Regulations on the Protection of the Mausoleum of the First Qin Emperor in Shaanxi Province (202 1 Revision)

Article 1 In order to strengthen the protection of the Mausoleum of the First Qin Emperor, ensure the authenticity, integrity and harmony of the Mausoleum of the First Qin Emperor as a world cultural heritage, and explore and spread its historical, artistic, scientific, cultural and social values, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Protection of Cultural Relics and relevant laws and administrative regulations, and in light of the actual situation. Article 2 These Regulations shall apply to the protection of cultural relics, tourism development, sightseeing, production and life and their supervision and management activities in the Qin Shihuang Mausoleum Protection Area.

The term "Mausoleum of the First Qin Dynasty" as mentioned in these Regulations refers to the Mausoleum of the First Qin Dynasty and its affiliated remains, which was approved by the State Council and announced as a national key cultural relics protection unit and located in the administrative area of Lintong District, Xi. Article 3 The protection of the Mausoleum of the First Qin Emperor shall follow the principles of giving priority to protection, giving priority to rescue, rational utilization and strengthening management, adhere to the principle of paying equal attention to the protection of cultural relics and the protection of surrounding environment, and coordinate the relationship between cultural relics protection and local economic and social development, urban and rural construction and improvement of people's livelihood. Article 4 Encourage and support the research on the archaeological culture of the Mausoleum of the First Qin Emperor, interpret, display and spread the historical culture, carry forward the socialist core values, strengthen cultural self-confidence and inherit Chinese civilization. Article 5 The provincial people's government shall strengthen its leadership over the protection of the Mausoleum of Qin Shihuang, organize the preparation of the protection plan of the Mausoleum of Qin Shihuang, and coordinate and solve major problems in the protection and management of the Mausoleum of Qin Shihuang.

Xi Municipal People's Government and Lintong District People's Government are responsible for the protection of Qin Shihuang Mausoleum according to their duties, organize the implementation of the protection plan of Qin Shihuang Mausoleum, and do a good job in land acquisition, surrounding environment management, relocation in different places, tourism development and other related work.

The street office where Qin Shihuang Mausoleum is located assists in the related work of protecting Qin Shihuang Mausoleum. Sixth provincial cultural relics administrative departments shall supervise and guide the protection of cultural relics in the Mausoleum of Qin Shihuang; The administrative departments of cultural relics in Xi City and Lintong District shall, in accordance with their duties, undertake the supervision and administration of the protection of cultural relics in Qin Shihuang Mausoleum and the administrative law enforcement work according to law.

Public security, culture and tourism, natural resources, housing and urban and rural construction, ecological environment, agriculture and rural areas, urban management, market supervision, forestry and other relevant departments shall, within the scope of their respective duties, do a good job in the protection of the Mausoleum of the First Qin Emperor. Seventh Qin Shihuang Mausoleum Protection Agency is responsible for the specific work of cultural relics protection of Qin Shihuang Mausoleum, and performs the following duties:

(a) to participate in the preparation and implementation of the protection plan of the Qin Shihuang Mausoleum;

(2) To undertake the archaeological investigation, exploration and excavation of the Mausoleum of the First Qin Emperor;

(3) Organizing the collection and collection of cultural relics unearthed from the Mausoleum of the First Qin Emperor;

(four) to carry out relevant exhibition and utilization, academic research, publicity and education, exchanges and cooperation;

(five) to put forward opinions on the relevant construction plans and projects implemented in the Qin Shihuang Mausoleum Protection Area;

(six) to establish and improve the management system of cultural relics, and to prepare and organize the implementation of emergency plans for safety protection;

(seven) other work related to the protection of cultural relics of the Qin Shihuang Mausoleum. Article 8 The funds for the protection, management and maintenance of the Qin Shihuang Mausoleum shall be included in the financial budget by the people's governments of the provinces, Xi and Lintong.

Tickets and other business income of the Mausoleum of the First Qin Emperor shall be turned over to the state treasury, and two lines of revenue and expenditure shall be implemented for the protection of cultural relics, and no organization or individual may occupy or misappropriate them. Article 9 Organizations and individuals are encouraged to participate in the protection of the Mausoleum of the First Qin Emperor through donations and voluntary services.

The protection agency of the Mausoleum of the First Qin Emperor shall manage and use the donated property according to law and shall not use it for other purposes. Article 10 All organizations and individuals have the obligation to protect the Mausoleum of Qin Shihuang, and have the right to stop and report acts that damage or destroy the Mausoleum of Qin Shihuang, its historical features and the surrounding natural environment. Eleventh provinces, Xi, Lintong District People's governments and their relevant departments shall commend and reward organizations and individuals that have made outstanding contributions to the protection of the Mausoleum of the First Qin Emperor. Twelfth Qin Shihuang Mausoleum Protection Plan organized by the provincial people's government, submitted to the administrative department of cultural relics of the State Council for approval, promulgation and implementation.

The protection planning of the Mausoleum of the First Qin Emperor shall conform to the requirements of the Convention for the Protection of the World Cultural and Natural Heritage, and be connected with the planning of national territory and space, the planning of ecological environment protection in Qinling Mountains, the planning of Mount Li scenic spot and the planning of the protection of historical and cultural cities in Xi. Thirteenth according to the needs of the protection planning and cultural relics protection of the Qin Shihuang Mausoleum, the land collectively owned by the rural areas in the protected areas can be expropriated as state-owned land according to law.

Requisition of land owned by rural collectives shall be compensated according to law. Article 14 The Mausoleum of the First Qin Emperor is divided into protected areas and construction control zones. The scope of protection shall be delineated and published by the provincial people's government according to law; After the approval of the provincial people's government, the construction control zone shall be demarcated and published by the provincial cultural relics administrative department in conjunction with the provincial natural resources administrative department according to law.

The delineation of the scope of protection and the construction control zone of the Qin Shihuang Mausoleum should be connected with the heritage areas and buffer areas needed for the protection of world cultural heritage, and attention should be paid to the protection and coordination with the surrounding environment of the Qin Shihuang Mausoleum.

If it is necessary to change the scope of protection or build a control zone, it shall be submitted for approval and announced in accordance with the provisions of the first paragraph of this article. Fifteenth provincial people's government shall set up protection signs and boundary markers, and no organization or individual may move or damage them without authorization.
