Regulations of Liaoyang Municipality on the Management of Fireworks and Firecrackers Sales (202 1 Revision)

Article 1 In order to strengthen the safety management of fireworks and firecrackers, ensure personal and property safety, improve air quality and reduce noise pollution, these Regulations are formulated in accordance with the Regulations of the State Council Municipality on the Safety Management of Fireworks and Firecrackers and relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the sale and discharge of fireworks and firecrackers within the administrative area of this Municipality. Article 3 Fireworks and firecrackers as mentioned in these Regulations refer to fireworks and firecrackers products and civil black powder, pyrotechnics, fuses and other articles used for the production of fireworks and firecrackers.

The use of electronically excited gasoline, oxygen, gas and other substances that can produce explosive sounds and flash salutes shall be managed with reference to these Provisions. Article 4 This Municipality shall impose restrictions on the sale and discharge of fireworks and firecrackers. Fireworks and firecrackers will be set off within a limited time within the city. Fireworks and firecrackers can be set off from the 23rd day of the twelfth lunar month to the 15th day of the first month of the following year. Fireworks and firecrackers are prohibited at other times.

If the relevant organs and organizations in this Municipality need to set off fireworks and firecrackers during festivals such as celebrations, it shall be decided and announced by the Municipal People's Government.

Baita District, the communities under the jurisdiction of Qingyang Street and Tokyo Ling Street in Wensheng District, the communities under the jurisdiction of taizihe district, the streets under the jurisdiction of Hongwei District and Gongchangling District, and the built-up areas of Liaoyang County and dengta city are prohibited from selling fireworks and firecrackers. Fifth, it is forbidden to set off fireworks and firecrackers after the early warning of heavy pollution weather and the emergency plan are launched. City, county (city) District People's Government shall timely release early warning information of heavy pollution weather through news media to remind the public not to set off fireworks and firecrackers during this period. Article 6 These Regulations shall be implemented by the people's governments at all levels in this Municipality.

The public security department is responsible for the safety management of fireworks and firecrackers.

The emergency management department is responsible for the safety supervision and management of fireworks and firecrackers.

Administrative examination and approval, ecological environment, transportation, market supervision and management, education, civil affairs, housing and urban and rural construction, cultural tourism, radio and television and other departments shall be responsible for the safety management of fireworks and firecrackers according to their respective responsibilities. Seventh people's governments at all levels in this Municipality and their relevant departments shall regularly organize and carry out publicity on the safety management of fireworks and firecrackers, and increase the publicity on the safety management of fireworks and firecrackers during major festivals.

Radio, television, newspapers, Internet and other media organizations should carry out safety management of fireworks and firecrackers and public welfare publicity to change customs.

Schools and guardians of minors shall educate minors about the safety of fireworks and firecrackers, and guide them not to set off fireworks and firecrackers. Article 8 The people's governments of townships and towns and sub-district offices shall incorporate the safety management of fireworks and firecrackers into grassroots social governance, and strengthen organization, coordination, guidance and supervision.

Residents' committees and villagers' committees shall cooperate with the work related to the safety management of fireworks and firecrackers, strengthen the publicity and education of residents and villagers, guide them to change their customs, and discharge fireworks and firecrackers in accordance with the law, civilization and safety.

Hotels, restaurants, hotels and other operators and property companies in residential areas should discourage and stop the illegal discharge of fireworks and firecrackers within the responsibility management area. If it is ineffective after dissuasion and stop, it should report to the public security organ in time. Article 9 Units and individuals can report illegal sales of fireworks and firecrackers through "12345" mayor's hotline, "12350" safety reporting telephone and "10" alarm telephone, and relevant functional departments shall promptly investigate and deal with them according to law. Tenth fireworks business units should follow the principle of reasonable layout, total control and gradual reduction.

Enterprises engaged in the wholesale of fireworks and firecrackers and operators engaged in the retail of fireworks and firecrackers shall obtain corresponding business licenses according to law and operate within the permitted business scope, validity period and business premises specified in the business license.

Operators engaged in the retail of fireworks and firecrackers are prohibited from storing fireworks and firecrackers outside the business premises specified in the Fireworks and Firecrackers Business (Retail) License, and the business premises shall not be set in the same building as residential buildings. Eleventh fireworks wholesale enterprises, retail operators and discharge business units shall truthfully record the operation and discharge of fireworks and firecrackers, and encourage the use of information technology to record the flow information of fireworks and firecrackers.

This Municipality may, according to the safety needs of the public, implement real-name registration system registration and other safety control measures for the purchase of fireworks and firecrackers. Twelfth it is forbidden to set off fireworks and firecrackers in the following places:

(a) the cultural relics protection units and historical buildings in this Municipality recognized by the cultural relics protection department;

(2) Transportation hubs such as stations and railway line safety protection zones;

(3) Units that produce and store inflammable and explosive articles;

(four) in the military control zone, power transmission and transformation facilities and communication facilities safety protection zone;

(five) medical institutions, kindergartens, schools, nursing homes, parks, tourist attractions and other crowded places;

(six) forest and its surrounding areas 100 meters and other key fire prevention areas;

(seven) the office space of state organs and institutions;

(eight) more than 10 floor or more than 24 meters around the building 10 meters;

(nine) the implementation of property management area, in the area designated by the property company;

(10) Other places where fireworks and firecrackers are prohibited as stipulated by relevant laws and regulations and local people's governments at or above the county level.

The relevant responsible units that prohibit the discharge of fireworks and firecrackers shall set up warning signs to prohibit the discharge of fireworks and firecrackers, and do a good job in safety tips and prevention.
