronously with the main project, constructed in time, and delivered within the time limit stipulated in the construction contract. Ninth design and construction units undertaking landscaping construction must hold qualification examination certificates, strictly implement technical specifications, and ensure the quality of the project. After the completion of the greening project, the landscaping management department will accept and issue certificates. Tenth to strengthen the scientific and technological research of urban landscaping, trees, flowers, green space should be scientifically distributed, and according to the principle of beautification, cultivate and select excellent tree species, and appropriately highlight urban trees, flowers and other trees and flowers with local characteristics. Chapter III Management of Tree Greenland Article 11 The ownership and income attribution of trees shall be handled in accordance with the following provisions:
First, urban landscaping management departments rely on professional teams to mobilize the masses to plant trees on public green spaces, which are owned by the state.
Two, the West Lake scenic area in the forest, according to the relevant provisions of the forest rights certification.
Three, organs, troops, enterprises and institutions and people's organizations in the land within the scope of their own investment in planting and management of trees, owned by the unit.
Four, the trees planted in the greening projects of urban residential areas are owned by the state; Tree management income belongs to the management department.
Five, the trees planted and managed at their own expense in urban private gardens are owned by individuals. When the garden land is allocated by the state to others for use, the trees should be priced according to the relevant provisions, or transplanted by the owners of the trees. Twelfth whether public or private trees are cut down, in addition to the provisions of article seventh, it must be reported to the municipal landscaping management department for approval. Without approval, no unit or individual may cut down trees. Thirteenth construction units to apply for cutting down and moving trees that do not belong to their own units, should bear the labor costs, transportation costs and greening compensation fees according to the standards stipulated by the landscaping management department. If trees cannot be planted after being cut down, they shall compensate for the loss of trees.
