Measures for the implementation of meteorological administrative licensing

Chapter I General Provisions Article 1 In order to standardize meteorological administrative licensing, protect the legitimate rights and interests of citizens, legal persons and other organizations, and ensure and supervise the effective implementation of administrative management by competent meteorological departments, these Measures are formulated in accordance with the Administrative Licensing Law of People's Republic of China (PRC), the Meteorological Law of People's Republic of China (PRC), the Regulations on Weather Modification, the Regulations on General Aviation Flight Control and other relevant laws and regulations. Article 2 The meteorological administrative license mentioned in these Measures refers to the act of allowing citizens, legal persons or other organizations to engage in specific activities upon application and examination according to law. Article 3 These Measures shall apply to the implementation of meteorological administrative licensing.

These Measures shall not apply to the examination and approval of personnel, finance, foreign affairs and other matters by the competent meteorological department for its internal organs, directly affiliated institutions and subordinate competent meteorological departments. Article 4 The implementation of meteorological administrative license shall follow the principles of openness, fairness and impartiality.

The provisions, technical standards and technical specifications of meteorological administrative licensing shall be published; Without publication, it shall not be used as the basis for the implementation of meteorological administrative license. The implementation and results of meteorological administrative licensing shall be made public, except those involving state secrets, commercial secrets or personal privacy.

Applicants who meet the statutory conditions and standards have equal rights to obtain meteorological administrative licenses according to law, and the competent meteorological departments shall not discriminate. Article 5 The implementation of meteorological administrative license shall follow the principle of convenience and high efficiency, provide quality services and improve work efficiency. Sixth citizens, legal persons or other organizations have the right to make statements and defend the meteorological administrative license implemented by the competent meteorological departments; Have the right to apply for administrative reconsideration or bring an administrative lawsuit according to law; If the competent meteorological department illegally implements the meteorological administrative license and its legitimate rights and interests are damaged, it has the right to claim compensation according to law. Article 7 The meteorological administrative license obtained according to law shall not be transferred.

The licensee shall not alter, forge, resell, lease or lend the meteorological administrative license certificate or illegally transfer the meteorological administrative license in other forms. Article 8 When implementing meteorological administrative license, the competent meteorological department shall not attach other conditions other than the statutory conditions, and shall not ask the applicant for improper requirements such as purchasing designated products or accepting paid services.

The competent meteorological departments and their staff shall not ask for or accept the property of the applicant or seek other benefits when handling meteorological administrative licenses or implementing supervision and inspection. Chapter II Permitted Projects and Implementing Organs Article 9 Meteorological administrative licensing shall be implemented by the competent meteorological departments at or above the county level within the scope of statutory functions and powers. Tenth the following meteorological administrative licensing items shall be implemented by the competent meteorological department of the State Council:

(a) the relocation of the National Reference Climate Station (National Climate Observatory) and the National Basic Meteorological Station (National Meteorological Observatory) for approval;

(two) new construction, expansion and reconstruction projects to avoid harm to the national reference climate station (National Climate Observatory), the national basic meteorological station (National Meteorological Observatory) meteorological observation environment approval;

(three) to review the important meteorological facilities construction projects within the corresponding examination and approval authority;

(four) the examination and approval of the license for the use of meteorological special technical equipment;

(five) the approval of the license for the use of weather modification equipment;

(6) Grade A qualification of the design or construction unit of lightning protection engineering;

(seven) the examination and approval of overseas organizations, institutions and individuals engaged in meteorological activities in China;

(eight) other meteorological administrative licensing items implemented by the competent meteorological departments of the State Council as stipulated by laws and administrative regulations. Eleventh the following meteorological administrative licensing items shall be implemented by the competent meteorological departments of provinces, autonomous regions and municipalities directly under the central government:

(a) the general meteorological station (regional meteorological station) relocation approval;

(two) new construction, expansion and reconstruction projects to avoid harm to the general meteorological station (regional meteorological station) meteorological observation environment approval;

(three) to review the important meteorological facilities construction projects within the corresponding examination and approval authority;

(four) to organize the qualification examination and approval of weather modification operations;

(five) the qualification examination and approval of weather modification operators;

(six) the examination and approval of the transfer of operation equipment between weather modification operation units;

(seven) review of the use of meteorological data in the atmospheric environmental impact assessment of construction projects;

(eight) lightning protection device testing unit qualification;

(nine) lightning protection engineering professional design or construction unit B (C) qualification;

(ten) lightning protection device design audit;

(eleven) lightning protection device completion acceptance;

(twelve) the qualification of the unit that raises and releases unmanned free balloons or tethered balloons;

(thirteen) the approval of unmanned free balloons or tethered balloons;

(14) Other meteorological administrative licensing projects implemented by the competent meteorological departments of provinces, autonomous regions and municipalities directly under the Central Government as stipulated by laws, regulations and local government rules. Twelfth the following meteorological administrative licensing items shall be implemented by the competent meteorological departments of the city divided into districts:

(a) to review the use of meteorological data in the atmospheric environmental impact assessment of construction projects;

(two) lightning protection device design audit;

(3) Completion acceptance of lightning protection device;

(four) the qualification of the unit that raises and releases unmanned free balloons or tethered balloons;

(five) to approve the activities of raising and releasing unmanned free balloons or tethering balloons;

(six) other meteorological administrative licensing projects implemented by the municipal competent meteorological departments with districts as stipulated by laws, regulations and local government rules.
