Regulations of Changzhi Municipality on the Prevention and Control of Air Pollution

Chapter I General Provisions Article 1 In order to protect and improve the environment, prevent and control air pollution, safeguard public health, promote the construction of ecological civilization and promote the sustainable development of economy and society, these Regulations are formulated in accordance with the Environmental Protection Law of People's Republic of China (PRC), the Law on Prevention and Control of Air Pollution of People's Republic of China (PRC), the Regulations on Prevention and Control of Air Pollution of Shanxi Province and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the prevention and control of air pollution and its supervision and management within the administrative area of this Municipality. Article 3 The prevention and control of air pollution should aim at improving the quality of the atmospheric environment, and follow the principles of people-oriented, prevention first, source control, planning first, comprehensive policy, and responsibility for damage. Article 4 The people's governments of cities and counties (districts) shall be responsible for the quality of the atmospheric environment in their respective administrative areas, formulate plans and take measures to control or gradually reduce the emission of atmospheric pollutants, so that the quality of the atmospheric environment can meet the prescribed standards and be gradually improved.

Township (town) people's governments and sub-district offices shall, in accordance with the work arrangements of the people's governments at higher levels and relevant departments, do a good job in the prevention and control of air pollution. Fifth city and county (District) people's government department in charge of ecological environment of the administrative area of air pollution prevention and control of unified supervision and management.

Other departments of the people's governments of cities and counties (districts) shall, according to their respective responsibilities, supervise and manage the prevention and control of air pollution. Article 6 This Municipality implements the target responsibility system and assessment system for the prevention and control of air pollution. The Municipal People's Government shall assess the completion of the county (District) people's government's goal of improving the quality of the atmospheric environment and the key tasks of air pollution prevention and control. The evaluation results shall be announced to the public. Article 7 Enterprises, institutions and other producers and operators shall bear the main responsibility for the prevention and control of air pollution, take measures to prevent and reduce air pollution, and be liable for the damage caused according to law. Article 8 Citizens should enhance their awareness of atmospheric environmental protection, advocate a low-carbon and thrifty lifestyle, and consciously fulfill their obligations of atmospheric environmental protection. Chapter II Supervision and Administration Article 9 This Municipality implements the system of controlling the total discharge of key air pollutants.

The Municipal People's Government shall decompose the total air pollutant emission control indicators issued by the provincial people's government step by step and implement them to the county (District) people's government.

The county (District) people's government shall decompose the annual total control index of key air pollutants into pollutant discharge units. Tenth city and county (District) people's government in the preparation of urban and rural planning, should fully consider the natural landforms and meteorological conditions within their respective administrative areas, scientifically plan the spatial structure and overall layout of ventilation corridors, as well as the density and height of buildings, and maintain the smooth flow of urban ventilation corridors. Eleventh city and county (District) people's governments shall establish a grid supervision and management system for the prevention and control of air pollution. According to the principles of territorial management, graded responsibility, compartmentalization and comprehensive coverage, the grid units are scientifically divided, and the grid management objects, management standards and responsible persons are clearly defined. Article 12 The competent department of ecological environment of the people's governments of cities and counties (districts) shall be responsible for organizing the construction and management of the monitoring network of atmospheric environmental quality and atmospheric pollution sources in their respective administrative areas, carrying out the monitoring of atmospheric environmental quality and atmospheric pollution sources, and uniformly releasing the information of atmospheric environmental quality in their respective administrative areas. Thirteenth sewage units should establish a responsibility system for atmospheric environmental protection, clarify the relevant responsibilities and responsible persons, and set up air pollutant discharge ports and their signs in accordance with relevant regulations.

Key pollutant discharge units shall install and use automatic monitoring equipment for air pollutant discharge, and connect with the monitoring equipment of the competent department of ecological environment to ensure the normal operation of the monitoring equipment.

Key pollutant discharge units shall truthfully disclose their names, discharge methods, discharge concentration and total amount, excessive discharge, and the construction and operation of pollution prevention facilities to the public, and accept social supervision.

It is forbidden to occupy, damage or move or modify the atmospheric environmental quality monitoring facilities and automatic monitoring equipment for atmospheric pollutant discharge without authorization. Article 14 Under any of the following circumstances, the competent department of ecological environment of the Municipal People's Government shall, jointly with relevant departments, interview the principal responsible person of the local people's government, and the interview shall be made public.

(1) failing to complete the atmospheric environmental quality target;

(two) the emission of atmospheric pollutants exceeds the total control index;

(3) Major atmospheric environmental pollution accidents;

(four) do not implement the national and provincial environmental protection policies and work arrangements, resulting in outstanding atmospheric environmental problems in the region;

(five) did not complete the task of rectification of environmental protection inspectors.

In case of any of the circumstances mentioned in Items (1) and (2) of the preceding paragraph, the examination and approval of the environmental impact assessment documents of construction projects with the total amount of new key air pollutants in the region shall also be suspended. Fifteenth city and county (District) people's governments shall incorporate the heavy pollution weather response into the emergency management system.

City and county (District) people's governments shall formulate emergency plans for heavy polluted weather, report them to the competent department of ecological environment of the people's government at the next higher level for the record, and announce them to the public.

City, county (District) people's government shall, according to the warning level of heavy pollution weather, start the emergency plan in time. Article 16 An enterprise that discharges atmospheric pollutants shall formulate an emergency action plan for heavy polluted weather according to the emergency plan for heavy polluted weather formulated by the people's government of the city or county (district), and file it with the competent department of ecological environment of the people's government of the city or county (district) where it is located.

City, county (District) people's government to start the emergency plan for heavy pollution weather, air pollutant discharge enterprises should promptly start the emergency response operation plan for heavy pollution weather.
