Measures of People's Republic of China (PRC) Municipality on the Supervision of Temporary Imported Goods

Article 1 These Measures are formulated in accordance with the relevant provisions of the Provisional Customs Law of People's Republic of China (PRC) in order to promote economic, scientific, technological and cultural cooperation and exchanges with foreign countries and strengthen the management of temporarily imported goods. Article 2 These Measures shall apply to goods temporarily imported by international organizations, foreign governments, foreign enterprises, social organizations or individuals from Hong Kong and Macao for the purpose of economic, technological, scientific and cultural cooperation and exchange (hereinafter referred to as temporary imported goods).

Temporary imported goods applicable to these Measures include: photographic equipment, film, film, video tape, vehicles, clothing, props, etc. Imported for shooting films, video pictures and slides in China or in cooperation with domestic units; Equipment, props, clothing, vehicles, animals, etc. Introduced for sports competitions and cultural performances in China; All kinds of equipment, instruments, tools, teaching tools and transportation brought in for domestic engineering construction, academic and technical exchanges and lectures. Article 3 When temporarily importing goods into the country, the declarer shall fill in the Import Goods Declaration Form in triplicate (one of which shall be kept by the consignor after being endorsed by the customs), and attach the list of imported goods, and submit it to the approval documents of the competent department, commission, bureau of the State Council or the people's governments of provinces, autonomous regions and municipalities directly under the central government (including cities with separate plans) or organs above the competent department or bureau for declaration to the customs at the place of import. Radio equipment and goods that need animal and plant quarantine, drug inspection and food hygiene inspection shall also be submitted for inspection by the relevant administrative departments.

For the goods temporarily imported with the approval of the customs, the customs declarer shall pay a deposit equivalent to the tax, or provide a written guarantee recognized by the customs, and grant temporary exemption from import license and import duties, product tax (or value-added tax) or consolidated industrial and commercial tax and other taxes collected by the customs. Article 4 Where the temporarily imported goods need to be transported to other customs clearance places in China for customs formalities, the customs declarer shall go through the customs formalities in accordance with the customs supervision regulations on transit. Article 5 Goods temporarily imported shall be re-transported out of the country within 6 months from the date of import. If it is not transported out of the country after the expiration of the time limit, the applicant shall go through the formal import formalities with the customs and pay taxes according to the regulations. If it is necessary to extend the use period in China for some reason, an application shall be submitted to the customs before the expiration, and the extension formalities shall be handled after examination and approval by the customs. After the expiration of the extension period, it will not be extended unless it is specially approved by the General Administration of Customs. Article 6 When temporarily imported goods are transported out of the country, the declarant shall fill out the Export Goods Declaration Form in triplicate, and submit the Import Goods Declaration Form and the list of the goods to be transported out of the country. If the exit port is changed, the customs at the exit place shall go through the formalities of re-transportation with the original customs declaration form and the list of imported goods. After the customs at the exit place annotates the above-mentioned documents, they will be returned to the declarant for verification. Article 7 Temporary imported goods approved by the customs can only be used for specific purposes, and may not be sold, transferred or used for other purposes without the permission of the customs. Those who have not been re-transported out of the country and gone through the formal import formalities at the expiration of the period, and those who violate the provisions of these measures, shall be dealt with by the customs according to the Provisional Customs Law of People's Republic of China (PRC) and the relevant provisions of the state. Article 8 These Measures shall be implemented as of 1986 10/0/day.
