Measures of Nanjing Municipality on Tourism Management

Chapter I General Provisions Article 1 In order to strengthen the management of tourism in Nanjing, protect the legitimate rights and interests of tourists and tour operators, standardize the order of the tourism market, and promote the sustained and healthy development of tourism, these Measures are formulated in accordance with the relevant laws and regulations of the state and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to units and individuals engaged in tourism activities within the administrative area of this Municipality, including travel agencies, foreign-related hotels, designated shops, designated hotels, designated production enterprises of tourism commodities, scenic spots and resorts engaged in international and domestic tourism business. Article 3 Nanjing Tourism Bureau is the administrative department of tourism in this Municipality, and is responsible for the industry management of tourism within the administrative area of this Municipality in accordance with the principle of unified leadership and hierarchical management.

The district and county tourism industry management departments shall be responsible for the daily management of the tourism industry within their respective jurisdictions in accordance with the prescribed duties and powers. Article 4 People's governments at all levels shall incorporate tourism into the national economic and social development plan of the region, and support and support the development of tourism. Article 5 Relevant departments of planning, planning, industry and commerce administration, finance, taxation, public security, urban construction, price, health, transportation, municipal utilities, cultural relics, gardens, city appearance and religion at all levels shall, according to their respective functions and duties, cooperate with the tourism industry management departments to do a good job in the management of tourism. Article 6 The collected tourism development fees shall be used exclusively for tourism promotion in this Municipality, and provide short-term loans for tourism resources development and tourism construction projects, tourism public welfare expenditures, tourism education subsidies and other expenditures for tourism development in this region. Chapter II Tourism Resources Development and Tourism Construction Projects Article 7 Tourism resources development and tourism construction projects refer to the development and construction of natural and cultural landscapes with tourism value, including man-made landscapes, amusement places and supporting facilities for tourists. Eighth tourism resources development and tourism construction projects should be adapted to the overall urban planning and tourism development planning, and the architectural style should be coordinated with the surrounding environment. Ninth new construction, renovation and expansion of tourism construction projects should be approved by the tourism industry management department, and then submitted for approval according to the provisions of the national capital construction procedures. Tenth tourism construction projects that are included in the city's tourism development plan can enjoy relevant preferential policies within the scope of municipal authority after being approved by the municipal tourism industry management department. Eleventh units, individuals and foreign investors are encouraged to invest in the development of tourism resources and the construction of tourism service facilities. Foreign businessmen can enjoy preferential policies for the development of tourist attractions and the construction of tourist service facilities according to the relevant provisions of the state, province and city. Twelfth development of tourism construction projects, involving cultural relics, religion and other content, should be in accordance with the relevant provisions of the administrative departments of cultural relics, religion and other consent. Chapter III Travel Agencies Article 13 Travel agencies refer to enterprises engaged in tourism business for the purpose of making profits. Fourteenth travel agencies applying for international and domestic tourism business shall apply for approval in accordance with the procedures stipulated in the Regulations on the Administration of Travel Agencies and the Detailed Rules for the Implementation of the Management Conditions of Travel Agencies. Fifteenth travel agencies engaged in domestic tourism business shall pay the travel agency quality deposit to the municipal tourism industry management department in accordance with the regulations. Sixteenth travel agencies should carry out business activities in accordance with the approved business scope, perform travel contracts and abide by business ethics. Do not engage in tourism business by unfair means that harm competitors. Seventeenth travel agencies should employ tour guides who hold tour guide qualification certificates, and shall not employ tour guides who have not obtained tour guide qualification certificates. Eighteenth travel agencies engaged in scenic tourism business in this city must clearly mark the price and give the tickets to tourists. Travel agencies shall ensure the quality of tourism, and shall not change tourist routes, connecting points or missing points without authorization. The advertisement of tourist attractions must be consistent with the reality of tourist attractions. Nineteenth foreign countries need to set up a travel agency in this city, it should be approved by the tourism industry management department. Chapter IV Foreign-related Tourist Hotels Article 20 Foreign-related tourist hotels refer to hotels that mainly receive foreigners, overseas Chinese, overseas Chinese and compatriots from Taiwan Province Province and Macao. Twenty-first foreign-related hotels must be approved by the tourism industry management department and hold business licenses, tax registration certificates, special trade licenses, hygiene licenses and fire safety certificates before they can operate. Foreign-related hotels for Muslim tourists must also be approved by the administrative department of ethnic and religious affairs according to regulations. Twenty-second foreign-related tourist hotels applying for star rating shall apply for hotel star rating in accordance with the standards stipulated in the Classification and Evaluation of Star Rating of Foreign-related Tourist Hotels.

One-star and two-star foreign-related tourist hotels are approved by the Municipal Tourism Bureau, three-star foreign-related tourist hotels are reported to the Provincial Tourism Bureau for approval, and four-star and five-star foreign-related tourist hotels are reported to the National Tourism Administration for approval. Twenty-third star-rated foreign-related tourist hotels shall provide corresponding services to their guests according to the star-rated standards. Foreign-related tourist hotels that have not been rated as stars shall not use terms related to stars for publicity. Twenty-fourth star tourist hotels shall, in accordance with the provisions of the star rating system, accept the star inspection and review by the tourism industry management department. Chapter V Designated Tourist Units Article 25 Designated tourist units refer to units that have the ability to provide tourist services and are engaged in the reception business of tour groups.
