Measures for the administration of meteorological forecast release and publication

Article 1 In order to make meteorological forecast better serve economic construction, national defense construction, social development and people's life, strengthen the management of meteorological forecast release and broadcast, and standardize the activities of meteorological forecast release and broadcast, these Measures are formulated in accordance with the Meteorological Law of People's Republic of China (PRC). Article 2 These Measures shall be abided by when engaging in meteorological forecast publishing and broadcasting activities in People's Republic of China (PRC) and other sea areas under the jurisdiction of People's Republic of China (PRC). Article 3 The competent meteorological department of the State Council shall be responsible for the national meteorological forecast release and publication management. Local competent meteorological departments at various levels shall, under the leadership of the competent meteorological departments at higher levels and the people's governments at the corresponding levels, be responsible for the release, publication and broadcasting of meteorological forecasts within their respective administrative areas. Article 4 Local people's governments at or above the county level and their relevant departments shall actively support the competent meteorological departments, establish and improve various channels for issuing and broadcasting meteorological forecasts, and ensure timely and accurate issuance and broadcasting of meteorological forecasts. Article 5 The State implements a unified release system for meteorological forecasts. Meteorological forecast shall be released to the public in a timely manner by meteorological offices and stations subordinate to competent meteorological departments at all levels through radio, television, newspapers and websites designated by people's governments at all levels in accordance with their duties.

Meteorological offices and stations subordinate to competent meteorological departments at all levels shall, jointly with local media, establish and improve the working system for publishing and broadcasting weather forecasts, emergency broadcasts, inserting important severe weather warnings and supplementing and revising weather forecasts. Article 6 Radio stations, television stations and newspapers designated by the people's governments at all levels shall arrange basically fixed time and layout, and timely publish and broadcast weather forecasts every day.

Radio stations and television stations designated by people's governments at various levels shall, according to meteorological changes and needs, broadcast and insert important severe weather warnings and supplement and revise meteorological forecasts in a timely manner.

If other media need to publish and broadcast meteorological forecasts, they shall sign a publishing agreement with the meteorological offices and stations affiliated to the local competent meteorological department, and both parties shall provide and broadcast meteorological forecasts in accordance with the agreement. Article 7 Meteorological forecasts that have a significant impact on economic construction, national defense construction, social development and people's lives shall be timely released by the competent meteorological departments at or above the provincial level according to their functions and powers, or released to the public by designated spokespersons. Article 8 The competent meteorological departments at or above the provincial level shall implement an interview and registration system for meteorological forecasts and other information that have a significant impact on economic construction, national defense construction, social development and people's lives. Article 9 Meteorological offices and stations subordinate to competent meteorological departments at all levels shall be responsible for issuing meteorological forecasts within their areas of responsibility to serve the forecast. The forecast service responsibility area shall be implemented in accordance with the relevant provisions of the competent meteorological department of the State Council.

When the meteorological forecast provided by meteorological offices and stations exceeds the responsibility area of this forecast business, meteorological offices and stations shall use the real-time meteorological forecast provided by meteorological offices and stations affiliated to the competent meteorological departments across the responsibility area. Article 10 Encourage the media to actively publish and broadcast weather forecasts. The media must use the real-time weather forecast provided by the meteorological stations affiliated to the local competent meteorological departments, and indicate the name and release time of the release station. The media shall not broadcast or reprint weather forecasts from other sources in any form.

Meteorological forecast belongs to meteorological scientific and technological achievements, and the production and distribution units enjoy their ownership and are protected by relevant laws and regulations.

Without the consent of the weather forecast station, the media shall not change the content of the weather forecast. Article 11 The State encourages relevant scientific research and teaching institutions, academic organizations and individuals to study and discuss the techniques and methods of weather forecasting and climate forecasting. Their research conclusions and opinions can be provided to the meteorological stations affiliated to the local competent meteorological departments for comprehensive consideration in weather forecast and climate forecast, and can also be exchanged at professional and technical meetings, but they shall not be released to the public in any form. Twelfth other relevant departments of the State Council and other relevant departments of the people's governments of provinces, autonomous regions and municipalities directly under the central government shall make use of this system to provide special meteorological forecasts. Thirteenth in violation of the provisions of these measures, one of the following acts, the relevant competent meteorological departments can be ordered to correct, give a warning, and may impose a fine of 10000 yuan:

(a) unauthorized release and broadcast of weather forecast;

(2) Providing the obtained meteorological forecast to other media without authorization;

(3) broadcasting or reprinting the weather forecast without permission;

(4) changing the contents of the weather forecast without authorization, causing adverse social reactions or having a certain impact. Article 14 If the staff of the meteorological offices and stations affiliated to the competent meteorological departments at all levels neglect their duties and fail to release the meteorological forecast in time as required, resulting in serious consequences, they shall be given administrative sanctions by the competent meteorological departments according to law; If it causes great losses to national interests and people's lives and property and constitutes a crime, criminal responsibility shall be investigated according to law. Article 15 If radio stations and television stations designated by people's governments at various levels fail to timely release and broadcast weather forecasts in accordance with regulations, or fail to timely increase or insert important severe weather warnings and supplement or revise weather forecasts in accordance with regulations, the units to which they belong shall give administrative sanctions to the persons who are directly responsible according to law; Causing casualties or heavy property losses, which constitutes a crime, shall be investigated for criminal legal responsibility according to law. Article 16 The term "media" as mentioned in these Measures refers to public-oriented information carriers such as radio, television, newspapers, Internet, telephone voice, mobile communication and wireless paging.

The term "weather forecast" as mentioned in these Measures refers to the disastrous weather warning, daily short-term weather forecast, short-term climate forecast and pre-assessment of climate change that can be released to the society.
