Can farmland change the nature of farmland?

The land contracted by farmers shall not change the nature of land use without legal approval, and shall not be used for non-agricultural construction.

The government has strict restrictions on the nature of land that can be changed according to law. With the approval of the relevant departments, the nature of the land can be changed to industrial land. However, changing the nature of the land requires the consent of the original landowner, and others may not change it without authorization.

The nature of land is divided into three categories: agricultural land, construction land and unused land. These include:

1, agricultural land refers to the land directly used for agricultural production, including cultivated land, woodland, grassland, farmland water conservancy land, aquaculture water surface, etc.

2. Construction land refers to the land for building buildings and structures, including urban and rural residential and public facilities, industrial and mining land, transportation and water conservancy facilities, tourism land and military facilities;

3. Unused land refers to land other than agricultural land and construction land, such as barren hills, gullies, hills and beaches.

Establishment and registration of land contractual management right The land contractual management right was established when the land contractual management right contract came into effect. The registration authority shall issue certificates such as land contractual management right certificate and forest right certificate to the land contractual management right holder, and make registration to confirm the land contractual management right.

Article 334

Exchange and transfer of land contractual management right The holder of land contractual management right has the right to exchange and transfer land contractual management right according to law. Without legal approval, the contracted land shall not be used for non-agricultural construction.

Article 4 of the Land Administration Law of the People's Republic of China

The state formulates the overall land use planning, defines the land use, and divides the land into agricultural land, construction land and unused land. Strictly restrict the conversion of agricultural land into construction land, control the total amount of construction land, and implement special protection for cultivated land.
