Measures of Bengbu Municipality on Implementing the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution

Chapter I General Provisions Article 1 These Measures are formulated according to the actual situation of this Municipality for the purpose of implementing the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution, protecting the atmospheric environment and safeguarding public health. Article 2 These Measures shall apply to the prevention and control of air pollution and its supervision and management activities within the administrative area of this Municipality. Article 3 The prevention and control of air pollution should aim at improving the quality of the atmospheric environment, and adhere to the principles of source control, planning first, comprehensive prevention and control, coordinated control, universal control and liability for damage. Article 4 The people's governments of cities, counties and districts shall be responsible for the quality of atmospheric environment in their respective administrative areas.

The competent administrative department of environmental protection of the people's governments of cities, counties and districts shall exercise unified supervision and management over the prevention and control of air pollution.

Other relevant departments of the people's governments of cities, counties and districts shall, within their respective functions and duties, supervise and manage the prevention and control of air pollution.

Development zone management agencies, township people's governments, sub-district offices (community service centers) do a good job in the prevention and control of air pollution within the scope of their duties. Article 5 The people's governments of cities, counties and districts shall incorporate the prevention and control of air pollution into the national economic and social development plan at the corresponding level, increase financial investment in the prevention and control of air pollution, strengthen the construction of environmental law enforcement teams, and improve the ability of environmental supervision and management. Article 6 Matters concerning the prevention and control of air pollution not specified in these Measures shall be implemented in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution, the Regulations of Anhui Province on the Prevention and Control of Air Pollution and relevant laws and regulations. Chapter II Supervision and Administration Article 7 The people's governments of cities and counties shall, when making overall plans for the towns where they are located, reasonably determine the functional zoning and industrial structure layout of the towns in combination with physical geography and meteorological conditions, so as to form a spatial pattern of the towns conducive to the diffusion of atmospheric pollutants. Eighth city and county people's governments may, according to the needs of improving the quality of atmospheric environment, implement stricter atmospheric environment management and control measures in areas that do not meet the quality standards of atmospheric environment. Article 9 The municipal, county and district people's governments shall implement the target responsibility system and evaluation system for air pollution prevention and control, including the completion of the target for improving the quality of the atmospheric environment, the completion of the key tasks for air pollution prevention and control, the compliance of the total emission control indicators of key air pollutants, the use of funds, and the public satisfaction in the evaluation of the relevant departments of the people's government at the same level and the people's governments at lower levels and their responsible persons, as an important basis for their evaluation, rewards and punishments.

The evaluation results should be made public. Article 10 The municipal, county and district people's governments shall incorporate the emergency response to heavy polluted weather and sudden air pollution incidents into the emergency handling system, formulate and improve the emergency plan for heavy polluted weather and sudden air pollution incidents, report it to the competent administrative department of environmental protection of the people's government at the next higher level for the record, announce it to the public, and organize its implementation.

Enterprises and institutions that may have air pollution accidents shall formulate emergency plans for air pollution emergencies in accordance with the provisions of the state and the province, and report them to the competent administrative department of environmental protection and relevant departments for the record.

The competent administrative department of environmental protection of the Municipal People's Government shall, jointly with the meteorological department, establish a monitoring and early warning mechanism for heavy polluted weather, strengthen the monitoring and forecasting of atmospheric environmental quality, report the possible heavy polluted weather to the Municipal People's Government in time, and the Municipal People's Government shall determine the early warning level and release it in time. Article 11 The competent administrative department of environmental protection of the Municipal People's Government shall, jointly with the departments of development and reform, economy and informatization, determine and publish the list of key air pollutant discharge units according to the requirements of the atmospheric environmental carrying capacity of the administrative region, the total emission control indicators of key air pollutants and the types, quantities and concentrations of air pollutants discharged by pollutant discharge units.

Key air pollutant discharge units shall install and use automatic monitoring equipment for air pollutant discharge in accordance with relevant state regulations and monitoring norms, and connect with the monitoring equipment of the competent administrative department of environmental protection to ensure the normal operation of the monitoring equipment, and be responsible for the authenticity of the monitoring data.

Automatic monitoring data can be used as the basis for the administrative department of environmental protection to implement administrative penalties and other regulatory enforcement. Article 12 The people's governments of counties and districts, the administrative departments of environmental protection of the people's governments of cities, counties and districts, and other departments and units responsible for environmental protection supervision and management have one of the following acts, and the directly responsible persons in charge and other directly responsible persons shall be given demerit, gross demerit or demotion; Causing serious consequences, given dismissal or dismissal, the main person in charge to resign:

(a) does not meet the conditions of administrative license, no administrative license;

(2) Covering up environmental violations;

(3) Failing to make a decision to suspend production or business or close down according to law;

(4) Failing to promptly investigate and deal with acts that exceed the standard, evade supervision and discharge pollutants, and cause environmental accidents and ecological damage due to failure to implement ecological protection measures;

(5) Failing to cope with the heavily polluted weather and performing their duties, thus causing serious consequences;

(6) Tampering with, forging or instructing to tamper with or forge monitoring data;

(seven) environmental information should be made public in accordance with the law but not made public;

(eight) after receiving the report, it fails to investigate in time or keep the relevant information of the informant confidential;

(nine) other illegal acts as prescribed by laws and regulations.
