Regulations of Lanzhou Municipality on Controlling Smoking in Public Places

chapter I general provisions article 1 in order to control smoking, reduce the harm of tobacco smoke, safeguard public health, maintain public health environment and improve the level of urban civilization, these regulations are formulated in accordance with the provisions of relevant laws and regulations and in light of the actual situation of this municipality. Article 2 These Regulations shall apply to the control of smoking in public places within the administrative area of this Municipality (hereinafter referred to as "tobacco control"). Article 3 The tobacco control work in this Municipality follows the principles of government-led, departmental supervision, site responsibility and public participation. Article 4 The people's governments of cities and counties (districts) shall strengthen their leadership over tobacco control within their respective administrative areas and be responsible for organizing the implementation of these Regulations.

the funds needed for tobacco control work should be included in the fiscal budget at the corresponding level to be guaranteed. Article 5 The administrative department of public health of the people's governments of cities and counties (districts) shall manage the tobacco control work within their respective administrative areas, and their specific responsibilities include:

(1) To study and formulate supporting policies for tobacco control work;

(2) to guide and inspect the tobacco control work of relevant departments and industries;

(3) organizing relevant departments as stipulated in Article 6 of these Regulations to carry out joint law enforcement on tobacco control, and regularly reporting the implementation of tobacco control laws and regulations;

(4) organizing publicity and education activities on tobacco control;

(5) Responsible for designing and issuing uniform no-smoking signs;

(6) set up a unified information platform such as tobacco control work report, complaint telephone number and email address, and establish corresponding handling mechanisms;

(7) handle the daily affairs of tobacco control work and coordinate and solve the related problems of tobacco control work. Article 6 The relevant departments of the city and county (district) shall do a good job in tobacco control according to the following duties:

(1) The administrative department of health and family planning shall be responsible for the supervision and management of tobacco control in various medical and health institutions and family planning technical service institutions at all levels;

(2) The education administrative department is responsible for the supervision and management of tobacco control in schools, kindergartens and other educational institutions at all levels, and strengthening the education on the health hazards of tobacco smoke;

(3) government agencies and units are responsible for the supervision and management of tobacco control in the workplaces of their own agencies and subordinate units;

(4) The administrative department of transportation is responsible for the supervision and management of tobacco control in public transport vehicles and their related workplaces and public places;

(5) The administrative departments of culture, public security, sports and tourism are respectively responsible for the supervision and management of tobacco control in cultural and entertainment places, hotels, stadiums and tourist attractions;

(6) the administrative department for industry and commerce is responsible for the supervision and management of tobacco control in shopping malls (stores) and various forms of tobacco advertisements;

(7) The administrative department of food and drug supervision and administration is responsible for the supervision and management of tobacco control in restaurants, places where medicines and medical devices operate;

(8) Sub-district offices of county (district) people's governments and township (town) people's governments are responsible for the supervision and management of tobacco control work in the central units in Lanzhou, provincial units in Lanzhou and foreign units in Lanzhou, chess and cards entertainment, elderly activities and other public places located in the community;

(9) Other relevant administrative departments, industry departments, enterprises and institutions shall do a good job in the supervision and management of tobacco control within their jurisdiction. Article 7 The people's governments of cities and counties (districts) shall commend and reward the units and individuals that have made outstanding achievements in tobacco control.

Encourage other social organizations and individuals to participate in tobacco control. Chapter II Places for Controlling Smoking Article 8 Places for controlling smoking within the administrative area of this Municipality are divided into places where smoking is prohibited and places where smoking is restricted.

Smoking places are completely banned, and smoking rooms or designated smoking areas are not allowed.

Fixed smoking rooms or designated smoking areas can be set up in places where smoking is restricted, and smoking is prohibited in other areas of the place. Article 9 Places where smoking is prohibited include:

(1) indoor areas of various medical and health institutions at all levels, family planning technical service institutions, welfare homes, nursing homes and sanatoriums;

(2) Indoor and outdoor areas for minors' education or activities, such as kindergartens, primary and secondary schools, secondary vocational schools and children's palaces; Indoor areas and outdoor teaching areas for adult learning, education and training institutions other than the places mentioned in this item;

(3) the indoor business premises of financial, postal and communication enterprises and the indoor areas of bookstores, shopping malls and supermarkets;

(4) Indoor areas of theaters, concert halls, archives, libraries, museums (institutes), art galleries, exhibition halls, science and technology museums, Internet service places and places for cultural and recreational activities for the elderly;

(5) Indoor areas of various stadiums and gymnasiums, outdoor areas where spectators sit and play;

(6) elevator areas in various public places;

(7) passenger buses, long-distance buses, battery cars, taxis, rail transit vehicles, ferry boats, trains and their indoor areas for waiting and ticketing;

(8) indoor areas of state organs, enterprises, institutions and social organizations;

(9) Other places where smoking is prohibited as stipulated by laws, regulations and rules. Article 1 Smoking-restricted places include:

(1) indoor areas of restaurants, bars, cafes, teahouses and other catering services;

(2) Indoor areas of hotels, hotels, hotels, resorts and other places providing accommodation and rest services;

(3) indoor areas of public leisure and entertainment places such as song (dance) halls, bathing places and chess and cards entertainment;

(4) the indoor area of the airport.

it is encouraged to set up non-smoking places such as non-smoking restaurant boxes, non-smoking rooms and non-smoking floors in restricted smoking places.

the smoking rooms or designated smoking areas in the above-mentioned restricted smoking places should be cancelled after the expiration of the time limit, and smoking control in this place should be changed from restricted smoking to no smoking. The specific time limit and scope shall be determined by the Municipal People's Government.
